Abstract

ABSTRAK Pembiayaan mudharabah, yaitu salah satu bentuk pengelolaan uang/harta yang dibenarkan oleh Allah SWT dengan cara menyalurkan dengan memberi modal kepada seseorang atau sebuah lembaga. Modal tersebut kemudian dikelola di dalam suatu usaha yang layak. Sistem suplai dana melalui mudharabah adalah salah satu sistem penyuplaian dana terpenting di dalam syariat Islam. Mudharabah adalah akad antara dua orang yang berisikesepakatan bahwa salah seorang dari mereka akan memberikan modaldari harta miliknya sendiri kepada pihak lain sebagai modal usaha-usahaproduktif dan keutungan dari usaha itu akan diberikan sebagian kepadapemilik modal dalam jumlah tertentu sesuai dengan kesepakatan yang sudah disetujui bersama. Perjanjian Al-Mudharabah juga mengacu pada prinsip-prinsip pokok terhadap syarat-syarat sahnya perjanjian sebagaimana yang tertuang dalam Pasal 1320 KUHPerdata serta Mukallaf yaitu orang yang mampu bertindak secara hukum seperti baliq dan berakal sehat, dengan tidak mengesampingkan Asas kehati-hatian (Prudential Banking Principle) terhadap proteksi pengamanan dana Bank. Kata Kunci : Asas Konsensualisme, Perjanjian Mudharabah ABSTRACT Mudharabah financing, which is a form of money/wealth management that is justified by Allah SWT by channeling it by giving capital to a person or an institution. The capital is then managed in a viable business. The system of supplying funds through mudharabah is one of the most important systems of supplying funds in Islamic law.Mudharabah is a contract between two people that contains agreement that one of them will provide capital from his own property to other parties as business capital productive and profits from the effort will be given in part to owners of a certain amount of capital in accordance with the agreement have been mutually agreed. The Al-Mudharabah agreement also refers to the basic principles of the legal terms of the agreement as stated in Article 1320 of the Civil Code and Mukallaf, namely people who are able to act legally like baliq and have common sense, without overriding the Prudential Banking Principle. ) to the protection of the Bank's fund security.

Abstract

The Covid-19 pandemic was taking place in almost all countries around the world. Along with the increasingly vigorous government strategy in tackling the spread of the corona virus that was still endemic until now, the government had started to enforce the Large-Scale Social Restrictions (PSBB) with the signing of Government Regulation (PP) No. 21 of 2020 about PSBB which was considered able to accelerate countermeasures while preventing the spread of corona that was increasingly widespread in Indonesia. The research method used was normative prescriptive. The government put forward the principle of the state as a problem solver. The government minimized the use of region errors as legitimacy to decentralization. The government should facilitated regional best practices in handling the pandemic. Thus, the pandemic can be handled more effectively. The consideration, the region had special needs which were not always accommodated in national policies. The government policy should be able to encourage the birth of regional innovations in handling the pandemic as a form of fulfilling human rights in the field of health. Innovation was useful in getting around the limitations and differences in the context of each region. In principle, decentralization required positive incentives, not penalties. Therefore, incentive-based central policies were more awaited in handling and minimizing the impact of the pandemic.
