Abstract

Dalam globalisasi perdagangan bebas, hak atas merek dagang merupakan hal penting untuk dibuat dalam perdagangan yang sehat. Tanda digunakan dalam aktivitas perdagangan barang dan jasa juga sebagai pembeda produk dari suatu perusahaan. Untuk itu, tanda merupakan keaslian suatu barang atau jasa antara produsen sebagai jaminan pribadi serta reputasi produk dan jasa tersebut.Perlindungan atas hak yang timbul dari kreativitas manusia dalam barang dan jasa sangat berkembang dan memilki kemiripan dengan pemboncengan reputasi (passing off) dalam satu sisi.  Oleh karena itu, saat ini pelanggaran merek sering dilakukan dengan motivasi untuk memperoleh keuntungan dari merek barang atau jasa yang telah terkenal. Aktivitas tersebut meskipun tidak melanggar hukum namun melanggar hak perusahaan yang telah memiliki reputasi atas merek barang dan jasa tersebut

Abstract

The purpose of the study is to provide a theoretical basis on the discussion of space by comparing the theory of space law with Indonesian laws related to space. Nowadays, space is no longer empty land, no man's land, but has become an arena of competition for the interests of various countries and international organizations. As space currently has limitless economic and strategic values. To utilize space optimally, an understanding between the parties concerned is necessary. Thus, the existence of the theory of space law becomes a vital issue in bridging the gap between the needs and availability of area in space as not every position in space has the same economic and strategic value. The research was conducted by using the method of doctrinal legal research using the conceptual and legal approach which is explained descriptively by analysis using the deductive method. The results of the study are going to determine the differences in the concept of mastery of space according to the theory of space law and according to Indonesian law.

Abstract

Moral Rights protection is getting ignored in the era of global economy, specially since the beginning the emergence of the Information Technology revolution is marked by the use of the Internet as a means of communication. In the era when copyrights exploitation is becoming more intensive, complex, and multifacet, the appreciation of moral rights is being ignored. Society can access easily in the form of information products and other digital products which can be directly received. However, copyright infringement for e-books are often overlooked, because it's so easy to copy and modify digital product. Issues related to moral rights are the work of the e-book is translated without permission, and then up loaded in the Internet. This is an issue that occurs in cyberspace. Copyright is the legal protection extended to the owner of the rights in an original work that he has created on e-book. Nowadays, people can easily access and obtain digital information such as e-book which is published and reproduced without respecting the copyrights of it. The issue related to the moral rights is that the e-book is translated without getting legal permission from the author, and publish it on the internet. This is a law issue in the realm of internet. Copyrights privides legal protection to the original owner of the e-book. That is why; the objective of this study is to find and analyze copyrights breaching happens in cyberspace and what efforts needed to examine prevention of moral rights infringement under Indonesia regulations.Keywords: Moral Rights; Copyright; Electronic Publishing; E-Book TranslationABSTRAKPerlindungan Hak Moral semakin terabaikan dalam era ekonomi global, terutama sejak munculnya revolusi Teknologi Informasi (TI) yang ditandai dengan maraknya penggunaan Internet  sebagai sarana komunikasi. Dalam era digital eksploitasi karya cipta semakin intensif, kompleks, dan multifacet, sehingga cenderung mengabaikan penghormatan terhadap hak moral pencipta. Dewasa ini, masyarakat dapat dengan mudah mengakses dan mendapatkan  informasi  dalam bentuk produk informasi digital termasuk buku elektronik (e-book). Akan tetapi, hal ini menyebabkan  terjadinya pelanggaran terhadap Hak Cipta buku elektronik (e-book) yang sering  kali diabaikan, hal ini terjadi karena begitu mudahnya orang untuk menyalin dan memodifikasi produk digital tersebut. Isu yang terkait dengan hak moral adalah karya e-book tersebut diterjemahkan tanpa izin pengarangnya, dan kemudian dimuat di Internet. Ini adalah permasalahan hukum yang terjadi di dunia maya. Hak Cipta memberikan perlindungan hukum kepada pemilik hak dalam karya asli seperti pada e-book tersebut. Oleh karena itu, tujuan dari penelitian ini adalah untuk menemukan dan menganalisis pelanggaran Hak Cipta di dunia maya dan meneliti upaya pencegahan terhadap pelanggaran hak moral tersebut melalui peraturan hukum di  Indonesia.Kata Kunci : Hak Moral; Hak Cipta; Penerbitan Elektronik; Terjemahan E-Book

Abstract

Every Indonesian citizen has right to get job and decent living for humanity, but in reality, the limitation of job fields makes lots of Indonesian people prefer to work abroad. From year to year,the amount of Indonesian people who work abroad is always increasing. The magnitude of publicwho wants to workabroad and already work abroad not only has its positive effect to decreasethe unemployment problems, but also has its negative effect related to the possibility of inhuman treatment including trafficking. This kind of risk can be experienced by migrant workers during the departure period, working period, and after coming back to Indonesia. In other hand, UU No. 39 Tahun2004 about TKI (Tenaga Kerja Indonesia) placement and protection abroad has not accommodated the whole content of Konvensi Pekerja Migran, because it only covers TKI protection during pre-placement and postplacement. Unfortunately, the law cannot protect the TKI during working period abroad.

Abstract

Share acquistion is a very popular formof acquistion carried out in every company takeover. Share acquistion will, however, become an extraordinary matter when it creates monopoly and business competition. Acquistion is therefore still deemed as a controversial decision as it possesses dramatic and complex implications, detrimental as wel as beneficial to manyparties. With respectto the above, this research needed to study : First, what are the legal implications when share acquistion of a national company by a foreign company creates business competitions, and second, what legal protection is there for minoritysharehoders who suffered through the acquistion of a nationalcompany by a foreign company.

Abstract

Corruption Law should arrange for replacement of the convicted criminal money to be paid to the state. Legally if the convicted person is not able to reimburse the state, it will be replaced with imprisonment. Substitute criminal restitution imposed is not proportional to the amount of money obtained by the convict from the state and in addition, there is a wide disparity of restitution between many convicts. This study examines, first, what kind of additional criminal punishment in the form of payment of compensation which can protect the economic rights of the people? Second, how is the concept of proportionality (proportionality) should be applied for criminal compensation against the accused of corruption in the future? This study is normative juridicial, which uses methods of comparative law and conceptual. The results found that: first, the payment of compensation in practice does not protect the lost economic rights of the people through the passage of time until the decision is legally enforceable; payment of compensation is based only on the amount that the defendant obtained as proceeds of corruption. Secondly, the concept of proportionality/ proportionality substitute for criminal compensation can be applied with Jurimetri approach.

Abstract

Correctional systems are maintained in order to establish patronages to be fully human, aware of sins, improve themselves, and not to repeat the criminal act so that they can be accepted by society. In KKN-PPM, Universities and Penitentiary in Garut and Subangare cooperating one another in providing working guidance in a variety of competitive skills which has the objective to focus on the process of re-empowerment of inmates as well as sharpening human resources toward the prisoners. The method implemented is participatory methodwithin coaching inmates by giving community-based corrections. KKN-PPM has economic potential that can be enhancedits role through inmates empowerment at Class II A Subang and Class II B Garut correctional facilitiesby involving students from interdisciplinary, they are Agriculture Economic, and Law major. Based on the data, the number of the correctional facility and penitentiary inmates in Indonesia are around 76% including the productive age. The ultimate purpose of the correctional system is reuniting prisoners with the society, as good citizens and being more responsible.The ex-patronages in the community are expected to building the society and not the other wayor becoming an obstacle overthe development.

Abstract

Homeless Children in Bandung is a social problem that is being widely observed by all parties, both government and civil society/NGOs. Legal counseling is done at the shelter organizer in this case Yayasan Bahtera, which specifically deals with the existence of homeless children, the issue that interest people is girls though in terms of quantitatively less than boys since girls are particularly vulnerable by various acts of other behavior sides. The existence of homeless girls has also many aspects related to the problem of morality and law, even at  serious principle things related to sexual crimes, such as persuasion, violation, prostitution and trafficking. Therefore,  the law is intended to give more understanding of legal protection
