Abstract

The concept of human peace, traditionally explored in the context of physical or political conflicts, has gained relevance in digital spaces where human interactions increasingly occur. This article examines how peaceful narratives can emerge within controversial discussions online, focusing on a specific case: the debate around the use of the flex menstrual disc. Using Netnography as the primary method, this study observes netizen interactions within a polarized thread, highlighting how, despite differing opinions, some participants contribute to a constructive and peaceful dialogue. Supported by theories such as Nonviolent Communication and Conflict Resolution, the research seeks to identify language patterns and behaviors that foster peace, even in contentious digital environments. The results of this study are to demonstrate that peaceful engagement is possible in online discussions, offering insights into how human peace can be maintained and encouraged in digital interaction spaces.

Abstract

Abstract: The right of unborn child (fetus) is one of the long-standing and debatable topics in both contemporary and classical literatures. In general, the discussions of the right of the unborn child are mostly brought into the perspective of human right. On the one hand, the case of abortion is always to be the heated topic because it relates to the right to life. On the other hand, there are only few studies address the civil rights of the fetus, even though the fetus is the early stage of a human and thus is treated as the weakest legal subject. Based on this, this article seeks to elaborate two main problems: the extent to which Indonesian positive law regulates the interests of the fetus as a legal subject and the discussions of the fetus’ civil rights, particularly on the issue of its in inheritance, will and endowments in classical fiqh. This is a literature research, with a normative juridical approach. The results of this study are: (1) Islamic law and positive law in Indonesia are similar in recognizing the legal subject of a fetus who can attain the right of inheritance, will, and endowments; (2) Islamic law and positive law in agreement that unborn child who dies in his/her mother’s womb or born dead is not eligible to inherit; (3) in Islamic law, the fetus has the right to the property that is endowed to him/her and the profit generated from it, while the positive law does not explain clearly the permissibility or impossibility of waqf to the fetus.Abstrak: Isu tentang anak merupakan salah satu topik pembahasan dalam berbagai literatur baik klasik maupun kontemporer. Pembahasan-pembahasan ini pada umumnya membicarakan hak-hak janin yang berkaitan dengan hak-hak untuk hidup, dalam hal ini adalah fikih aborsi. Pada sisi lain, tulisan yang mengulas tentang hak-hak keperdataan janin tidak begitu banyak padahal anak dalam kandungan merupakan bagian dari anak secara keseluruhan dan merupakan subjek hukum yang paling lemah. Berdasarkan hal ini, artikel ini berupaya memaparkan dua pokok masalah, yakni sejauh mana hukum positif di Indonesia mengatur kepentingan janin sebagai subjek hukum dan bagaimana diskusi fikih klasik menyinggung hak-hak keperdataanya terutama dalam kewarisan, wasiat, dan wakaf. Penelitian ini merupakan penelitian pustaka, dengan pendekatan yuridis-normatif. Hasil penelitian ini yakni: (1) antara hukum Islam dan hukum positif di Indonesia menerapkan hukum yang sama dalam hal pengakuan janin sebagai subjek hukum yang dapat memiliki hak waris dan wasiat; (2) hukum Islam dan hukum positif menganggap janin tidak pernah ada apabila ia telah mati dalam kandungan atau terlahir dalam keadaan mati sehingga hak waris dan wasiatnya tidak ada; (3) dalam hukum Islam, janin berhak atas barang yang diwakafkan kepadanya dan yang dihasilkan dari barang tersebut, sedangkan hukum positif tidak menjelaskan kebolehan atau ketidakbolehan wakaf terhadap janin.

Abstract

This study discusses the waṣiya right of the fetus (janīn) in the context of Islamic law. Islamic law in this regard is the opinion of the most powerful jurists in the four best known sects (mażhab). Being something that is worth mentioning is due to the lack of human attention and the legality that surrounds it to the rights of janīn. This study aims to find out how Islamic law protects the rights of children in the content with the strongest opinions available. This research is a literature study by collecting data in classic jurisprudence books to find out the opinions and opinions of past jurists and other supporting articles, normative jurisprudence that seeks to extract values and norms from the opinions of classical jurists. or any of the arguments contained in the law, and uses a descriptive approach intended to illustrate in general the scope of Islamic law in relation to the rights of the janīn. This study of Islamic law produces the strongest opinions of any internal debate in a sect, and the most salient opinion of all mażhab on a waṣiya right of the janīn.

Abstract

Fatwas have so far been issued by religious institutions in Indonesia. Not many Islamic educational institutions based in pesantren perform istinbath al-ahkam in response to contemporary issues. Ma'had Aly Salafiyah Syafi'iyah Sukorejo Situbondo in East Java (Ma'had Aly Situbondo) is one of the Islamic educational institutions within the pesantren environment contributing to the formulation of fatwas. This research examines the istinbāṭ al-ahkām conducted by Ma'had Aly Situbondo using a field research method involving interviews with students and lecturers of Ma'had Aly Situbondo, as well as studying documents from the Tanwirul Afkar bulletin from 2020-2021. The bulletin contains a collection of findings from the Istinbāṭ al-Ahkām Ma'had Aly Situbondo addressing contemporary legal issues. The research findings explain that istinbāṭ al-ahkām at Ma'had Aly Situbondo uses qauli and manhaji approaches. The qauli approach combines texts from fiqh books with texts from the Qur'an and Hadith. In contrast, the manhaji approach involves exploring the principles of fiqh and usul al-fiqh (manhajiy school) based on public interest considerations.  Abstrak: Fatwa selama ini disusun oleh lembaga keagamaan di Indonesia. Tidak banyak lembaga pendidikan Islam yang berbasis pada pesantren melakukan istinbāṭ al-aḥkām dalam merespons persoalan-persoalan kontemporer. Ma’had Aly Salafiyah Syafi'iyah Sukorejo Situbondo Jawa Timur (Ma’had Aly Situbondo) merupakan salah satu lembaga pendidikan Islam di lingkungan pesantren yang berkontribusi pada penyusunan fatwa. Penelitian ini mengkaji istinbāṭ al-aḥkām yang dilakukan Ma’had Aly Situbondo dengan menggunakan metode field research yang digali dari wawancara kepada mahasiswa dan dosen Ma’had Aly Situbondo serta studi dokumen yang bersumber dari buletin Tanwirul Afkar tahun 2020-2021. Buletin tersebut berisi kumpulan hasil istinbāṭ al-aḥkām Ma’had Aly Situbondo dalam merespons problematika hukum kontemporer. Temuan penelitian menjelaskan bahwa istinbāṭ al-ahkām Ma’had Aly Situbondo dilakukan dengan pendekatan qawlī dan pendekatan manhajī. Pendekatan qawlī dilakukan dengan memadukan antara teks yang terdapat dalam kitab-kitab fikih dengan teks al-Qur’an dan hadis, sedangkan pendekatan manhajī dilakukan dengan menelusuri kaidah fikih dan ushul fikih yang berbasis pada kemaslahatan.

Abstract

Abstract: This article explores the normative foundations of family finance in Islam by examining key doctrines within classical and contemporary fiqh literature. The study focuses on fundamental aspects such as financial responsibilities (nafaqah), wealth management, and intra-household economic roles. It adopts a doctrinal approach to analyze legal texts from major Islamic legal schools (madhāhib), while engaging critically with selected modern social and economic theories to enrich the normative discussion. By juxtaposing Islamic jurisprudential insights with contemporary discourses on household economics, gender roles, and financial planning, the article seeks to offer a balanced and context-aware understanding of Islamic family economy. This synthesis aims to highlight both the enduring relevance and adaptive potential of Islamic legal principles in addressing the economic realities faced by Muslim families today. Keywords: Family Finance; Fiqh; Contemporary Social-Economy Discourse.   Abstrak: Artikel ini mengeksplorasi fondasi normatif keuangan keluarga dalam Islam dengan memeriksa doktrin kunci dalam literatur fiqh klasik dan kontemporer. Studi ini berfokus pada aspek mendasar seperti nafkah wajib (nafaqah), manajemen kekayaan, dan peran ekonomi intra-rumah tangga. Ini mengadopsi pendekatan doktrin untuk menganalisis teks-teks hukum dari aliran hukum Islam utama (madhāhib), sambil terlibat secara kritis dengan teori-teori sosial dan ekonomi modern yang dipilih untuk memperkaya diskusi normatif. Dengan menyandingkan wawasan yurisprudensi Islam dengan wacana kontemporer tentang ekonomi rumah tangga, peran gender, dan perencanaan keuangan, artikel ini berusaha menawarkan pemahaman yang seimbang dan sadar konteks tentang ekonomi keluarga Islam. Sintesis ini bertujuan untuk menyoroti relevansi abadi dan potensi adaptif prinsip-prinsip hukum Islam dalam mengatasi realitas ekonomi yang dihadapi oleh keluarga Muslim saat ini. Abstract

This study discusses the conversations of cyber citizens, specifically the social media Twitter (X), about the phenomenon of menstrual sex trends and how Islamic family law responds to netizens' discussions about the trend.   This research is a normative-empirical legal research. The results of this study show at least two main findings. First, the form of netizens' responses to the thread raised by Andrea Gunawan (@catwomanizer) varies. The first group states that even with the help of a device that prevents menstrual bleeding during sexual intercourse, it does not abort haram. Another group's response stated otherwise, if women who have more potential to be disadvantaged have been declared to be close to zero risk, as long as there is consent from both parties, then sexual intercourse can be carried out. Meanwhile, many other groups responded to this trend by asking the thread owner again and showing a neutral attitude of not judging the arguments made by the account owner. Second, Islamic law has clarity of attitudes and rules related to sexual behavior. There are no exceptions regarding the rules of sexual intercourse during menstruation. Normatively, Islamic law states that women who are menstruating should not be approached by their partners. Approaching in this case means sexual intercourse with the meeting of two genitals. Even if it is under the pretext and excuse that medical risks have been dealt with with the presence of certain tools, it still does not invalidate the original law.

Abstract

Poverty and social inequality remain major challenges in achieving sustainable development, necessitating alternative instruments that promote inclusive economic empowerment. Productive zakat, as an innovative approach to zakat management, has strong potential to support the Sustainable Development Goals (SDGs). This study aims to analyze the role of productive zakat in supporting the achievement of the SDGs, particularly in poverty alleviation, economic growth, gender equality, and the reduction of social inequalities. This study employs a qualitative descriptive method through a literature review. Data were collected from national and international academic journal articles, zakat management regulations, and relevant publications of zakat institutions. The analysis focuses on examining the relationship between the implementation of productive zakat and SDG indicators. The findings indicate that productive zakat contributes substantially to increasing beneficiaries’ income and economic self-reliance through the provision of business capital, skills training, and continuous mentoring. In addition, productive zakat supports microenterprise development, job creation, enhanced women’s economic participation, and the reduction of social inequality at the community level. The implications of this study highlight the importance of strengthening governance, program integration, and impact-based evaluation to optimize productive zakat as a strategic instrument of Islamic economics in advancing the achievement of the SDGs and sustainable economic development.

Abstract

This article examines the normative foundations of family finance in Islam and their pivotal role in strengthening family resilience through a normative-doctrinal analysis of classical Islamic jurisprudence texts, including works by Al-Kasani, An-Nawawi, Ibn Qudamah, and contemporary scholarly interpretations. The study analyzes primary sources from the four major madhāhib (legal schools), Quranic verses, and authenticated hadith collections, while critically engaging with contemporary theories of family resilience and household economics from scholars such as Becker, Putnam, and empowerment theorists. This research employs no empirical data or case studies but focuses entirely on doctrinal analysis and theoretical synthesis. By synthesizing traditional Islamic teachings with modern socio-economic discourses, this research highlights how Islamic financial norms, rooted in concepts of responsibility (mas’ūliyyah), moderation (i’tidāl), and trust (amānah), contribute not only to economic stability but also to the adaptive capacity and emotional well-being of families in the face of changing social realities. This study argues that Islamic family finance norms offer a comprehensive framework that fosters both material sufficiency and holistic resilience, thus demonstrating the dynamic applicability of Islamic legal values in contemporary family life.
