Abstract

The rules regarding the 2024 General Election provide different treatment between parties participating in the general election that have already passed in 2019 and political parties participating in the general election that are new or have not yet passed the 2024 general election. This form of inequality is shown through the determination of serial numbers of political parties , where those who have passed the 2019 general election can use the old serial number or draw it again, while the new political parties must draw their serial number. This research has a focus on studying how to apply the principle of justice in determining the serial number of participants in the 2024 general election and how the concept of applying the principle of justice in the future will apply to the principle of justice. This research is a normative legal research with a doctrinal approach that is processed conceptually. The results of this study indicate that the application of the principle of justice does not occur in the process of determining the serial number of parties participating in the 2024 election, so an evaluation of the rule of law is needed in order to ensure that the principle of justice can be carried out properly.

Abstract

The disparity in sentencing in cases of criminal acts of corruption by public officials is caused by differences in sentences in equally serious cases, namely corruption committed by public officials. The existence of high inequality in sentencing can affect people's judgments as a form of injustice. The aim of this research is to examine how positive law regulates disparities in sentencing in judges' decisions and how public officials who commit corruption crimes are punished. This research is included in the category of normative legal research, where the data used consists of secondary sources such as legal texts including laws and regulations, court decisions, and legal journals. The research was carried out through the use of statutory methods combined with a theoretical framework and secondary data, namely legal materials. The research findings show that arrangements relating to the criminal prosecution of public officials who practice corruption can be found in Article 13 paragraph (1) of Perma Number 1 of 2020 which relates to the Guidelines for Punishment Articles 2 and 3 of the Corruption Eradication Law. However, the regulation of disparities in the Supreme Court Regulations has not been a solution in reducing disparities. It requires absolute alignment of sentencing goals so that the crimes committed with the crimes obtained can reflect the values of justice. So that disparities can be used only to burden criminal prosecution in corruption cases by public officials.

Abstract

Gender and child-based violence in Banyumas is relatively high. This is indicated by the case data of the last 2 years released by the UPTD PPA Banyuma. This study aims to determine the effectiveness of laws and efforts to protect victims of gender-based violence and children, as well as the obstacles faced by UPTD PPA. This study uses empirical research methods, data collected by interviews, observations, and literature studies. The results of this study indicate that the effectiveness of the law on the protection of victims of gender-based violence and children in Banyumas has been effective, it is measured from 5 factors, namely legal factors, law enforcement officers, facilities or facilities, society and culture, where society and cultural factors are also obstacles for UPTD PPA. Efforts to protect victims of gender-based violence and children by UPTD PPA Banyumas conducted in 2 (two) ways, namely preventive and repressive efforts.

Abstract

Simultaneous regional head elections in 2024 are a challenge for Indonesia's democratic system, especially with the phenomenon of single candidates even though the Constitutional Court has lowered the nomination threshold through Decision Number 60/PUU-XXII/2024. This study aims to analyze the impact of the Constitutional Court's decision on party political participation and identify factors that influence the sustainability of the single candidate phenomenon. This research uses a normative juridical method with a conceptual approach. The results show that although the lowering of the threshold has succeeded in increasing the opportunities for small parties to nominate candidates, the dominance of incumbents, high political costs, and weak political education remain significant obstacles so that there will still be single candidates in 37 Regions in the 2024 Simultaneous Regional Head Elections. Key findings suggest the need for additional arrangements, such as limiting the maximum party support for a single candidate, to encourage more participatory competition. This research confirms the importance of regulatory reform and political education to realize a more inclusive democracy in the context of regional head.

Abstract

Kedudukan Hukum Pemohon dalam perkara konstitusi pengujian undang-undang terhadap UUD NRI Tahun 1945 merupakan syarat mutlak. Dalam penelitian ini terdapat dua putusan Mahkamah Konstitusi yang memberikan putusan yang berbeda tentang kedudukan hukum pemohon yaitu putusan Nomor 90/PUU-XXI/2023 dan putusan Nomor 74/PUU-XVIII/2020, di mana dari kedua putusan tersebut memiliki permohonan yang serupa tentang syarat pencalonan presiden dan wakil presiden, namun Mahkamah memberikan putusan kedudukan hukum yang berbeda. Sehingga dalam penelitian ini ada dua rumusan masalah pertama tentang bagaimana kedudukan pemohon dalam putusan Nomor 90/PUU-XXI/2023 dan Putusan Nomor 74/PUU-XVIII/2020, kedua mengenai pandangan Majelis Hakim Mahakamah Konstitusi tentang kedua putusan tersebut. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan kasus (Case Approach). Penelitian ini menemukan bahwa terdapat permasalahan dalam pemberian kedudukan hukum pemohon oleh Mahkamah Konstitusi khususnya dalam Putusan Nomor 74/PUU-XVIII/2020 yang tidak memberikan kedudukan hukum kepada pemohon sedangkan terhadap putusan 90/PUU-XXI/2023 memberikan kedudukan kepada pemohon. Hal tersebut menunjukan sikap Inkosistensi Mahkamah Konstitusi terhadap kedudukan hukum pemohon yang permohonannya merupakan kebijakan hukum terbuka yang itu sebenarnya bukan kewenangan Mahkamah Konstitusi. Mahkamah Konstitusi sebagai penjaga Konstitusi seharusnya menunjukan konsistensi dalam pemberian kedudukan hukum khususnya terkait dengan permohonan yang berkaitan dengan kebijakan hukum terbuka. Kata Kunci:Inkonsistensi; Kedudukan Hukum; Mahkamah Konstitusi.

Abstract

Indonesia merupakan Negara Kesatuan dengan sistem desentralisasi, kebijakan desentralisasi ini berpengaruh pula terhadap proses pembentukan hukum, di mana Pemerintah Daerah memiliki kewenangan untuk membuat Peraturan Daerah. Selama ini peran masyarakat dalam proses pembentukan Peraturan Daerah masih bersifat parsial dan simbolik. Beberapa komunikasi massa yang dilakukan hanyalah sebagai pelengkap prosedur adanya basic research (penelitian dasar) yang melandasi perencanaan pembentukan Peraturan Daerah. Sementara dalam tahapan perancangan pembahasan dilakukan oleh unit kerja dinas di pemerintahan atau panitia khusus dari DPRD. Hal tersebut mengakibatkan tidak sedikit Peraturan Daerah yang digugat ke Mahkamah Agung dan dibatalkan oleh pemerintah pusat. Menurut Ibrahim yang dimaksud dengan Perda bermasalah yaitu Perda yang dinilai bertentangan dengan peraturan perundang-undangan yang lebih tinggi, dianggap tidak mampu mewadahi kepentingan nasional, tidak mampu mewadahi konteks sosial setempat atau nilai kearifan lokal, bertentangan dengan kepentingan umum, dan tidak aspiratif. Berdasarkan uraian tersebut dalam penelitian ini terdapat dua rumusan masalah yaitu (1) Bagaimana dasar filosofis dan yuridis pembentukan peraturan perundang-undangan yang partisipatif? Dan (2) Bagaimana Konsep Penyusunan Program Pembentukan Peraturan Daerah Partisipatif?. Metode Penelitian yang digunakan adalah Yuridis Normatif dengan pendekatan peraturan perundang-undangan (Statute Aprroach). Dalam proses pembentukan peraturan perundang-undangan sangatlah dibutuhkan peran serta masyarakat. Terkait partisipasi dalam pembentukan peraturan perundang-undangan, terdapat empat model partisipasi. Keempat model tersebut adalah pertama, partisipasi murni (pure representative democracy), Kedua, a basic model public partisipation, Ketiga, a realism model of publik partisipat, Keempat, model The Possible Ideal For South Africa. Penyusunan Program Pembentukan Peraturan Daerah tidak hanya untuk kepentingan pembentuk Peraturan daerah semata, tetapi lebih luas lagi terkait dengan keseluruhan program pembangunan daerah. Maka dari itu perlu diperhatikan partisipasi masyarakat dalam Penyusunan Program Pembentukan Peraturan Daerah. Partisipasi masyarakat dalam pembentukan peraturan daerah merupakan wujud penyelenggaraan pemerintahan yang baik sesuai dengan prinsip-prinsip good governance.
