Abstract

Kebebasan berpendapat berpotensi menjadi kejahatan dan dikriminalisasi dalam penerapan aturan di Indonesia. Penelitian artikel ini menggunakan pendekatan sosiologis. Dalam penulisan ini, dilakukan analisis hukum terhadap data yang telah diperoleh dan kemudian akan diuraikan secara deskriptif. Selain itu digunakan pendekatan perundang-undangan (statue approach). Hasil penelitian menunjukkan penanggulangan kejahatan dalam perspektif kriminologi terbagi dua, yakni sarana non-penal dan sarana penal. Sarana non-penal lebih menitikberatkan pada aspek pencegahan sebelum terjadinya kejahatan seperti penanaman nilai dan norma agar terinternalisasi dalam diri masyarakat dan memberikan edukasi agar tidak terjadi tindak pidana. Sedangkan sarana penal lebih menitikberatkan pada aspek penegakan hukum secara represif yang dilakukan saat setelah terjadi tindak pidana/kejahatan yang tindakannya berupa penegakan hukum. Dalam konteks penanggulangan tindak pidana pencemaran nama baik melalui media sosial, pananggulangan kejahatan lebih dominan kepada sarana penal atau upaya represif berupa penindakan setelah terjadi tindak pidana. Sejatinya, diperlukan dominansi dalam penanggulangan tindak pidana pencemaran nama baik melalui media sosial berupa upaya non-penal. Hal ini dapat ditempuh melalui Pendidikan moral kebangsaan ataupun kebudayaan, yang penanaman nilainya dapat dimulai dalam keluarga, Pendidikan formal dan informal, dan sosial bermasyarakat.

Abstract

Salah satu faktor penghambat vaksinasi covid-19 adalah penyebarluasan berita bohong. Penelitian ini bertujuan untuk memberikan rekomendasi dan penguatan terhadap optimalisasi fungsi penegakan hukum dalam penanggulangan berita bohong terkait vaksinasi covid-19 di Kepolisian Daerah Sulawesi Selatan. Penelitan ini menggunakan metode penelitan hukum empiris dengan pendekatan interdisipliner. Data dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan penegakan hukum tentang penanggulangan tindak pidana penyebaran berita bohong terkait vaksinasi covid-19 telah dilakukan oleh Polda Sulawesi Selatan dengan membentuk Satgas Aman Nusa. Dalam implementasinya terdapat hambatan yang bersumber dari faktor penegak hukumnya, faktor masyarakat, dan faktor kebudayaan. Sekaitan dengan hal tersebut upaya optimalisasi fungsi penegakan hukum dalam penangulangan tindak pidana berita bohong terkait vaksinasi covid-19 di Polda Sulawesi Selatan, dapat ditempuh dengan melakukan penambahan personel satgas, membenahi proses penyebarluasan informasi yang lebih terstruktur dan massif, melakukan upaya edukasi yang lebih komunikatif, dan berkolaborasi dengan berbagi pihak untuk mengatasi sumber masalah utama penyebarluasan berita bohong. Dengan demikian vaksinasi covid-19 dapat terlaksana dengan baik guna menciptakan kekebalan kelompok dalam rangka penanganan pandemi.

Hal ini dapat ditempuh melalui Pendidikan moral kebangsaan ataupun kebudayaan, yang penanaman nilainya dapat dimulai dalam keluarga, Pendidikan formal dan informal, dan sosial bermasyarakat.

Abstract

The phenomenon of early marriage that continues to occur is a polemic for the government in the midst of fulfilling the sustainable development goals. The consequences of early childhood marriage have good implications for dropout rates, health, domestic violence, mortality and the ratio of achievement of the human development index. This study purposes to determine the role of local governments in preventing marriage of school-age children. The method used in this research is legal research using the statute approach, conceptual approach and legal principles. The results of the study indicate that the role of local governments is an essential part in organizing the protection and fulfillment of children's rights in order to prevent early childhood marriages. The Child-friendly City/Regency Program coordinated by the Kementerian Pemberdayaan Perempuan dan Perlindungan Anak can help the implementation of child protection to be realized because the program has a program implementation mechanism starting from the planning stage to program evaluation which also involves various stakeholders at the central to regional levels with supervision and involvement. by the community, community organizations, educational institutions and business actors.

Abstract

Re-appraising the tax exemption of social enterprises (SEs) in Malaysia from a theoretical perspective involves the underlying frameworks that justify the current tax policies applied to SEs. SEs have increasingly become pivotal in addressing societal challenges such as poverty alleviation, environmental sustainability and community development. The approach taken by Malaysian government to taxing SEs has a notable effect in achieving their social goals. One of the significant constraints for SEs in Malaysia is their tax treatment as business entities. Despite their main purpose is for public good, identical to charitable organizations, SEs are subject to taxation like business entities. Particularly, SEs are not entitled for the tax benefit as offered to charitable organizations. The tax regulatory framework does not recognize a SEs by the legal definition and there are no established tax incentives in the current legal framework that are specific to SEs. Despite the clear fact that charity organizations and charitable activities are exempted from tax, there is no tax exemption granted for SEs in Malaysia. Consequently, SEs are treated as business entities under Income Tax Act 1967. This article utilizes the argument to justify tax exemption for SEs in Malaysia. For the purpose of this discussion, this paper applied library research approach combining legal research methodology which mainly involves document analysis such as case law, legal provision and legal theories to see how they might be used to the subject matter. The paper makes a finding that tax exemption for SEs in Malaysia could be justified based on the theories of Public Good Theory, Donative Theory and the Subsidy Theory. By applying this notion, tax exemption should be granted to SEs not only for charitable organizations

Abstract

The concept of plea bargaining in Indonesia's criminal justice system still lacks a clear and definitive standard. This study aims to examine the current application of plea bargaining in the Indonesian justice system and to explore an ideal framework for its implementation in the future. The research adopts a normative juridical approach. The findings reveal that plea bargaining remains a relatively new concept in Indonesian criminal law. The existing Criminal Procedure Code does not provide regulations for plea bargaining as an alternative method for resolving criminal cases outside of court. However, the Draft Criminal Procedure Code has introduced the concept under the term "special path" in Article 199, which allows for plea bargaining between judges, public prosecutors, and legal counsel. Plea bargaining has the potential to serve as a solution to challenges in sentencing and correctional systems, ensuring the principles of swift, simple, and cost-effective justice while safeguarding the rights of the accused and enhancing their role in legal proceedings.

Abstract

Campaigning plays a critical role in elections, enabling candidates to present their vision, mission, and programs to the public. However, Law Number 8 of 2015, lacks explicit regulations on black campaigning, especially when it occurs via electronic media. This research highlight the Regional Head Election Law only indirectly addresses defamation in Article 69 (b) and (c), which prohibits insults targeting individuals, religions, ethnicities, races, groups, and candidates. Other relevant regulations, such as the Criminal Code and the ITE Law, contain provisions on defamation, hate speech, and incitement, but they are not spesifically regulate in the context of election. This paper examines the urgency of reformulating explicit prohibitions and criminalization of black campaigning within the Regional Head Election Law. Using a normative juridical approach to examines the existing regulations, this research suggests that an amendment to the Regional Head Election Law is necessary to explicitly define and prohibit black campaigning, establishing it as a formal offense and identifying relevant legal subjects. By setting clear prohibitions, this reform would strengthen fairness and integrity in elections, prevent the spread of false information and incitement, and align with the principle of legality, ultimately enhancing the democratic process.
