Abstract

Korupsi sebagai white collar crime dilakukan secara sistematis dan terorganisir yang sulit untuk dibongkar oleh aparat penegak hukum, oleh karenanya dibutuhkan sebuah metode untuk memberantasnya salah satunya yaitu dengan bantuan peran Justice Collaborator yang nantinya memperoleh reward berkat bantuannya terebut. Penelitian ini bertujuan untuk menganalisis dapat tidaknya permohonan status Justice Collaborator ditolak oleh pengadilan tingkat Banding dan untuk mengetahui kesesuaian pertimbangan Hakim antara pengadilan tingkat pertama dengan pengadilan tingkat Banding dalam mengabulkan dan menolak permohonan status Justice Collaborator terhadap SEMA No. 4 Tahun 2011 dan UU No. 31 Tahun 2014. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan metode pendekatan perbandingan, serta spesifikasi penelitian yaitu preskriptif. Hasil penelitian menunjukkan bahwa Hakim Pengadilan Tinggi dalam Perkara Nomor 5/Pid.Sus-TPK/2018/PT.DKI dapat menolak status Justice Collaborator yang sudah dikabulkan oleh Pengadilan Negeri Jakarta Pusat karena Pengadilan Tinggi tingkat Banding memiliki fungsi korektor. Terdapat perbedaan pertimbangan dari kedua putusan dalam hal ini Pengadilan Negeri hanya mempertimbangkan aspek yuridis dan sosiologis sedangkan Pengadilan Tinggi telah mempertimbangkan aspek yuridis, sosiologi, dan filosofis.Kata kunci: Tindak Pidana Korupsi, Justice Collaborator, Banding

Abstract

Sistem Pemasyarakatan diselenggarakan dalam rangka membentuk Warga Binaan Pemasyarakatan agar menjadi manusia seutuhnya sehingga dapat diterima kembali oleh lingkungan masyarakat. Berkaitan dengan hal tersebut, lapas-lapas di Indonesia telah mengalami kelebihan penghuni yang akan meningkatkan resiko penularan HIV/AIDS. Oleh karena itu narapidana penderita HIV/AIDS harus mendapatkan perlakuan khusus daripada narapidana yang tidak menderita HIV/AIDS. Hal ini tidak hanya untuk kepentingan dirinya, melainkan juga kepentingan kesehatan narapidana lain dari penularan HIV/AIDS. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan pembinaan terhadap narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto dan mengetahui faktor penghambat dalam pelaksanaan pembinaan terhadap narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan spesifikasi penelitian yaitu deskriptif. Jenis data yang digunakan adalah data primer yaitu wawancara dan sekunder yaitu studi kepustakaan. Hasil penelitian  ini disajikan dalam bentuk  uraian-uraian  yang  disusun secara sistematis. Hasil penelitian menunjukan bahwa pembinaan terhadap narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto disamakan dengan narapidana lain yang bukan penderita HIV/AIDS, sehingga pembinaan terhadap narapidana penderita HIV/AIDS  tidak  berjalan  secara optimal.  Adapun  faktor penghambat pembinaan narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto dari struktur hukum yaitu tidak adanya dokter dan psikolog, ruangan khusus konsultasi bagi narapidana penderita HIV/AIDS, tidak diwajibkannya VCT bagi narapidana dan over population, dari   substansi hukum yaitu tidak adanya peraturan dan pembinaan khusus yang mengatur mengenai hak narapidana penderita HIV/AIDS dan dari budaya hukum yaitu HIV/AIDS dipandang sebagai aib oleh masyarakat, sehingga respon masyarakat lebih berorientasi pada labelling negatif terhadap penderita HIV/AIDS, termasuk di dalam LAPAS IIA Purwokerto yang kerahasiaan identitas narapidana penderita HIV/AIDS masih menjadi prioritas utama daripada pembinaan dan pencegahan penularan.Kata Kunci : Pembinaan, HIV/AIDS, Lembaga Pemasyarakatan

Abstract

The Indonesian Juvenile Justice System, established by Law No. 11 of 2012, focused on restorative justice and diversion strategies. However, two distinct aspects—handover and return to parents—do not possess sufficient supervisory measures, which raises doubts about their effectiveness in reducing recidivism and serving justice for victims. This article analyzes the legal framework and practical application of these elements using both normative and empirical methods, including interviews conducted with probation officers at the Purwokerto Correctional Center. The results indicate that although both approaches strive to safeguard the psychological health of child offenders, they lack enforceable responsibilities for parents or active community oversight. This results in a notable legal gap at the implementation level. The study suggests a redesign that combines the oversight of probation officers with community involvement to ensure observable behavioral improvements and accountability. This model aims to harmonize the principles of restorative justice with societal demands for fair justice and consideration for victims. The novelty of this article lies in providing a comprehensive institutional framework for post-diversion supervision, which has been mostly overlooked in earlier research.

Abstract

The failure to enforce state administrative court decisions with lasting legal force poses a challenge in Indonesia. Data indicates that merely 15 of 276 state administrative decisions were executed between 2013 and 2019. In 2020, statistics from the KPK, Bawas, and BPKP revealed that implementing state administrative court orders was insufficient, with an average completion rate of 34.92%. The 2021 annual report of the Ombudsman of the Republic of Indonesia documented 109 instances of non-compliance with unimplemented decisions. The research uses normative juridical methods with the addition of interviews to support existing data. This article examines the history, application, and challenges of contrarius actus, particularly in implementing state administrative court decisions. This research helps future researchers generate improvements or recommendations for state administrative court decision execution. The results show that contrarius actus originated from Roman law and is now an essential principle in state administrative law. Application of the contrarius actus in Indonesia’s administrative justice law provides for execution mechanisms without an institution or other party specialized in execution; administrative officials themselves must execute court decisions. A significant challenge in applying this principle in Indonesia is the failure of administrative officials to comply with court decisions. Despite the implementation of a merit-based system and elections aimed at selecting officials with integrity and lawfulness in filling administrative positions, many administrative officials violate court orders, making this enforcement of this concept difficult. To address this issue, it is recommended to maximize the role of the Ombudsman and state administrative courts in ensuring that administrative officials comply with legal decisions.

Abstract

Indonesian National Police Regulation Number 8 of 2021 regarding Criminal Case Handling based on Restorative Justice serves as the legal basis, empowering the police to resolve cases by applying Restorative Justice principles. This research aims to examine the implementation and inhibiting factors of Restorative Justice in resolving traffic accident cases in the jurisdiction of Bekasi City Police Resort. This study employs an empirical juridical approach with descriptive-analytical research specifications. The research location is conducted at Bekasi City Police Resort. The research findings indicate that firstly, Bekasi City Police Resort undertakes several stages in resolving cases through Restorative Justice, namely the attempt stage of mediation, the stage of requesting cessation of legal proceedings with Restorative, and the stage of determining the Letter of Termination of Investigation (SP3). Secondly, the research results show several obstacles in applying Restorative Justice to traffic accident cases in Bekasi City Police Resort, namely the substantive component. There are also other inhibiting factors, such as the victim party demanding a relatively high amount of compensation. In contrast, the perpetrator party cannot pay the total amount, failing the peace agreement.

Abstract

The Criminal Code (KUHP) has regulated alternative sanctions for imprisonment in criminal criminal practices, namely conditional sentences as regulated in Articles 14a to Article 14f of the Criminal Code. One of the sentences related to conditional criminal sentences is Decision Number X/Pid.Sus-Anak/2021/PN.Pwt. This research aims to find out the legal considerations of judges in imposing conditional criminal sanctions on defendants in the Purwokerto District Court Decision Number X/Pid.Sus-Anak/2021/PN Pwt. The approach method used in this research is normative juridical with prescriptive research specifications. The data source used is secondary data by collecting and using literature studies presented in narrative text, and the data analysis method used is normative qualitative. The results of research and discussion show that the judge in deciding Case Number X/Pid.Sus-Anak/2021/PN.Pwt did not consider the theory of retaliation. However, the conditional criminal sentence of 6 (six) months shows that the judge did not consider the fiscal theory, because the defendant has committed criminal acts against 2 (two) other victims.

Abstract

Incest is a sexual relationship that occurs between family members, and in this case the child becomes a victim of incest. Therefore, legal protection is needed to fulfill the rights of children who are victims of incest. This research aims to determine the legal protection provided by the Criminal Investigation Unit of the Banyumas Regency Women and Children Protection Unit. This research is empirical juridical research with a qualitative approach method and the research specifications are analytical descriptive. The data used in this writing are primary data and secondary data. The data is then processed using reduction methods, data display and data categorization and then presented in the form of narrative text, charts and graphs. The results of this research show the provision of legal protection in the form of applying for restitution, providing shelter or safe houses, medical and psychological rehabilitation for children who are victims of incest. Furthermore, the inhibiting factors of the legal structure are the lack of human resources, such as the unavailability of psychiatrists and/or forensic psychologists to handle and resolve victims' trauma due to the events that occurred, as well as the lack of budget for post-mortems. Finally, regarding facilities and infrastructure, the Criminal Investigation Unit of the Banyumas Regency Women and Children Protection Unit does not provide shelter or safe houses for victims. Furthermore, from the legal substance, namely the absence of specific regulations governing incest, while from the legal culture factor there is a negative stigma from society which views victims as disdainful, and considers incest a disgrace so that victims feel afraid and embarrassed to report it to the authorities, including The existence of patriarchal culture and superior attitudes from men makes women powerless and unable to resist.
