Abstract

The existence of customary law is a source of law in Indonesia, to be precise in Mirah Village and Golan Village, Sukerojo District, Ponorogo District. There is a customary rule that prohibits the two villages from carrying out a marriage. the worst is death. This can be seen from the discrepancy that exists between the customary law of the Mirah people and the Golanese people and the national law, whereas in the national law there is nothing that regulates the prohibition of inter-regional marriages. This research contains identification of the problem of how in the villages of Mirah and Golan there was a prohibition on inter-regional marriages and how to analyze the juridical prohibition on marriages of the Mirah and Golan Indigenous Peoples when viewed from Law Number 1 of 1974 concerning Marriage. This research aims to determine the prohibition on marriage between Mirah village and Golan village and to find out the juridical analysis of the prohibition on marriage between Mirah village and Golan village when viewed from Law Number 1 of 1974 concerning Marriage. This research method uses the Normative Juridical research type. Research Results The prohibition on marriage between Mirah and Golan villages occurs because there is an oath from the ancestors which is still adhered to today and has become a legal rule for both communities and that in Law Number 1 of 1974 Article 6 and Article 8 letter F includes the rules related to the ban on marriage that occurred in the villages of Mirah and Golan.

Abstract

This article discusses the mechanism for transferring Building Use Rights (HGB) to Ownership Rights based on the Decree of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 1339/SK-HK.02/X/2022. The case study was conducted at the Mulyani S.H., M.Kn., Karawang Notary and PPAT Office. This transition process is important to provide legal certainty and increase the economic value of land. The research uses an empirical juridical approach by collecting primary data through observation and interviews as well as reviewing written and unwritten legal materials. The research results show that the transition of HGB to Ownership Rights involves document verification, tax payment, and monitoring of processing status at the Land Office. Obstacles faced include completeness of documents, limited administrative staff, and lack of public understanding of the importance of transferring rights. The solutions implemented include verifying the validity of documents, ensuring tax payments, and regular monitoring. This transformation of land status provides stronger legal force and can be inherited indefinitely, thus increasing the selling value of the land

Abstract

The Integrated Service Center for the Empowerment of Women and Children (P2TP2A) is expected to function as a community-based service institution. This community-based service acts as a crisis center unit by providing complaints, health, rehabilitation, social, counseling, legal assistance, repatriation, and social reintegration services (for trafficking victims). Sexual violence encompasses any action that diminishes, belittles, intimidates, or assaults an individual's body or reproductive capabilities, stemming from imbalanced power dynamics or gender inequalities. Such acts inflict psychological or physical harm, potentially disrupting reproductive health and impeding educational opportunities. Examples include rape and sexual abuse. This research focuses on examining legal protection efforts and identifying obstacles faced by P2TP2A (Integrated Service Center for Women and Children) in handling cases of sexual violence against children, utilizing an empirical juridical approach. The findings reveal that legal protection for children experiencing sexual violence is enshrined in Article 13 of Law Number 35 of 2014, which emphasizes the rights of children to be protected from various forms of harm, including discrimination, exploitation, neglect, cruelty, violence, abuse, and injustice. Supporting factors include the availability of financial assistance to fund P2TP2A activities, the dedication of officers and volunteers who prioritize the welfare of women and children, and the provision of office facilities by the government. However, there are inhibiting factors such as inadequate budget allocation, the unrealized Community-Free Integrated Child Protection Program (PATBN), insufficient human resources, the need for improvement in office facilities and infrastructure, and the lack of safe housing for victims who are still renting.

Abstract

Lemahsubur Village is one of the villages included in the Tempuran District, Karawang Regency. Agriculture is a very important sector in Indonesia, because Indonesia is an agrarian country and the majority of its population works in the agricultural sector so that agriculture is one of the largest commodities in the village, so the main problem discussed in this article is about the cultivation of agricultural land in Lemahsubur village which is one of the accelerations in the acceleration of agrarian reform. To implement it, the Lemahsubur village government develops the cultivation of the land cultivated by farmers in Lemahsubur village by establishing a farmer group 'Wargi Saluyu' which is a forum for these farmers to be able to manage and develop agricultural land collectively, with the existence of the farmer group, it is hoped that it can accommodate the farmers in Lemahsubur village in land cultivation, with the protection and empowerment of farmers which includes empowerment, financing and funding, supervision, and the role of the community, which is held based on the principles of sovereignty, independence, utility, integration, openness, efficiency, justice, and sustainability. The purpose of writing this article, the author wants to help the community in educating about the land that farmers are working on in Lemahsubur village. This system uses the Forward Chaining method where the process of searching for a forward or forward track. The search process is by providing questions that are the cause of existing problems, especially regarding land, there is a need for consultation to increase manpower in realizing the welfare of Lemahsubur villagers.

Abstract

Marketplace is a platform that has the task of acting as an intermediary between sellers and buyers to carry out the product transaction process online. Although from a business perspective it will benefit consumers, producers and the marketplace itself, from a legal perspective there will be many consequences that arise because there are no specific regulations governing this marketplace. Based on this, it raises the issue of whether the marketplace can be held legally responsible for consumer losses and how future laws can ensure that the marketplace is responsible for consumer losses that occur. With the normative legal method, the author analyzes laws and regulations, policy regulations, principles of e-commerce implementation, and principles of responsibility, which show that the marketplace platform as an electronic system organizer has legal responsibility in the event of losses to consumers. Conclusion Responsibility Related to the responsibility of business actors is regulated in Article 19 of Law No. 8 of 1999, while in Law Number 19 of 2016 in Article 15. And in Government Regulation Number 80 of 2019 it is regulated in Article 22 paragraphs (1) and (2). Although Indonesia already has regulations related to buying and selling through e-commerce platforms, their implementation is still considered ineffective in addressing consumer rights protection issues, so it is necessary to revise and harmonize inclusive laws and regulations, ensuring normative clarity and fairness in handling consumer rights violations in the marketplace.

Abstract

The digitalization era has significantly transformed various aspects of life, including the legal system. This transformation demands not only technological adaptation but also philosophical reflection to ensure justice, human rights, and social welfare are upheld. This study aims to examine the role of legal philosophy in the transformation of Indonesia's legal system in the digital era and to analyze how philosophical foundations influence the realization of legal ideals, particularly the principle of expediency. The research employs a qualitative method with a normative juridical approach, utilizing literature review as the main source of legal analysis. The findings reveal that legal philosophy plays a vital role in guiding the development of a responsive, ethical, and humanistic legal framework amid rapid technological changes. Philosophical principles such as justice, legal certainty, mutual benefit, and human rights serve as the foundation in formulating legal policies in the digital context. The study concludes that integrating legal philosophy into digital-era lawmaking is essential to ensure that technological progress aligns with fundamental legal values and societal benefit.

Abstract

Sejak diterbitkannya beberapa peraturan dalam rangka pelaksanaan pendaftaran tanah, secara terus menerus Pemerintah berusaha melaksanakan pendaftaran tanah di seluruh wilayah negara Indonesia untuk menjamin kepastian hukum. Hingga saat ini, tanah terdaftar di seluruh Indonesia baru mencapai 50.482.072 bidang atau 40,07 % dari perkiraan bidang tanah di seluruh Indonesia sebanyak ± 126.000.037 bidang. Pemerintah secara terus menerus berusaha melaksanakan pendaftaran tanah di seluruh wilayah negara Indonesia untuk menjamin kepastian hukum. Atas prakarsa pemerintah, penyelesaian pendaftaran tanah di seluruh Indonesia direncanakan akan selesai pada tahun 2024 melalui program Pendaftaran Tanah Sistematis Lengkap (PTSL). Dalam pelaksanaannya, jumlah dan kecepatan capaian bidang terdaftar antara satu Kantor Pertanahan dengan kantor lainnya berbeda. Pengabdian ini bertujuan untuk mengenalkan kepada masyarakat tentang PTSL sehingga diharapkan banyak Masyarakat yang sadar dalam pentingnya sertifikat tanah untuk legalitas kepemilikan tanah yang dimilikinya, bekerjasama dengan mahasiswa yang sedang melaksanakan Kerja Praktik Tematik di desa Lemahsubur Kecatamatan Tempuran Kabupaten Karawang yang dihadiri oleh Masyarakat desa, staff desa, dosen dan mahasiswa Fakultas Hukum. Hasil dari pengabdian Masyarakat disimpulkan bahwa Masyarakat mengetahui tentang program PTSL dan manfaat dari pendaftaran kemepilikan ha katas tanah atau manfaat sertifikat.

Abstract

Bank Perkreditan Rakyat (BPR) mempunyai peran strategis untuk mendukung perekonomian masyarakat kecil dan menengah. Namun, dalam pelaksanaannya, BPR kerap menghadapi persoalan kredit macet (Non-Performing Loan/NPL) yang dapat mengganggu kinerja keuangan dan kepercayaan masyarakat terhadap lembaga tersebut. Contoh yang terjadi di BPR Kabupaten Karawang wilayah industri padat penduduk, kasus kredit macet pada BPR PT. Karawang Jabar menjadi perhatian khusus, salah satu kredit macetnya yaitu peminjaman modal usaha. Latar belakang di atas di temukan permasalahan yang menjadi bahan krusial peneliti diantaranya dua rumusan, yaitu: (1) Apa saja faktor-faktor yang menyebabkan terjadinya kredit macet di BPR Karawang Jabar? dan (2) Bagaimana proses penyelamatan serta penyelesaian kredit macet di BPR Karawang Jabar. Penelitian ini menggunakan pendekatan legislatif, studi kasus, dan metodologi penelitian hukum normatif. Untuk memahami bagaimana hukum digunakan dalam menyelesaikan kredit bermasalah, data dikumpulkan melalui tinjauan pustaka undang-undang dan peraturan, literatur ilmiah, dan dokumen terkait. Data kemudian dievaluasi secara deskriptif dan analitis. Hasil penelitian menunjukkan bahwa kredit macet di BPR Karawang Jabar disebabkan oleh kombinasi faktor internal dan eksternal. Faktor internal meliputi lemahnya sistem pengawasan dan kurangnya analisis kelayakan kredit. Faktor eksternal mencakup kondisi ekonomi yang tidak stabil, penurunan pendapatan debitur, dan kebutuhan sosial mendesak. Penyelesaian dilakukan melalui dua pendekatan, yaitu restrukturisasi kredit dan penyelesaian hukum berupa eksekusi jaminan atau gugatan ke pengadilan. Penelitian ini menegaskan pentingnya penguatan manajemen risiko dan peningkatan kapasitas sumber daya manusia di lingkungan BPR.

Abstract

The purpose of this study is how the authority of the Central Jakarta Religious Court is in resolving sharia economic disputes and how is the legal reasoning of judges in deciding this sharia economic case. Decision Number 0950/Pdt.G/2019/PA.JP is a sharia economic case regarding a musyarakah contract related to default involving four parties, namely Pelawan as PT. Mofatama Bangun Nusa (Company Legal Entity), Defendant I as PT. Bank Muamalat Indonesia, Tbk. and Defendant II as Head of State Assets and Auction Service Office II Jakarta/KPKNL II Jakarta as Co-Defendant I, as well as Private Auction Center PT. Power Astindo Selaras as Co-Defendant II and Mrs. Dian Pertiwi as Defendant III This research is a qualitative descriptive field research, taking place at the Central Jakarta Religious Court. The method used is normative juridical. Based on the results of the research, the judge granted Pelawan's resistance where the Defendant had defaulted/broken his promise during the execution of the auction on 9 July 2019 and thereafter which was carried out by Co-Respondent II/Private Auction Center PT. Power Astindo Selaras, for the Determination of the Co-Opponent I / KPKLN II Jakarta Tender Execution, No. S-1040/WKN.07/KNL. 02/2019, May 9 2019 is invalid and Convicts the Defendant to pay court fees.Tujuan penelitian ini adalah bagaimana kewenangan Pengadilan Agama Jakarta Pusat dalam menyelesaikan sengketa ekonomi syariah dan bagaimana legal reasoning hakim dalam memutuskan perkara ekonomi syariah ini. Putusan Nomor 0950/Pdt.G/2019/PA.JP merupakan perkara ekonomi syariah akad musyarakah terkait wanprestasi yang melibatkan empat pihak, yakni pihak Pelawan selaku  PT. Mofatama Bangun Nusa (Badan Hukum Perusahaan), pihak Terlawan I selaku pihak PT. Bank Muamalat Indoneisa, Tbk. dan Terlawan II selaku Kepala Kantor Pelayanan Kekayaan negara dan lelang II Jakarta/KPKNL II Jakarta selaku turut Terlawan I, serta Balai Lelang Swasta PT. Power Astindo Selaras selaku turut Terlawan II beserta Ny. Dian Pertiwi selaku Terlawan III. Penelitian ini adalah penelitian lapangan yang bersifat deskriptif kualitatif, dengan mengambil lokasi di Pengadilan Agama Jakarta Pusat. Urgensi dari penelitian ini adalah untuk mendeskripsikan bagaimana kewenangan absolut dari pengadilan agama untuk memutuskan perkara yang terkait dengan ekonomi syariah, sehingga melalui ini didapatkan sebuah legal reasoning dalam pemutusan perkara ekonomi syariah. Metode yang digunakan adalah yuridis normatif.  Berdasarkan hasil penelitian hakim mengabulkan perlawanan Pelawan dengan dimana Terlawan telah melakukan wanprestasi/ingkar janji dalam pelaksanaan eksekusi Lelang tanggal 9 Juli 2019 dan setelahnya yang dijalankan turut Terlawan II/Balai Lelang Swasta PT. Power Astindo Selaras, atas Penetapan Eksekusi Lelang turut Terlawan I / KPKLN II Jakarta, No. S-1040/WKN.07/KNL. 02/2019, tanggal 09 Mei 2019 tidak sah dan Menghukum Terlawan untuk membayar biaya perkara. Ekonomi Syariah; Musyarakah; Wanprestasi

Abstract

Copyright protection for musical works is a vital aspect of the music industry. However, the practice of using songs commercially without the creator’s authorization remains a significant problem that violates both economic and moral rights. This research aims to analyze the scope of legal protection for song copyrights under Law Number 28 of 2014 and the challenges of its enforcement. It also critically examines the Panel of Judges’ legal reasoning in Case Number 92/Pdt.Sus-HKI/Copyright/2024/PN Niaga Jkt.Pst concerning the determination of the Performer’s liability and the application of civil sanctions. This normative legal research employs a qualitative analysis of primary and secondary legal materials, drawing on statutory, case, and conceptual approaches. The findings indicate that although Law Number 28 of 2014 provides a robust basis for protection, various enforcement challenges persist. Case Number 92/Pdt.Sus-HKI/Copyright/2024/PN Niaga Jkt.Pst affirmed the occurrence of copyright infringement by the Performer. The ruling found the Performer liable despite the presence of an organizer. It also imposed economic damage sanctions by referencing parameters within criminal provisions. However, the court rejected the claim for moral rights damages for lack of proof. This case has implications for affirming the Performer’s liability and the paradigm for imposing sanctions in song copyright disputes. It also promotes increased legal awareness within the Indonesian music industry.
