Abstract

The enforcement of court decisions regarding custody (hadanah) and alimony (nafkah) for children and ex-wives post-divorce is frequently inadequate, with many husbands failing to comply. Although decisions based on legal provisions (rechtsspraack naar wetboeken) should be effective according to the principle of the Effectiveness of Law, numerous children and women in Indonesia suffer from the ineffective execution of judges' rulings in alimony and custody cases. Ensuring the rights of children and women after divorce can be improved through proper implementation of laws in a preventive, curative, and supportive manner. In Indonesia, the E-Mosi Caper application has been developed in Bengkulu Province, in collaboration with the PTA Bengkulu and local government, to enhance the effectiveness of laws concerning custody and alimony. This application could serve as a model for other regions. In contrast, Malaysia has established a Family Support Division (BSK) tasked with overseeing maintenance payments to support children and ex-wives after divorce. This study employs a comparative legal method to examine the frameworks for ensuring the rights of children and women post-divorce in both countries. The findings aim to highlight the effectiveness of the existing systems and after recommendations for improving law enforcement and protecting post-divorce rights.

Abstract

This research aims to examine the implementation of hadith in contemporary Islamic law through a case study of fatwa regarding the exchange of new money ahead of Eid in Indonesia. The method used in this study is a qualitative approach based on case studies using a functional structural approach to understand the social function of the practice. The results of the study show that the practice of money exchange is allowed if there is a separation of contracts between transactions and service fees.

Abstract

This article examines hadith digitalization as both an epistemological shift and a technological transformation that reshapes how Muslims engage with prophetic traditions in the modern age. Through a qualitative literature-based approach, the study traces the evolving forms of digital hadith representation, ranging from e-books and mobile applications to takhrij software and social media platforms. It analyzes how these digital spaces reconfigure the frameworks of transmission, authentication, and interpretation. The findings reveal that digitalization greatly enhances public access to hadith literature, democratizes textual dissemination, and enables faster, more flexible learning across geographic boundaries. However, these benefits are counterbalanced by emerging risks such as the proliferation of fabricated hadiths, the erosion of traditional scholarly authority, and the algorithmic bias that privileges viral content over verified religious knowledge. The study argues that hadith digitalization is not merely a change in medium, but a redefinition of the epistemic landscape—one that demands ethical safeguards, robust digital religious literacy, and strategic collaboration between scholars and technologists to ensure that the transmission of prophetic knowledge remains authentic, contextually relevant, and epistemologically sound in today’s interconnected world.

Abstract

Penelitian ini memjelaskan arus Globalisasi terhadap penyebaran hadis palsu di media sosial. Hadis merupakan salah satu sumber utama hukum Islam yang berfungsi sebagai pedoman dalam menjalankan kehidupan beragama dan bermoral bagi umat Muslim. Namun, di era globalisasi dan perkembangan teknologi digital, penyebaran hadis palsu melalui media sosial menjadi fenomena yang mengkhawatirkan. Hadis palsu, yang sering kali dimanipulasi atau dikemas secara menarik, dapat menyebar dengan cepat dan luas, memengaruhi pemahaman agama serta menimbulkan perpecahan di tengah umat. Dengan menggunakan pendekatan kualitatif berbasis studi pustaka, penelitian ini menemukan bahwa kurangnya literasi keagamaan, lemahnya verifikasi informasi, serta penyalahgunaan media sosial menjadi penyebab utama. Untuk itu, diperlukan upaya strategis seperti peningkatan pendidikan keagamaan, peran aktif ulama, penggunaan teknologi verifikasi berbasis digital, kolaborasi dengan platform media sosial, penegakan hukum yang tegas, serta dukungan terhadap riset dan inovasi. Langkah-langkah tersebut diharapkan mampu membendung penyebaran hadis palsu dan menjaga integritas ajaran Islam di era digital. Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor penyebab penyebaran hadis palsu, dampaknya terhadap masyarakat, serta solusi dalam menanggulanginya. Kesimpulannya penyebaran hadis palsu ini memengaruhi pemahaman agama umat Islam. Ketidakmampuan untuk membedakan hadis shahih dari palsu dapat menyesatkan orang, mengganggu akidah mereka, dan mengarah pada praktik keagamaan yang salah. Maka demikian perlu dilakukan upaya strategis dan menyeluruh yang diperlukan untuk mengatasi masalah ini.

Abstract

This research aims to determine the concept of character education, character education materials and character education methods in the books Tahdzîb al Akhlâq by Ibnu Miskawaih and Ayyuhal Walad by Imam Al Ghazâlî. This research uses descriptive analysis methods or text analysis and the data collection technique used in this research is the literature study technique (library), and the data sources used in this research are the books Tahdzîb al Akhlâq by Ibnu Miskawaih and Ayyuhal Walad by Imam Al Ghazâlî. The results of this research show that there are similarities in the character education values ??emphasized by Ibnu Miskawaih and Al Ghazâlî, such as patience, honesty, generosity and compassion. These two books also emphasize the importance of having a sense of responsibility and social awareness in everyday life. However, there are differences in the approaches and methods used by these two figures in teaching character education. Ibn Miskawaih tends to use a philosophical approach and encourages deep self-reflection, while Al Ghazâlî prioritizes a practical approach and provides clear instructions regarding concrete actions that must be taken in developing good morals. Based on the results of this research, it can be concluded that character education is an important aspect in the lives of individuals and society. Through understanding and teaching the character education values ??found in these books, it is hoped that it can help in forming individuals with good morals and a better society.
