Abstract

Kewenangan deportasi dimiliki oleh instansi Keimigrasian sebagai instansi utama yang mengurus warga asing di suatu negara. Di Indonesia sendiri terdapat ketentuan pengembalian atau deportasi warga negara asing (WNA). Hal ini diatur dalam Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Deportasi merupakan tindakan paksa untuk mengeluarkan orang asing dari wilayah Indonesia. Permasalahan dalam penelitian ini bagaimanakah pengaturan mengenai deportasi terhadap warga negara asing di wilayah Indonesia. Bagaimanakah akibat hukum yang diberikan kepada warga negara asing yang melakukan pelanggaran di Indonesia. Jenis penelitian yang digunakan dalam penulisan ini adalah yuridis normatif yang didukung oleh metode empiris. Kewenangan deportasi dimiliki oleh instansi Keimigrasian sebagai instansi utama yang mengurus warga asing di suatu negara. Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian mengatur bahwa deportasi merupakan salah satu Tindakan Administratif Keimigrasian dan sanksi Projusticia (Proses Peradilan) terhadap orang asing yang berada di wilayah Indonesia yang dikarenakan melakukan kegiatan berbahaya dan patut diduga membahayakan keamanan dan ketertiban umum atau tidak menghormati serta tidak menaati peraturan perundang-undangan yang berlaku di Indonesia. Abstract

The Constitution of the Republic of Indonesia mandates the right to a good and healthy living environment. However, in practice, with the large number of environmental cases still occurring today, this can of course be a criticism of the Government as the organ that is fully responsible for fulfilling these rights. The various environmental problems that occur, both damage and pollution, are not directly proportional to the law enforcement mechanisms implemented by the Government. The birth of Law no. 32/2009 (PPLH Law) apparently has not been able to answer all the problems of environmental law enforcement in Indonesia. Law Number 32 of 2009 concerning Environmental Protection and Management (UUPPLH) has included criminal provisions in Chapter XV, which consists of 23 articles. These criminal provisions are much more complete and detailed when compared to the old Law Number 23 of 1997 concerning the Environment, but there are still many things that need to be addressed in the UUPPLH, therefore in this article we will describe the existing environmental law enforcement mechanisms. applies in Indonesia.

Abstract

To determine legal certainty in an agreement, it can be analyzed through the greatest potential cause of disputes in the agreement, namely default. Default is the greatest potential for a problem or dispute in an agreement. Default is the implementation of obligations that are not fulfilled or broken promises or negligence carried out by the debtor either because they do not carry out what has been promised or even do something that according to the agreement should not be done. The term default comes from Dutch, namely "wanprestatie" which means non-fulfillment of achievements or obligations that have been set for certain parties in an agreement, either an agreement born from an agreement or an agreement arising from the law.
