Abstract

Penelitian ini bertujuan untuk mengkaji suatu bentuk Perlindungan Hukum Bagi Notaris Dalam Pembuatan Akta Autentik Yang Didasarkan Keterangan Palsu Dari Pihak Penghadap. Notaris merupakan pejabat umum yang berwenang untuk membuat suatu Akta Autentik. Notaris dalam menjalankan jabatannya mempunyai keterbatasan yang sering tidak bisa diantisipasi terkait dengan keinginan pihak penghadap yang ingin dengan sengaja melakukan perbuatan melawan hukum yang dilarang oleh kaidah hukum, sehingga seorang notaris bisa saja terseret dalam suatu perkara di pengadilan. Apabila hakim pada suatu proses peradilan meminta untuk seorang notaris memberikan kesaksiannya terhadap akta yang telah dibuatnya yang isinya berdasarkan keterangan palsu yang disampaikan oleh pihak penghadap dan notaris dalam hal ini memutuskan untuk tidak menggunakan hak ingkarnya maka akan timbul suatu konflik norma antara menjaga kerahasiaan isi akta yang dibuatnya sesuai dengan Pasal 16 ayat (1) huruf f UUJN dan untuk menuruti perintah atau permintaan pejabat yang berwenang untuk kepentingan pemeriksaan dalam suatu proses pembuktian dalam persidangan sesuai dengan Pasal 216 ayat (1) KUHP, maka dua hal ini yang perlu dipertimbangkan secara mendalam. Penelitian yang digunakan adalah Penelitian Hukum Normatif dengan mengkaji berbagai macam aturan hukum yang bersifat formal seperti undang-undang, literatur-literatur yang bersifat konsep teoritis yang kemudian dihubungkan dengan permasalahan yang menjadi pokok pembahasan.

Abstract

Law enforcement in wildlife protection is a crucial issue involving environmental, legal and social justice aspects. This article examines the dynamics of law enforcement in wildlife protection cases through a legal sociology approach, with a focus on issues of justice and social inequality. Although various regulations have been implemented to protect endangered wildlife, the effectiveness of law enforcement remains weak and often uneven. Factors such as social inequality, corruption, and economic power exacerbate wildlife law violations. Émile Durkheim's sociological theory can be connected to the case of wildlife protection through the social concepts he developed, such as social solidarity, collective morality, and the function of law in society. Local communities, especially those who live around conservation areas, are often the ones most affected by conservation policies, while violations by economically powerful groups are not always subject to appropriate sanctions. This analysis shows that unfair law enforcement and inequality in access to justice affect the success of wildlife conservation efforts. Therefore, a more inclusive and fair approach is needed in the application of the law, which not only protects wildlife but also ensures justice for the communities involved. This article concludes that increasing the effectiveness of law enforcement, strengthening regulations, and empowering local communities are important steps to overcome social inequality in the case of wildlife protection, so as to create a balance between environmental conservation and social justice.

Abstract

In essence, a notary as a public official has the authority to make deeds authentic in accordance with norms, values ​​and provisions of laws and regulations applicable so that the law can work in society. Every deed made by the notary must be kept in the notary's protocol, and the protocol must be transferred in the case of the notary died or his term of office has expired or retired. The existence of a lawsuit addressed to the notary protocol holder regarding the forgery of authentic deeds that have been transferred to him will become a problem in the future. The notary who receives the protocol will still be summoned for information if there are problems related to the protocol in his control, because this is one of the responsibilities of the notary protocol recipient. Article 65 of the Notary's Position Law explains that a notary is responsible for every deed he makes even though the Notarial Protocol has been submitted and transferred to the party holding the Notarial Protocol. The notary holding the Protocol only has the obligation to care for and maintain the deed that has been submitted to him, and is not responsible for the contents of the deed. The storage of notary protocols as state archives is also not regulated in detail in the Notary Public Law. So there needs to be special arrangements regarding policies, guidance and management of notary protocols. In order to create legal certainty for notaries in storing and maintaining notary protocols.

Abstract

Suatu perceraian mengakibatkan penguasaan dan pengurusan anak-anak tidak bisa dilakukan secara bersama-sama, sehingga terjadi perselisihan antar kedua orang tua tersebut. Atas dasar hal tersebut, maka anak yang akan menanggung akibat dari perceraian yang dilakukan oleh kedua orangtuanya. Peran hukum disini seharusnya lebih mementingkan kenyamanan psikis, psikologis, tempat tinggal dan lingkungan yang mempengaruhi tumbuh kembang serta emosi anak dari korban perceraian yang hak asuhnya di perebutkan oleh kedua orang tuanya. Dari beberapa tes yang di lakukan psikolog terhadap anak maka hasil analisa tes psikologi tersebut di jadikan acuan sebagai bukti bahwa sorang anak sedang mengalami teraumatik terhadap suatu kejadian atau tidak. Majelis Hakim memiliki peranan yang besar dalam menentukan pihak mana yang berhak atas penguasaan terhadap hak asuh anak. Masih kurang jelasnya pengaturan di Indonesia terkait apa yang menjadi parameter khusus dalam penentuan pemberian hak asuh anak setelah putusnya suatu perkawinan akibat perceraian membuat penulis merasa bahwa perlunya dibuat suatu aturan khusus untuk dijadikan suatu tolak ukur dalam penentuan terhadap pemberian hak asuh anak.

Abstract

In the development of modern legal science, understanding the essence of legal science has become increasingly important in explaining the position of law as an autonomous discipline amid social, moral, and political influences. This study aims to examine the essence of legal science based on Hans Kelsen's pure theory of law and its relevance to the development of legal science in civil law and common law systems. The research method used is normative jurisprudence with three approaches, namely the legislative approach to examine the hierarchy of norms in the legal system, the conceptual approach to examine the Grundnorm and Stufenbau des Recht theories, and the comparative approach to compare the application of these theories in the two legal traditions. The results of the study show that Kelsen's concept of the hierarchy of norms is in line with the codification system in civil law, because each norm derives its validity from a higher norm, culminating in the basic norm. Meanwhile, in common law, Kelsen's thinking remains relevant because judicial decisions can be understood as legal norms that are valid and binding within the hierarchy of norms. Thus, Hans Kelsen's Pure Theory of Law provides a universal conceptual foundation for the development of legal science as a rational, systematic, and autonomous discipline.
