Abstract

Medical malpractice has serious consequences for patients and creates a legal burden on hospitals as healthcare institutions. This article aims to analyze the form and limits of hospital legal responsibility in cases of medical malpractice based on a normative approach to laws and regulations in Indonesia, especially Law No. 17 of 2023 concerning Health and Government Regulation No. 28 of 2024 concerning Implementing Regulations of the Health Law. This research uses a normative qualitative method with a legislative and conceptual approach. The results of the study show that hospitals can be held held accountable civilly, criminally, and administratively, especially in the framework of vicarious liability, where the hospital is responsible for the actions of medical personnel under its authority. However, there are still weaknesses in the implementation of regulations and gaps between legal norms and field practice. Therefore, it is necessary to strengthen the supervision system, internal medical evaluation, and legal protection for patients and medical personnel

Abstract

Protection of elderly prisoners or what we often call the elderly is one of the issues that should receive special attention in criminal justice in Indonesia. From a legal perspective, these elderly prisoners are often in physical or psychological conditions that require fair treatment because it is influenced by their rights as Indonesian citizens. The legal and correctional system in Indonesia has regulated several provisions regarding elderly convicts. As regulated in Law No. 12 of 1995 concerning Corrections. One of them is the rights of prisoners in general, but cannot explicitly address the problems being faced by elderly prisoners. However, existing regulations must be able to provide guarantees for the basic rights that elderly prisoners must obtain. Such as, the right to receive health and medical care, the right to feel safe from discrimination and the right to their safety while serving their sentence. From a juridical perspective, attention to the protection of human rights (HAM) for elderly prisoners is very important. In accordance with the principle of protecting human rights contained in the constitution and many national instruments, it emphasizes the importance of humane treatment, including for elderly prisoners. However, in its implementation, elderly convicts often have difficulties when they are in correctional institutions

Abstract

Layanan kurir menjadi elemen vital dalam mendukung kegiatan perekonomian dan komunikasi di era digital. JNE Express sebagai salah satu perusahaan jasa ekspedisi ternama di Indonesia memiliki tanggung jawab hukum atas pelaksanaan perjanjian pengangkutan barang yang dilakukan dengan konsumen. Penelitian ini bertujuan untuk menganalisis bentuk pertanggungjawaban JNE Express atas wanprestasi dalam pengiriman barang serta mengkaji upaya hukum yang dapat dilakukan konsumen. Penelitian ini menggunakan pendekatan yuridis empiris, yaitu perpaduan antara pendekatan hukum normatif dan fakta empiris melalui wawancara dan observasi. Hasil penelitian menunjukkan bahwa JNE Express belum sepenuhnya memenuhi pertanggungjawaban atas wanprestasi seperti keterlambatan, kerusakan, dan kehilangan barang. Hal ini disebabkan oleh kurangnya pemahaman konsumen terhadap klausul perjanjian, rendahnya penggunaan asuransi, lemahnya kualitas pelayanan pelanggan, serta kendala teknologi. Upaya hukum yang dapat dilakukan konsumen meliputi jalur litigasi dan non-litigasi seperti mediasi dan pengaduan ke BPSK. Edukasi terhadap konsumen dan penguatan sistem manajemen mutu JNE Express menjadi kunci dalam meningkatkan perlindungan hukum bagi konsumen.
