Abstract

Background. Non-formal education organized for people who need provision of knowledge, skills, life skills, and attitudes to develop themselves, develop a profession, work, independent business, and / or continue their education to a higher level. Purpose. This thesis aims to analyze the legal consequences and legal processes that Courses and Training Institutions are one form of unit taken from carrying out unlicensed job training institutions in Bali. Method. This research is conducted with normative legal research method, namely through literature study of laws and regulations related to vocational training institutions and their operational licenses. Results. The results of this research are expected to provide a clear understanding of the legal consequences that can arise from misusing the work training institute license given by the Government to the work training institute in Bali, where the discussion of legal consequences and what legal process will be taken when the parties feel harmed as a result of the work training institute carrying out activities without a license in Bali. Conclusion. As well as knowing how to seek permission to legalize the operational license of a vocational training institution so that the training institution can be said to be legal. And can be a job training institution for people who need provision of knowledge skills and life skills, to develop themselves, develop their profession, work independently. Job Training Institutions also function as educational services that function as substitutes, additions, or complements to formal education in order to support education in school.Where in Government Regulation Number 5 of 2021 concerning this PP, regulates Business Licensing based on the level of risk of business activities.

Abstract

Kewenangan deportasi dimiliki oleh instansi Keimigrasian sebagai instansi utama yang mengurus warga asing di suatu negara. Di Indonesia sendiri terdapat ketentuan pengembalian atau deportasi warga negara asing (WNA). Hal ini diatur dalam Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Deportasi merupakan tindakan paksa untuk mengeluarkan orang asing dari wilayah Indonesia. Permasalahan dalam penelitian ini bagaimanakah pengaturan mengenai deportasi terhadap warga negara asing di wilayah Indonesia. Bagaimanakah akibat hukum yang diberikan kepada warga negara asing yang melakukan pelanggaran di Indonesia. Jenis penelitian yang digunakan dalam penulisan ini adalah yuridis normatif yang didukung oleh metode empiris. Kewenangan deportasi dimiliki oleh instansi Keimigrasian sebagai instansi utama yang mengurus warga asing di suatu negara. Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian mengatur bahwa deportasi merupakan salah satu Tindakan Administratif Keimigrasian dan sanksi Projusticia (Proses Peradilan) terhadap orang asing yang berada di wilayah Indonesia yang dikarenakan melakukan kegiatan berbahaya dan patut diduga membahayakan keamanan dan ketertiban umum atau tidak menghormati serta tidak menaati peraturan perundang-undangan yang berlaku di Indonesia. Abstract

A political party is defined as an organization or association founded by an individual or group of individuals who seeks to place its members in government office for the purpose of carrying out desired political policies or programs. One thing that differentiates them from other associations is the matter of conveying a substantive interest in public affairs as part of their efforts to secure the election or election of their own representatives to public office through government policy. The right to nominate Pair Candidates for President and Vice President is the exclusive right of the parties participating in the election and is not permitted or there is no possibility at all for individual or independent Pair Candidates for President and Vice President other than those proposed by the political party or combination of political parties, and those proposed by non-party organizations. Abstract

The purpose of this study is to determine how the Implementation and obstacles in the implementation of Remission Rights for Corruption Prisoners in Kerobokan Class II A Women's Prison. The type of research used in this writing is an empirical research method in the form of data collection by means of field research. The data used in this study are primary data obtained directly from informants to obtain data or information that has relevance to the author's problem, and secondary data sourced from library research. Based on the results of the research that has been carried out, it shows that the fulfillment of the right to remission for prisoners of Corruption cases in Class II A Kerobokan Women's Prison in accordance with the Correctional Law has been fulfilled and well implemented as evidenced by corruption prisoners who have received remission. Obstacles faced in the fulfillment of remission for Corruption convicts, consisting of Internal obstacles, namely delays in Receiving Verdicts and Minutes of the Implementation of Court Decisions (Execution), and External Obstacles, namely the existence of Register F for prisoners who violate the rules in prison. These obstacles can be overcome by coordinating with the Court, the Prosecutor's Office, as well as by providing knowledge to prisoners about the rules in the prison, and the community outside the prison is expected to help realize correctional goals by supporting the coaching program in the prison.ABSTRAKTujuan dari penelitian ini untuk mengetahui bagaimana Implementasi dan hambatan dalam pelaksanaan Hak Remisi bagi Narapidana Korupsi di Lapas Perempuan Kelas II A Kerobokan. Jenis penelitian yang digunakan dalam penulisan ini adalah dengan metode penelitian empiris berupa pengumpulan data dengan cara penelitian lapangan. Data yang digunakan dalam penelitian ini adalah Data primer yang diperoleh secara langsung dari informan untuk memperoleh data-data atau informasi yang ada relevansinya dengan permasalahan penulis, dan Data Sekunder yang bersumber dari penelitian kepustakaan. Berdasarkan hasil penelitian yang telah dilaksanakan, menunjukkan bahwa pemenuhan hak remisi bagi narapidana kasus Korupsi di Lapas Perempuan Kelas II A Kerobokan sesuai dengan Undang-Undang Pemasyarakatan sudah terpenuhi dan terlaksana dengan baik dibuktikan dengan narapidana korupsi yang sudah mendapatkan remisi. Hambatan yang dihadapi dalam pemenuhan remisi bagi narapidana Korupsi, terdiri atas hambatan Internal yakni keterlambatan Penerimaan Petikan Putusan dan Berita Acara Pelaksanaan Putusan Pengadilan (Eksekusi), dan Hambatan Eksternal yaitu Adanya Register F bagi Narapidana yang melanggar aturan di dalam Lapas. Hambatan tersebut dapat diatasi dengan berkoordinasi dengan pihak Pengadilan, Kejaksaan, maupun dengan memberikan pengetahuan kepada warga binaan tentang aturan yang ada di dalam Lapas, serta masyarakat yang berada di luar lapas diharapkan dapat membantu mewujudkan tujuan pemasyarakatan dengan mendukung program pembinaan dalam lapas.

Abstract

Praktik hak angket sering mengalami kendala, sehingga banyak yang menilai belum ada tujuan dan skema pelaksanan yang jelas. Hak angket seharusnya dapat mendukung fungsi legislasi, anggaran, dan pengawasan DPR, namun seringkali hak angket lebih sering digunakan untuk kepentingan politik. Tujuan penelitian ini adalah untuk mendeskripsikan, memahami, dan menganalisis pengaturan hak angket DPR dalam pengawasan kebijakan pemerintah, serta mekanisme pengajuan dan penerapan hak angket. Metode penelitian ini menggunakan studi hukum normatif yang mengkaji aturan hukum formal, termasuk undang-undang dan literatur teori yang relevan. Teknik analisis yang digunakan adalah deskriptif analitis dan analisis argumentasi hukum. Hasil penelitian menunjukkan bahwa pengajuan hak angket diperlukan minimal 25 anggota parlemen lebih dari satu fraksi, diikuti dengan penyampaian permohonan rinci dan pertimbangan di sidang paripurna sesuai Pasal 177 UU Nomor 27 Tahun 2009. Hak angket DPR diatur dalam Pasal 20A ayat (2) UUD 1945 dan diperkuat dalam Pasal 79 ayat (3) UU Nomor 42 Tahun 2014. Hak ini memungkinkan DPR untuk menyelidiki pelaksanaan undang-undang atau kebijakan pemerintah yang dianggap bertentangan dengan peraturan. Dapat disimpulkan bahwa prinsip check and balance harus tetap dijunjung agar tidak melemahkan fungsi independensi lembaga.

Abstract

To determine legal certainty in an agreement, it can be analyzed through the greatest potential cause of disputes in the agreement, namely default. Default is the greatest potential for a problem or dispute in an agreement. Default is the implementation of obligations that are not fulfilled or broken promises or negligence carried out by the debtor either because they do not carry out what has been promised or even do something that according to the agreement should not be done. The term default comes from Dutch, namely "wanprestatie" which means non-fulfillment of achievements or obligations that have been set for certain parties in an agreement, either an agreement born from an agreement or an agreement arising from the law.

Abstract

Prostitution in Indonesia continues to be a complex and contentious issue, involving not only pimps and sex workers but also service users who remain largely unregulated by existing laws. This research examines the gaps in Indonesia’s legal framework, particularly the absence of provisions criminalizing prostitution service users. The study aims to explore how Indonesian law addresses the criminalization of all parties involved in prostitution, focusing on service users and the enforcement of criminal sanctions. Using a normative legal research methodology, this study reviews existing laws such as Law No. 44 of 2008 on Pornography, Law No. 19 of 2016 on Electronic Information and Transactions, and the Criminal Code (KUHP). It applies legal analysis through the legislative approach and legal concept approach, identifying significant gaps in applying criminal sanctions to users of prostitution services. The findings highlight that while pimps and service providers are criminalized, service users remain largely exempt from legal accountability. The study proposes that service users can be prosecuted through adultery complaints as stipulated in Article 284 of the Criminal Code. These findings suggest the urgent need for legal reforms to address this gap, ensuring a more comprehensive legal approach to prostitution regulation.

Abstract

The objectives of this thesis are to analyze the implementation of the submission of summons reports through the village head in the verstek decision and to analyze the obstacles to the implementation of the submission of summons reports through the village head in the verstek decision. The type of research used in this study is empirical juridical legal research. In empirical juridical research, law, as law in action, is described as an empirical social phenomenon. Empirical legal research, also known as sociological legal research, is legal research that examines law by conceptualizing it as actual behavior, an unwritten social phenomenon experienced by everyone in social relationships. The results of this study found that the implementation of the submission of summons reports through the village head in the verstek decision is related to the implementation of summons in civil cases at the Bangli District Court. Since the issuance of PERMA Number 7 of 2022, there has been a change in the implementation of the submission of summons reports, from the conventional summons issued through a bailiff to now using registered mail. There are no sanctions or penalties for the sub-district or village if they do not directly convey the summons given, and the requirement for postal officers to convey the village head also faces time constraints and the busyness of the postal officers themselves, who must adjust the workload of postal delivery, which of course has a postal delivery target aligned with the opening or service hours of the post office or sub-district office.

Abstract

Police officers as law enforcers have a central role in law enforcement. Problems arise when police officers actually break the law or commit crimes. The crimes committed not only violate criminal law, but also violate the ethics and code of the police profession. Based on this description, the problem can be formulated as follows: How is the responsibility of police officers who commit crimes in the Bali Regional Police (Polda) and What are the obstacles to imposing sanctions for police officers who commit crimes in the Bali Regional Police (Polda). The responsibility of police officers who commit crimes includes accountability for the code of ethics and criminal accountability through general justice and its resolution internally within the institution, namely through a disciplinary hearing by the Indonesian National Police Code of Ethics Commission (KKEP). Obstacles to the application of sanctions for police officers who commit crimes in the Bali Regional Police are in the form of internal problems within the Polri structure, such as limited facilities and infrastructure, information networks, number of personnel, and budget support. In addition, there are also external obstacles that come from the community, such as lack of evidence and witnesses, community apathy, and lack of supporting facilities

Abstract

Handling of domestic violence is handed over to the police as the spearhead of the investigation process and its handling is processed in accordance with applicable law. Police Efforts in Handling Domestic Violence in the Karangasem Police Jurisdiction, namely (1) Pre-Emptive Efforts (Non-Penal Facilities), are one of the non-penal efforts or outside the legal path that aims to foster society by trying to instill good norms or morals to eliminate the intentions of potential perpetrators of domestic violence. (2) Preventive Efforts (Non-Penal Facilities) are the last non-penal efforts that can be taken by the police to prevent domestic violence. Preventive efforts themselves are more towards efforts aimed at eliminating the opportunities that potential perpetrators have to commit a criminal crime. and (3) Repressive Efforts (Penal Facilities), are the last efforts that can be made by the police to overcome a criminal crime.
