Abstract

Cross-border marriages are increasingly common in the era of globalization, but this also creates legal complexities in settling marriages. Private international law plays an important role in regulating legal relations involving foreign elements. This research aims to analyze various aspects of international civil law that are relevant in the settlement of marriage trials carried out abroad. The research method used is a normative juridical approach, by collecting primary data through interviews and secondary data from the literature. The research results show that differences in legal systems between the couple's country of origin and the country where the marriage took place can create complexity in resolving disputes. The application of private international law principles, such as acquisition, choice of law, and recognition and enforcement of foreign judgments, can help reduce conflicts that occur and ensure justice and legal certainty.

Abstract

Marriages between Indonesian citizens (WNI) and foreign citizens (WNA) abroad are increasingly common along with increasing global mobility. However, this phenomenon also presents complex legal challenges, especially related to marriage procedures, legal recognition, and family rights. This research aims to analyze International Private Law in the context of marriages between Indonesian citizens and foreigners abroad, as well as evaluating the challenges faced by inter-country couples and the legal solutions available. The research method used is a qualitative approach with descriptive-analytic techniques, which includes in-depth interviews with legal experts and Indonesian-WNA couples, as well as literature studies. The research results show that International Private Law plays an important role in providing legal certainty and protection for couples, through regulating marriage procedures, recognizing marital status, and resolving disputes. Despite challenges in legal recognition and differences in legal systems, applying the principles of Private International Law can help reduce uncertainty and protect the rights of couples. It is hoped that this research can provide a deeper understanding of the importance of International Private Law in regulating mixed marriages between countries.

Abstract

In the era of globalization, inter-country marriages are increasingly common, including among Indonesian citizens (WNI) who choose to marry abroad. However, the recognition and validity of such marriages in Indonesia is a complex legal challenge. This article aims to explore the dynamics of International Private Law in the context of recognizing Indonesian citizens' marriages abroad, as well as identifying the legal challenges faced and solutions that can be implemented to increase legal certainty and protect the rights of Indonesian citizens. The research method used is qualitative with a descriptive analytical approach, utilizing secondary data sources such as legal literature, regulatory documents and case studies. The research results show that the marriage recognition mechanism involves a complicated administrative process, including registration at the Indonesian representative office and legalization of documents. Challenges faced include differences in legalization procedures between countries and a lack of information regarding the steps that must be taken. To increase legal certainty, it is recommended that regulations be harmonized, increase legal dissemination, and use digital technology in the marriage recognition process. It is hoped that this research can provide useful policy recommendations for protecting the rights of Indonesian citizens who marry abroad.

Abstract

ABSTRACT Marriage of Indonesian citizens (WNI) abroad is becoming an increasingly common phenomenon along with increasing global mobility. This research aims to explore the legal and social aspects of Indonesian citizen marriages abroad, with a focus on legal validity, registration, and the social impacts faced by Indonesian citizen couples. The background to this research shows that many Indonesian citizens marry foreign nationals (WNA) or fellow Indonesian citizens abroad, but they often face challenges in legal recognition of these marriages in Indonesia. This is important to understand considering that unrecognized marriages can have an impact on the legal status, inheritance rights and citizenship of children. The method used in this research is a qualitative approach with data collection techniques through in-depth interviews with Indonesian citizens who have married abroad, analysis of legal documents related to international marriage, as well as literature studies to understand the wider legal and social context. The research results show that the validity of an Indonesian citizen's marriage abroad is recognized if it meets the legal requirements of the country where the marriage takes place. However, marriage registration in Indonesia is often hampered by a lack of information and complicated procedures. Many Indonesian citizens also experience social stigma and difficulties in accessing legal rights, especially regarding children's citizenship and inheritance rights.
