Abstract

Untuk mencapai suatu perdamaian yang dapat disahkan maka terdapat syarat yang harus dipenuhi, yakni debitor mengajukan rencana perdamaian dan mendapat persetujuan para kreditor dengan ketentuan kuorum yang diatur dalam Pasal 281 UU Kepailitan dan PKPU. Tetapi didalam pemungutan suara persetujuan perdamaian kreditor preferen tidak diatur kedudukan hak suaranya padahal UU Kepailitan dan PKPU menentukan bahwa perjanjian perdamaian yang telah disahkan mengikat semua jenis kreditor. Sebagai contohnya perkara PT. Kertas Leces (Persero), buruh selaku kreditor preferen diakui dalam rencana perdamaian namun buruh ini tidak dimintai hak suara Di kemudian hari debitor terbukti lalai dan buruh menuntut pembatalan perdamaian hingga akhirnya debitor dinyatakan pailit. Dalam skripsi ini akan membahas mengenai kedudukan hak suara kreditor preferen dalam perdamaian PKPU dan upaya hukum yang dapat dilakukan ketika dikemudian hari dirugikan seperti halnya menuntut pembatalan, dengan menggunakan metode penelitian hukum yuridis normatif dan disertai pendekatan statute approach, conceptual approach, dan case approach. Hasil dari penelitian menunjukan bahwa UU Kepailitan dan PKPU tidak memberi kepastian hukum terhadap kedudukan hak suara kreditor preferen akan tetapi meskipun begitu perjanjian tetap mengikat semua jenis kreditor, sehingga menjadi legal standing dalam mengajukan suatu upaya hukum pembatalan.

Abstract

The Indonesian National Police (Polri) has the task of maintaining public order in overcoming problems of social deviation, such as sexual orientation deviation (Lesbian, Gay, Bisexual, and Transgender/LGBT). Social deviation in the Polri is limited by norms, rules, and standards of behaviour regulated by the Indonesian Police Code of Ethics (KEPP). This normative legal research analyses regulation of sexual orientation deviation in the KEPP and the enforcement of the code of ethics for sexual orientation deviation by Polri members. The author tries to find a common thread between rules, theories, and practices in compiling the KEPP concept bydeveloping previous research by Mallory et al. (2013), Faridah (2019) and Puspita (2016). Unlike the United States, which protects LGBT rights in the police organization, this is undoubtedly motivated by culture. This study shows : 1) a legal vacuum where sexual orientation deviation in the form of LGBT needs to be included in the violation of the Police’s standard of conduct in Indonesia so that the interpretation of deviation is still interpreted broadly, so deregulation is needed to realize legal reform that upholds religion and morals; also 2) the views of natural law and Human Rights on the regulation of sexual orientation deviation based on KEPP and howthe concept of imposing sanctions for the code of professional ethics if an officials and member of the Police is proven to be LGBT. This paper offers comparative insight for jurisdictions grappling with similar ethical dilemmas within law enforcement institutions in religiousconservative societies.

Abstract

General Background: Land tenure rights, particularly Building Use Rights (HGB) over Management Rights (HPL), play a crucial role in Indonesia’s legal and economic landscape.Specific Background: Extending HGB over HPL requires approval from the HPL holder, leading to legal disputes when HGB holders are unaware of their land’s status.Knowledge Gap: Limited studies address the legal mechanisms for extending HGB over HPL, especially after Government Regulation No. 18 of 2021.Aims: This study analyzes the legal framework for HGB extensions over HPL and examines legal remedies for unaware HGB holders.Results: Findings show that approval from the HPL holder is mandatory for HGB extensions, and without it, applications are rejected. Court rulings confirm this requirement.Novelty: This study clarifies recent regulatory changes and their impact on landowners.Implications: Clearer legal frameworks and better land status verification are needed to prevent disputes and ensure compliance. Highlights: Mandatory Approval: HGB extensions over HPL require approval from the HPL holder; otherwise, they are legally invalid. Regulatory Impact: Government Regulation No. 18 of 2021 reinforces strict conditions for HGB extensions, affecting landowners.
