Abstract

Through various types of social media, everyone can experience the benefits of information technology, namely through the social networks Facebook, Twitter, Instagram, and so on without having to meet face to face. The awareness of some people to write and express opinions wisely through social media sometimes does not maintain behavior and ethics in interacting so that it is considered to cause problems as a result of what they upload, clash with the respect of others, one of which is the problem of defamation through social media with the existence of norms regulate it, but in proving the existence of an insult or defamation and the element of the offense is subjective in nature, it is different from the formulation of other offenses which are always formulated more objectively such as theft offenses. Called offense is subjective because it can only be assessed by the person concerned or the target target called the victim. It cannot be denied that the article regarding defamation in the Constitution of electronic information and transaction can be considered a “rubber article” apart from the fact that the offense element is subjective as well because there are no clear parameters and many acts can be classified as defamation. Then the article has the potential to be misused, thus threatening freedom of expression.

Abstract

Penolakan karantina di zaman pandemi adalah hal yang sangat berbahaya pada saat itu. Untuk hukum di negara Indonesia sendiri, masih kurang tegas dalam menegakkan keadilannya bahkan yang sudah tertulis sekalipun tidak cukup kuat untuk menegaskan keadilan yang ada. Penolakan karantina ini juga kerap kali dilakukan oleh oknum-oknum yang tidak bertanggung jawab karena merasa memiliki jabatan yang cukup besar untuk tidak menaati peraturan yang ada. Seperti pada contoh kasus yang kami berikan, penolakan karantina yang dilakukan oleh salah satu public figure yang ada justru merugikan banyak pihak, tidak hanya merugikan dirinya sendiri tetapi juga merugikan orang-orang yang membantunya serta masyarakat sekitar. Namun, dia dan rekan-rekannya yang melanggar kekarantinaan ini justru tidak mendapat hukuman yang sepantasnya sedangkan orang-orang yang membantunya untuk melanggar kekarantinaan ini mendapat sanksi yang lebih berat. Tujuan dari penelitian ini, adalah untuk mengetahui penegakan sanksi hukum serta mengetahui etika, hukum dan keadilan terhadap pelaku penolakan karantina. Dan juga sama seperti yang sudah-sudah, hukum yang berlaku bergerak tumpul ke atas dan runcing kebawah. Etika, hukum dan keadilan adalah hal yang berkesinambungan dan memiliki satu kesatuan yang padu termasuk pada hal penolakan karantina itu sendiri, dimana hak masyarakat, ketentuan hukum dan sifat dasar menolak dan menerima menentukan segala aspek. Menurut temuan penelitian ini, seharusnya untuk pelaku penolakan karantina, dikenakan sanksi yang lebih tegas dan sama rata, tanpa terkecuali agar tidak terjadinya kecemburuan sosial. Kecemburuan sosial itu sendiri, sangat merugikan seperti orang-orang yang tidak memiliki kekuasaan atau jabatan yang penting untuk bisa membantunya lari dari tanggungjawab, sedangkan orang-orang yang memiliki kekuasaan dengan tenang kabur begitu saja.

Abstract

Community service is an activity aimed at assisting specific communities in various activities. This activity is a part of the Tri Dharma of Higher Education, an educational activity for the community in the form of formal and non-formal education for children or students. In community service, it is expected to increase students' interest through an Indonesian language learning approach at MTS. AL-HIJRAH NU Medan, the learning approach is conducted using the play-for-study method, where Indonesian language learning will utilize a learning media in the form of a synonym and antonym dictionary application. Through the approach of learning by playing in groups, skills in understanding antonyms and synonyms are developed, so that through this game, it is hoped that students will be able to understand the similarities/differences in vocabulary. This approach provides an opportunity for students to interact with each other and express various arguments in their minds. From this activity, it is hoped that the use of the synonym and antonym dictionary application as a facility that accommodates students' learning, practicing, and playing activities through word-guessing skills can be fulfilled and beneficial to the surrounding community.

Abstract

This study aims to examine the impact of implementing the Think-Pair-Share (TPS) cooperative learning model on improving academic motivation and learning achievement in Indonesian language lessons at SD Pangeran Antasari Medan. The TPS model was chosen because it encourages students to actively engage in discussions and collaborate, which can enhance their involvement in learning. The research method used is a quantitative approach with an experimental design, where data is collected through pre-tests and post-tests to measure changes in students' motivation and academic performance. In addition, a questionnaire was used to assess students' academic motivation. The results of the study show a significant improvement in both academic motivation and learning achievement after the implementation of the TPS model. Normality and statistical tests were conducted to ensure the validity of the data. This study provides benefits for the development of Indonesian language teaching at the elementary level by introducing a method that can effectively improve students' motivation and academic performance.

Abstract

This research analyzes the implementation of the rights of correctional inmates based on Law Number 22 of 2022 concerning Corrections, which emphasizes a humanist approach in the correctional system. This law emphasizes that inmates still have basic rights, such as education, health, family visits, and mental and social training. Using normative-empirical research methods, this research examines the implementation of these regulations at the Medan Class I Penitentiary. The research results show that although these rights have been regulated in statutory regulations, their implementation still faces various obstacles, such as the limited number of correctional officers, overcapacity conditions, and a lack of facilities and health personnel. These obstacles hinder the optimization of the community system in achieving the goal of social reintegration for inmates. Therefore, strategic steps are needed from related parties to increase the effectiveness of providing the rights of inmates in order to achieve more optimal community goals.

Abstract

 Health history is a file that contains important notes or documents that contain the patient's identity regarding examinations, treatment, actions and services that have been provided to the patient. Medical records have a major influence on the legal relationship between hospitals and patients. This research examines two things, namely legal regulations related to the management of hospital patient files and the responsibility of hospitals to disclose confidential medical records. The author's aim in conducting this research is to analyze the responsibility of hospitals, especially medical personnel, if there is a data leak from a patient's medical history. This type of research is normative legal research, with emphasis on the study of legislation and literature, analyzing and revising applicable legal norms as a basis for problem solving. The research results show that the legal provisions contained in Law NO 17 of 2023 concerning health, medical personnel can be prosecuted for negligence in health services, including divulging medical secrets. Regulated in Article 301 paragraph (2) of Law NO 17 of 2023 concerning Health, medical personnel can be held responsible for actions/deeds related to the implementation of Health Services including medical records which cause civil and criminal harm to patients.

Abstract

This research aims to analyze the role of mediation as a method of medical dispute resolution in Indonesia, which is seen as more effective, fair, and cost-effective than the litigation process. This research uses a normative legal method with a descriptive-analytical approach to identify legal principles, doctrines, and regulations related to medical dispute resolution. The main focus is dispute resolution through mediation in medical malpractice cases, which involves civil, criminal, and restorative justice aspects. The novelty of this research lies in the in-depth exploration of penal mediation as an approach in resolving criminal disputes related to medical malpractice, even though it does not yet have a strong legal foundation in the Indonesian criminal justice system. The results show that mediation, both in the civil and criminal realms, can provide a more humane and satisfying solution for all parties involved. However, the implementation of penal mediation still faces legal and practical challenges, especially in providing protection of patients' rights and ensuring justice for medical personnel.In conclusion, mediation has great potential in resolving medical disputes in Indonesia, but more specific regulations are needed to optimize its implementation, especially in criminal cases. As such, this study makes an important contribution to the development of a better medical dispute resolution mechanism in Indonesia.
