Abstract

In formal legal conduct contrary to criminal law, including discrimination, acts of racial and ethnic discrimination are prohibited in Article 4 (b) (2) of Law No. 40 of 2008 on the Elimination of Racial and Ethnic Discrimination, which reads : 'Shows hatred or hatred towards people because of racial and ethnic differences in the form of: (2): Speech, express or say certain words in a public place or other place that can be heard by others. In the settlement of criminal offenses, especially in minor criminal law, two choices are made to solve criminal law problems, namely litigating or not litigating. peace consultation mechanism (no litigation) In indigenous peoples, the case can be resolved out of court as long as the issue is a minor criminal case. Among the cases that arose around disputes as well as insults between ethnic groups between Malays and Batak tribes, this subsequently caused commotion, involving insults between racial and ethnic groups leading to disputes that were not in accordance with existing laws . The wording of the problems in this dissertation research is, first, how the legal perspective is related to the settlement of ethnic discrimination crime out of court. second, how the law can be enforced in the settlement of ethnic discrimination crimes through the Riau Malay Customary Institution From the results of research based on two problem formulations, it can be concluded: First, this settlement is resolved out of court through common law mechanisms to bring about peace, brotherhood and restoration of relations in society, in positive law the common law system is not regulated but is recognized and has legal provisions. that is at the level of positive law because this customary law has existed for generations and is used in customary law communities. Second, settlement out of court through the customary courts, settlement in this customary institution is not regulated in the positive legal system in Indonesia but has a recognized position in the Indonesian legal system, because the State recognizes and respects the position of customary law. Abstract

Article 51 paragraf 3 of law number 30 of 2009 states that, “every personwho uses electric power which is not legally entitled to imprisonment for amaximum of 7 years and a maximum fine of 2.5000.000.000,00”. Based on theprinciple of justice, inessence it is abstrac and relative. In criminal law, especiallyin a criminal ase, justice is very difficult to create because there are two partieswith different interests who demand justice. The judge in case number24/Pid.Sus/2015/PN.Slw sentenced him to 3 months imprisonment and a fine of 3million rupiah. 1670/Pid.B/2016/PN.Mks and was sentenced to only 6 monthsimprisonment, and case number 222/Pid.Sus/2015/PN.Skh was sentenced to only6 months imprisonment. Meanwhile the electricity he stole was not only for theuse of his own household but also forthe benefit of his own personal business,which had harmed the state and also the community. So that from the result of thisdecision, the purpose of the punishment was dettering the perpetratorwas notachieved.The purpose of this study was criminal sanctions for electricity crime basedon the perspective of the principle of justice and to find out the ideal conceptrelated to electricity crime. This research is structured using a normative juridicalresearch type, namely research focused on examining the application of the rulesor norms in positive law. The approach used in this research namely literaturelaw research.The results of the research from the author are that In accordance with theprinciple of justice that the sentence that should be imposed must be inaccordance with the governing law, not with a judge’s decision which gives reliefvery far from the law that has been enacted. The judge’s decision that was handeddown was so low that it did not cause a deterrent effect on the perpetrator so thatis possible that this incident will happen again in the future. Ideal concept isachieved in determining the decision in accordance with the law against thejudge’s decision, and the criminal punishment imposed on the defendant shouldbe in accordance with the regulated law, namely law number 30 of 2009concerning electricity.Keywords: Electricity theft – justice – criminal sanction

Abstract

Accountability and openness are forms that are pursued in creating good governance. The accountability that must be carried out by the government is an embodiment of efforts to provide information related to every action or activity of government administration that has village finances. In this case, it cannot be separated from both the central government to the smallest level, namely the village government which is the focus of this research. As for the form of village government accountability in the form of an obligation to provide transparency in the form of budget realization, realization of activities, remaining budget and address of complaints to the village community as stated in article 72 of the minister of home affairs regulation number 20 of 2018 concerning village financial management. However, in this case, the village government of Kasikan, Tapung Hulu Subdrict, Kampar District, has not implemented it optimally.This type of research is a sociological juridical which emphasizes a research approach to the legal aspects related to the subject matter to be discussed, related to the facts or facts in the research location. This research was conducted in Kasikan Village, Tapung Hulu District, Kampar District, Riau Province. By conducting research in the Kasikan village government, the Kasikan Village Consultative Body, Customary Figures, PKK, and Kasikan Village Communities.In the result, there are three main points that can be concluded. First, the accountability and tranaprency of reports on the use of village finances to the community carried out by the kasikan village government have not been implemented properly according to the mechanism in accordance with applicable regulations. Second, the inhibiting factor in implementing the fulfillment of community rigths related to village finances by the village government is due to the wide area of the kasikan village, inadequate human resources, weak community participation, and inadequate facilities and infrastructure in village administration. And third, efforts to fulfill village financial reporting obligations to the community by the village government are only carried out in the form of banners and billboards in front of the kasikan village office. However, the village government will strive to increase community participation and further increase the suvervision of the village consultative body.Keyword: Accountability-Financial-Village

Abstract

Police officers may not use violence in securing demonstrations. These provisions areregulated in Article 10 Letter C of the Republic of Indonesia's National Police Regulation Number8 of 2009 concerning the Implementation of Human Rights Principles and Standards in CarryingOut Duties of the Indonesian National Police, however cases of beatings against students fromagency Students Executivein Riau se musala RRI office district, Pekanbaru. Students who aremembers of bodies Student Executivethroughout Riau consist of Riau University (UNRI), RiauIslamic University (UIR), Suska State Islamic University (UIN), and Tabrani Rab University.There were about 37 students who were injured after clashing with the police. The studentsshowed a number of wounds, in the form of bruises on their hands, head and the lips that werebroken due to the impact of the rattan by the Sabhara members.This legal research is normative legal research that is oriented towards positive legalnorms (ius constitutum), namely: research that is more focused on the implementation of positivelegal norms and principles, in the form of a statutory approach that is relevant to study theformulation of the problem of legal issues in this legal research. In this study the authorsconducted a study that examines the analysis of law enforcement against violence perpetrated bylaw enforcement officials against protesters. With the formulation of the problem, how can thecriminal responsibility of the police who commit violence while securing a demonstration bereleased from punishment? What are the limits of violence that can and cannot be done insecuring a demonstration?The author concludes that police who commit violence in a demonstration can be heldresponsible for the crime, because they are state officials who function at the demonstration toprovide security, the violence is carried out consciously by the apparatus and the form of theerrors contained in the Criminal Code. In addition, the police have professional ethics that arecarried out when carrying out their duties, so that it confirms that officers who commit violencewhile securing a demonstration can be held responsible for criminals, and the limits on violencethat can and cannot be done in securing demonstrations are contained in Republic of IndonesiaNational Police Regulation Number 9 of 2003 Procedures for Providing Services, Safeguardingand Handling Cases for Submission of Opinions in Public in Articles 23 and 24Keywords: Accountability - Demonstrations - Police

Abstract

Narcotics based on article 1 paragraph (1) of Law Number 35 of 2009concerning Narcotics which reads "narcotics are substances or drugs derivedfrom plants, both synthetic and semisynthetic, which can cause a decrease orchange in consciousness, loss of taste, reduce to eliminate taste. pain, and canlead to dependence, which are differentiated into groups as attached in this Law". Narcotics precursors are substances or starting materials or chemicals that canbe used in the manufacture of narcotics which are differentiated in the table asattached to this Law.This type of research can be classified into sociological juridicalresearch where the research tests the effectiveness of the current law. Thissociological research is a type that is viewed from the purpose of legal research.Sociological or empirical legal research consists of legal identification(unwritten) and research on the effectiveness of the law.The research objectives of this thesis are; First, public participation isseen from Article 104 of Law Number 35 Year 2009 concerning narcotics, whichstates that “the public has the widest opportunity to participate in helping toprevent and eradicate the abuse and illicit trafficking of narcotics and narcoticprecursors. The two efforts made by the Malay community of Pangean District inpreventing the circulation and abuse of narcotics.From the research results, based on two problem formulations it can beconcluded. First, so far the community has not fully participated in the preventionand trafficking of narcotics and narcotics precursors, it can be seen from theincreasing number of use and circulation of narcotics in Pangean sub-district.Second, preventive efforts have been made to the maximum extent possible by thevillage apparatus working together with the Police to disseminate information onthe dangers of narcotics abuse and narcotic precursors. Abstract

The establishment of an independent state institution has different names, making it unclear in its accountability, through the third amendment to the 1945 Constitution of the Republic of Indonesia it was agreed that the formation of a Judicial Commission based on Article 24B Judicial Commission is independent, this does not give meaningful meaning to its institutional status , The Judicial Commission is clearly closer to the function of judicial power, because the Judicial Commission (KY) regulation is in the 1945 Constitution of the Republic of Indonesia (UUD NRI). In addition, there are also institutions that are at the same level as the Judicial Commission, namely state institutions. independent which has the same level of function. Unlike the Judicial Commission, these three institutions are not regulated in the constitution, namely the Attorney General's Office, the Corruption Eradication Commission, and the National Human Rights Commission. However, the regulation stipulated by article 24 paragraph (3) which states "Other bodies whose functions are related to judicial power are regulated in law" So that becomes a problem. This raises a big question why only the Judicial Commission is regulated in the Constitution?This research uses a typology of normative legal research or what is also called doctrinal legal research, which deals more specifically with legal principles. In this study the authors use descriptive research characteristics, because the authors describe the Regulatory Arrangement of Independent State Institutions in the Structure of the Indonesian State Administration System.The result of the research conducted by the author is that there must be regulation arrangement in an effort to equal position by regulating these independent state institutions including the Attorney General's Office, Komnas Ham, and the Corruption Eradication Commission in the Constitution. Abstract

Pacu jalur merupakan salah satu tradisi dari Kabupaten Kuantan Singingi Provinsi Riau. Pacu jalur juga termasuk dalam ruang lingkup kebudayaan. Untuk ada kelestarian kebudayaan tentunya harus ada perlindungan terhadap kebudyaan tersebut. Tulisan ini mengkali terkat konsep perlindungan yang dapat diberikan pada tradisi pacu jalur. Metode penelitian dalam tulisan ini melalui pendekatan yuridis normatif. Dalam tulisan ini mengkaji konsep perlindungan untuk pacu jalur dapat melalui perlindungan warisan budaya tak benda dan kekayaan intelektual komunal.

Abstract

Indikasi geografis merupakan bagian dari kekayaan intelektual. Indikasi geografis adalah suatu tanda yang menunjukkan daerah asal suatu barang dan/atau produk yang karena faktor lingkungan geografis termasuk faktor alam, faktor manusia atau kombinasi dari kedua faktor tersebut memberikan reputasi, kualitas, dan karakteristik tertentu pada barang dan/atau produk yang dihasilkan. Salah satu bentuk indikasi yang telah didaftarkan yiatu kopi liberika dari Kabupaten Kepulauan Kepulauan Meranti. Dengan ada pendaftaran tersebut tentu telah ada perlindungan terhadap produk kopi tersebut. Pendaftaran tersebut tentu memiliki arti penting. Tulisan ini membahas arti penting pendaftaran kopi liberika dari Kabupaten Kepulauan Meranti. Penelitian ini melalui pendekatan yuridis normatif.

Abstract

Doktrin exhaustion pada kekayaan intelektual adalah pembatasan hak pemilik untuk menegakkan hak kekayaan intelektualnya. Apabila suatu barang telah dipasarkan oleh, atau dengan persetujuan, pemilik kekayaan intelektual di dalamnya, maka hak tersebut “habis” dan tidak dapat lagi digunakan untuk mencegah atau mengendalikan distribusi, atau penjualan lebih lanjut dari barang tersebut. Doktrin exhaustion dalam ranah kekayaan intelektual menimbulkan perdebatan, karena dianggap sebagai pengecualian dalam pelanggaran kekayaan intelektual. Dalam tulisan ini akan dibahas terkait dengan penerapan doktrin exhaustion dalam ranah kekayaan intelektual terutama dalam hak cipta, paten dan merek. Artikel ini mengacu pada penelitian hukum (legal research). Karakteristik penelitian hukum yakni mencari kebenaran koherensi yang mana suatu kebenaran didasarkan pada kesesuaian antara yang ditelaah dengan aturan yang ditetapkan. Adapun pendekatan digunakan dalam tulisan ini adalah pendekatan undang-undang (statute approach) dan pendekatan konseptual (conceptual approach).

Abstract

The protection of products with potential geographical indications (GIs) is closely tied to the economic benefits they offer to both communities and governments, particularly at the regional level. Local governments play a key role in this effort, as they possess a deep understanding of their region’s superior products. In Riau Province, the government has the authority—under Government Regulation No. 56 of 2022 on Communal Intellectual Property and Law No. 20 of 2016 on Trademarks and Geographical Indications—to inventory, register, and supervise GI products. Notable examples from Riau include Rangsang Liberika coffee and Rangsang sago, which have been successfully registered and now require quality and reputation maintenance. Using empirical legal research, this research finds that the Riau Provincial Government can strengthen the regional economy by mapping GI potential, facilitating registrations, developing protected products, and promoting legal protection and recognition at national and international levels. Although steps have been taken, current efforts remain suboptimal and should be further enhanced to fully realize the economic potential of GI protection in the province.
