Peraturan Negeri merupakan dasar dalam bertindak oleh pemerintah, sehingga arah pembentukan peraturan harus menjawab kebutuhan masyarakat. Kenyataan yang terjadi di pemerintah Negeri kewenangan pembentukan peraturan Negeri dimiliki oleh Saniri Negeri. Realita yang terjadi sumber daya yang ada pada Saniri Negeri Nusaniwe masih terbatas kemampuannya dalam membentuk peraturan Negeri. Adapun metode yang dipakai dalam pengabdian ini adalah metode penyuluhan dan praktek pembentukan peraturan negeri di Negeri Nusaniwe. Harapan kami kegiatan ini dapat menambah kapasitas pengetahuan Saniri Negeri Nusaniwe dalam mebenruk Peraturan Negeri.

Introduction: The authority possessed by the village government in forming village regulations, in addition to the authority possessed by the village, in the administration of government in the village must be based on mutually established regulations. Counseling carried out in the Poka village with the consideration that if you look at the development of the formation of village regulations, there are still many obstacles faced, namely the limitations of human resources.Purposes of Devotion: Provide legal understanding of Establishment of village regulations in Poka Village, Teluk Ambon District, Ambon City. Method of Devotion: The method used is counseling law to the community, especially to the Poka village government and the Poka village BPD.Results of the Devotion: The implementation of these activities is known that there are many problems in the capacity to form village regulations, this has an impact on the administration of government which is only based on ordinary government management, without any breakthroughs in the formation of village regulations which are the basis for innovation in the development of poka village development.

The Local Representative Council is one of barometers of reformation success in Indonesian state administration. as the Local Representative Council becomes a new legislative institution that will strengthen and work closely with previously-established legislative institutions (People's Representative Council). This study aims to: (1) find out and identify the status of legislation function of Local Representative Council based on the regulation after the decision of Constitutional Court; and (2) find out and identify the implementation of legislation function of Local Representative Council based on the regulation after the decision of Constitutional Court. The research method used normative research with a statute approach and a conceptual approach and analyzed descriptive qualitative. The results show that the constitutional authority of Indonesian Local Representative Council as a legislator institution is still very weak. Since the decision of Constitutional Court was read, from normative perspective, there is no any legislation change, either in planning, proposing, or discussing the regulation draft in the Indonesian Parliament, related to the authority of Indonesian Local Representative.

Penelitian ini bertujuan yang Pertama Mengkaji dan menganalisis indikator masyarakat hukum adat di Indonesia berdasarkan ketentuan Pasal 18B ayat (2) UUD 1945; Kedua, Mengkaji dan menganalisis pengaturan hak-hak dan wewenang masyarakat hukum adat dalam pengelolaan sumber daya alam pada petuanan laut; Jenis penelitian yang digunakan dalam penelitian ini yaitu Penelitian ini akan menggunakan tipe penelitian hukum normatif yaitu suatu proses untuk menemukan aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum guna menjawab isu hukum yang dihadapi serta suatu penelitian yang terutama mengkaji ketentuan-ketentuan hukum positif maupun asas-asas hukum. Hasil penelitian menunjukkan Bahwa Pengaturan eksistensi masyarakat hukum adat sebagaimana diatur dalam Pasal 18B ayat (2) UUD 1945 merupakan pengakuan bersyarat yang dilakukan oleh negara. Syarat eksistensial ini tidak perlu dicantumkan dalam Pasal 18B ayat (2) UUD 1945, oleh karena politik hukum pembentukan pasal ini sebagai upaya reformasi terhadap Undang-Undang Nomor 5 Tahun 1979. Pada hakikatnya pengaturan dalam Undang-Undang Nomor 5 Tahun 1979 tersebut bertentangan dengan Pasal 18 UUD 1945 (sebelum amandemen), karena tidak mengakui adanya hak-hak masyarakat hukum adat. Pengaturan hak dan wewenang masyarakat hukum adat dalam berbagai undang-undang tidak mengakomodir adanya hak dan wewenang masyarakat hukum adat dalam pengelolaan sumber daya alam pada wilayah pesisir (petuanan laut). Masyarakat hukum adat yang memiliki hak bawaan tentunya akan dirugikan dari pengaturan tersebut. Padahal, hak dan wewenang masyarakat hukum adat merupakan hak bawaan yang diakui dalam UUD 1945, karena itu masyarakat hukum adat tetap memiliki hak dan wewenang dalam pengelolaan sumber daya alam pada wilayah petuanan laut. Masyarakat Di Kepulauan Kei (Tanimbar Kei) secara nyata telah mengatur dalam Peraturan Adat terkait penyelenggaraan kegiatan di wilayah petuanan pesisir dan laut, menunjukan bahwa masyarakat di Kepaualauan Kei (Tanim,bar Kei) masih eksis dalam pengelolaan wilayah petuanan pesisir dan laut.

Law of the Republic of Indonesia number 19 of 2019 concerning the second amendment to law number 30 of 2002 concerning the Corruption Eradication Commission was formed with the aim of increasing the efficiency and effectiveness of efforts to eradicate corruption. In carrying out its duties, the Corruption Eradication Commission was given the authority to conduct investigations, investigations, and prosecutions (indictments) of corruption crimes involving law enforcement officers, state administrators, and other people related to corruption crimes committed by law enforcement officers or state administrators.

This study examines the implementation of the principles of participation and openness in the process of drafting village regulations. The focus of the study is directed at an in-depth analysis of the application of the principles of good governance, especially community participation and information openness in the legislative process at the village level, and identifying various factors that inhibit the application of these principles. This study uses a qualitative methodology with an empirical legal approach to obtain a comprehensive understanding of the social and legal phenomena in the process of drafting village regulations. Data collection was carried out through a series of in-depth interviews with various stakeholders, direct observation of the process of drafting village regulations, and extensive documentation studies. The results of the study indicate that the implementation of the principles of participation and openness in the drafting of village regulations has not yet reached an optimal level. Community participation still tends to be limited to the socialization stage, while information openness has not been fully integrated into each stage of the drafting of village regulations. The various inhibiting factors identified include internal aspects such as limited human resources and infrastructure, as well as external aspects such as socio-cultural conditions and local political dynamics. This study produces comprehensive recommendations for improving the quality of community participation and openness in the process of drafting village regulations.Keyword: Participation, Transparency, Village Regulations

Ambon City is the capital city in Maluku Province which has a customary law community unit called the Country, in the Village Law regulations it is obligatory to organize villages into traditional villages and villages. Determination of State in Ambon City with Regional Regulation No. 9 of 2017, if viewed from the applicable laws and regulations, the determination is not in accordance with the applicable regulations, where there must be legitimacy through the code or the Traditional Village Register Number. According to the procedure, before the determination of customary villages and villages is carried out, it is necessary to determine the recognition and protection of customary law communities, because that is a requirement for being designated as a traditional village. The research method used in this paper is normative research with a statutory approach as data primary as well as by using concepts, theories as library materials which are secondary data to analyze the issue of determining the Traditional Village in Ambon City. The results of this study indicate that until now the status of the State in Ambon City is still unclear and must be adjusted to the applicable regulations.

Currently in Indonesia child labor is not a new issue because in almost all regions in Indonesia there are still many underage children working. but not in accordance with the regulations that have been made by the government, labor issues and child labor are problems that need serious attention, regulation and supervision from the government. This study aims to analyze the considerations that must be made by the government in overcoming the problem of child labor. The problems studied in this study are about how the form of government supervision of child labor and government supervision procedures for child labor. so that how the function of government supervision of child labor and how the government's responsibility for this and has the aim of examining and analyzing how government policies in protecting child labor are in accordance with the supervisory function, what factors influence the government's responsibility to increase efforts to protect child labor.The method used in analyzing and discussing the problem of Government Supervision of Child Labor is Normative Juridical. This type of research is descriptive-analytical, the sources of legal materials used are primary legal materials and secondary legal materials. research techniques are carried out through literature review followed by descriptive analysis using qualitative methods.The results show that the government has an important responsibility to protect child labor. What the government must consider is ensuring that there is effective supervision to protect child labor. The government also needs to implement clear policies and regulations to protect child labor. This includes developing regulations that provide protection and limit child laborers' access to hazardous industries, as well as providing protection and access to education and health..

Regional governments have an important role in regulating and supervising activities related to public facilities in their area. PUB practices and the sale of funds are regulated at both national and regional levels. However, the problem from a regulatory perspective is that regulations governing PUB practices in public facilities are often unclear and even inadequate.The purpose of this research is to examine and analyze the authority of regional governments and what forms of control can be carried out by regional governments in controlling the sale of funds in public facility areas. With normative juridical research methods and the nature of descriptive analytical writing.The research results show that:1). The government has the authority to regulate the sale of funds at public facilities, further stated in Law no. 23 of 2014 Article 65 paragraph (1) states that regional heads have the task of "maintaining public peace and order". This means that the government has given authority to regional governments to carry out their respective regional affairs, including the maintenance of peace and public order. 2). The form of control carried out by regional governments to handle sales in public facilities is contained in Article 26 paragraph (2) of Minister of Social Affairs Regulation No. 8 of 2021, namely administrative sanctions and criminal sanctions. This includes strict supervision, setting up special zones, using certain regulations. The effectiveness of enforcement strategies varies depending on the context and characteristics of local communities.

According to Law Number 39 of 2008 concerning State Ministries, Article 23 to be precise states that ministers are prohibited from holding concurrent positions if the position in question is as another state official or being the head of an organization financed by the State Revenue Budget/Regional Revenue Budget. The problem that then arises is that there have been several cases of ministers holding concurrent positions as leaders of political parties. So this clearly violates the regulations regarding ministers who are prohibited from holding concurrent positions. For this reason, the implementation of the practice of holding multiple positions by ministers as leaders of political parties is not in accordance with Law Number 39 of 2008.The purpose of this study is to find out and analyze concurrent positions in accordance with the rules and regulations carried out by ministers and to find out and analyze the legal consequences of multiple ministerial positions as leaders of political parties. The research used in this writing is normative legal research.The results of this study explain that the concurrent positions carried out by the minister are in conflict with laws and regulations which have ignored Article 23 of Law Number 39 of 2008 regarding the prohibition of concurrent ministerial positions, and the legal consequences of concurrent ministerial positions as leaders of political parties will be dismissed based on President's prerogative for ministers who hold concurrent positions.
