Abstract

Parenting roles and responsibilities are often influenced by gender stereotypes that exist in society. There are different expectations and demands on the roles of men and women in parenting. For instance, women (mothers) are often considered primarily responsible for caring for and educating children, while men (fathers) are considered more as breadwinners and leaders of the family. Additionally, it is frequently questioned when a father bears a child while away from the child's mother. This study seeks to evaluate and examine the notion of roles and responsibilities in parenting from the perspective of gender equality and Islamic law, employing a library research method (descriptive analysis research) that involves objectively assessing and describing occurrences. According to the findings of the study, parenting plays a significant role in the personality development and formation of children. According to a gender perspective, both mothers and fathers have the same role in raising children. According to the perspective of Islamic law, parenting is based on religious teachings which provide guidelines on how to educate children in an Islamic way. Parents are expected to carry out parenting responsibilities by taking into account Islamic values, including respecting children's rights under religious teachings. Abstract

In today's life, there are many cases that we often hear about or see that are directly or indirectly related to external sexual violence or marital rape. Therefore it is necessary to formulate rules that can reduce the number of violence, especially marital rape which is a concern for everyone to get married. Maqosid Syariah is one of the appropriate alternative sources of law originating from sources of Islamic law. The following research is a qualitative descriptive research equipped with library research methods with a normative juridical approach. The formulation for regulation of domestic violence in Law Number 12 of 2022 concerning the Law on Sexual Violence has fulfilled the dharuriyat category or primary needs in Maqashid Syariah related to kulliyat al khams, one of the main things, namely Hifzu al-nafs (life protection). In this position, the Act on Sexual Violence can use Maqashid Syariah as an alternative point of view. By formulating these regulations, the concept of Maqashid Syariah can be used for the purpose of common interest has been implemented. With regulations like this, it can be a benchmark for reducing domestic violence.

Abstract

Day care for the elderly has become a new trend in the modern era in providing services in terms of psychological, sociological, motor and religious recovery for the elderly. The purpose of this study is to analyze the role and function of elderly day care, to describe the construction of Maqasid Syariah and the Sociology of Islamic Law on the actualization of day care for the elderly in the modern era. The author's ethnographic qualitative research method was used to obtain authentic data from the elderly and elderly day care managers as primary data. The results of this study are that the role and function of day care for the elderly provides services for mental and spiritual strengthening (tafaqquh fi al din) and Islamic values (Islamic Values) through the realization of the programs provided, while the construction of sharia maqosid in day care for the elderly can realize the stages of daruriyyat, hajjiyat, and tahsiniyat through Ahamiyyatus al syari'iyyah, namely maintaining religion, maintaining reason, and taking care of offspring, To protect the soul, and to protect the treasures. The sociological construction of Islamic Law in the actualization of day care for the elderly in the modern era is based on several studies, namely, in the values of Islamic Law there is noexplicit prohibition on day care for the elderly. The social practices carried out by day care for the elderly through their services provide goodness for the elderly psychologically, sociologically, motorly, religiously. Legal policy according to Law No. 13 of 1998 concerning Social Welfare for the Elderly, that the Indonesian government has provided clear regulations related to the implementation of day care for the elderly through the Decree of the Minister of Social Affairs of the Republic of Indonesia Number 76/HUK/2011 concerning the Determination of Institutions/Foundations Recipients of Assistance for the Implementation of the Elderly Daily Service Program.

Abstract

A common form of digital marketing today involves promoting products through influencer marketing strategies, carried out by individuals known as influencers. However, the application of influencer marketing often fails to align with Islamic ethical values, as seen in the lack of transparency or honesty, promotion of non-halal products, inadequate product descriptions, exaggerated claims, and the inappropriate appearance or attire of some influencers. These issues can lead to legal disputes and leave consumers feeling harmed. Therefore, clear guidance on the ethical conduct and behavior of influencers is essential. This study applies the Stimulus-Organism-Response (S-O-R) theory and uses a qualitative method with a descriptive approach. The data is composed of written words drawn from in-depth phenomena within the relevant context. Secondary data sources include books, academic journals, websites, and online resources. The findings reveal that influencer marketing is effective in building trust and enhancing marketing outcomes. Its effectiveness increases when aligned with sharia principles, such as honesty, transparency, and the promotion of halal and beneficial products. Consumer responses are heavily influenced by the ethics and values demonstrated by the influencer. Hence, in sharia-based marketing, influencers serve not only as promotional agents but also as representatives of Islamic values, contributing to transactions that yield not just economic benefits but also positive social and spiritual impacts.

Abstract

PT Asuransi Jasa Indonesia adalah sebuah perusahan BUMN member of IFG yang bergerak pada industri jasa keuangan yang dikategorikan sebagai Industri Keuangan Non-Bank (IKBN) sejak tahun 1973 merupakan bagian penting dalam perjalanan Sejarah bangsa dan tanah air Indonesia dalam perasuransian. Implementasi UU Ketenagakerjaan pada PKB sangat penting untuk meningkatkan kesadaran hukum perusahaan dan pekerja/karyawan, serta memberikan perlindungan hukum yang memadai bagi pekerja/karyawan. Penelitian ini membahas implementasi Undang-Undang Ketenagakerjaan pada Perjanjian Kerja Bersama (PKB) di PT Asuransi Jasa Indonesia dan bagaimana implementasi UU Ketenagakerjaan dalam PKB antara perusahaan dengan serikat karyawan, penerapan hak dan kewajiban serta sanksi pada PKB, dan faktor-faktor yang menjadi penghambat dalam perancangan, penyusunan, dan pengimplementasian PKB. Penelitian ini dilakukan dengan pendekatan metode penelitian yuridis normatif dengan studi kepustakaan dan analisa dokumen yang mengkaji hukum dari perspektif norma atau peraturan perundang-undangan serta menggunakan bahan-bahan hukum primer, sekunder, dan tersier sebagai sumber data. Dalam implementasi Undang-Undang Ketenagakerjaan pada Perjanjian Kerja Bersama (PKB) di PT Asuransi Jasa Indonesia, terdapat beberapa persoalan yang perlu diperhatikan. Salah satu persoalan yang dihadapi adalah tidak adanya aturan yang jelas tentang Perjanjian Kerja Waktu Tertentu (PKWT) dalam PKB perusahaan. Hal ini dapat menyebabkan ketidakpastian hukum bagi pekerja dan perusahaan. PKB perusahaan sudah diatur dengan baik namun perlu penyempurnaan sesuai Peraturan Pemerintah (PP) No. 36 Tahun 2021 tentang Pengupahan, dan peraturan perundang-undangan yang berlaku. Oleh karena itu, perlu dilakukan upaya untuk meningkatkan implementasi UU Ketenagakerjaan pada PKB, sehingga dapat menciptakan hubungan industrial yang harmonis dan produktif antara perusahaan dan pekerja
