Abstract

Artikel ini membahas dinamika hukum adat dalam perkawinan di Asia Tenggara, dengan fokus pada ketegangan antara nilai-nilai tradisional dan perlindungan hak-hak individu, khususnya perempuan dan anak-anak. Masalah utama yang diangkat adalah ketidakjelasan regulasi antara hukum adat dan hukum negara, yang menciptakan kesenjangan perlindungan hukum bagi kelompok rentan. Dalam banyak komunitas adat, elemen patriarkal dalam hukum adat sering kali menempatkan perempuan dalam posisi subordinat, sementara anak-anak yang lahir dari perkawinan adat yang tidak tercatat dalam sistem hukum negara terhambat aksesnya terhadap hak-hak sipil, seperti akta kelahiran dan pendidikan.  Metode yang digunakan dalam penelitian ini adalah kajian literatur dan analisis terhadap regulasi hukum adat serta hukum negara di beberapa negara Asia Tenggara, termasuk Indonesia, Malaysia, Thailand, dan Filipina. Analisis ini juga mengkaji dampak ketidakselarasan hukum terhadap perempuan dan anak-anak dalam komunitas adat. Hasil temuan menunjukkan bahwa meskipun hukum adat berfungsi sebagai landasan sosial dan budaya penting dalam komunitas, sering kali tidak cukup melindungi hak-hak perempuan dan anak-anak. Ketidakjelasan antara hukum adat dan hukum negara memperburuk ketidaksetaraan gender, meningkatkan risiko kekerasan berbasis gender, serta membatasi akses kelompok rentan terhadap hak-hak sipil dan perlindungan hukum yang memadai. Oleh karena itu, diperlukan reformasi hukum yang mengintegrasikan nilai-nilai lokal dengan perlindungan yang lebih tegas terhadap hak-hak individu, serta memperkuat dialog antara pemerintah dan masyarakat adat untuk menciptakan sistem hukum yang inklusif dan adil.

Abstract

This research was grounded on the argument that Malay Society is know to be highly religious and Islamic, even identifying themselves as strong Muslims. However, the issue of LGBT has been increasingly prevalent in Riau since 2023. Employing a qualitative approach and utilizing literature studies, this research attempted to analyze issues related to LGBT in the Land of Lanang Kuning. Data were obtained through research findings on LGBT in Riau on Mendeley as well as from both print and online media. The findings indicated that the growing issue of LGBT in Riau is accompanied by an increase in positive sentiments and perceptions towards LGBT behavior. Several emerging studies demonstrated the reinforcement of positive sentiments and the high positive perception among Riau students towards LGBT.

Abstract

This study aims to analyze power relations in the educational practices at SMP Al Amanah, a junior high school located in Jeneponto Regency, South Sulawesi. The focus is on how decision-making structures and academic interactions shape—or hinder—the development of critical national consciousness among students. This research adopts a qualitative approach with a case study design. Using a descriptive-qualitative approach with a critical case study design, data were collected through participant observation, in-depth interviews with teachers, students, and school administrators, as well as document analysis, including curricula, syllabi, and school meeting notes. The data were analyzed using critical discourse analysis, framed by Antonio Gramsci’s theory of hegemony and Pierre Bourdieu’s concept of cultural capital. Findings reveal that structural dominance by the school principal in decision-making processes, coupled with a curriculum that emphasizes a national narrative without meaningful integration of local context, results in hierarchical power relations with minimal participation. This condition weakens the role of teachers as agents of change and limits students’ opportunities to engage critically in the learning process. Unequal distribution of cultural capital leads to the reproduction of a uniform and decontextualized discourse of nationhood, thereby weakening reflective national awareness. The study underscores the need for a more democratic decision-making structure within schools and the integration of local values into the curriculum to foster a participatory, contextual, and emancipatory civic education.
