Abstract

Many children have a pregnancy out of wedlock. Many factors make the parents marry off their underage children who are pregnant out of wedlock, by applying for matrimonial dispensation to the Religious Courts. Law Number 1 Year 1974 on Marriage has set a minimum age limit for men and women to marry with age and psychological maturity considerations, for the realization of the purpose of the marriage. This study uses a juridical-empirical method, which will see the Religious Courts as the authorized institution, having particular considerations in granting marriage dispensation applications in order to fulfill the rights of the people and to preserve the order of life in the community.[]Banyak terjadi anak-anak mengalami kehamilan di luar nikah akibat dari pergaulan yang terlalu bebas antara laki-laki dan perempuan. Banyak faktor yang membuat orang tua menikahkan anaknya yang masih di bawah umur yang hamil di luar nikah, yakni dengan mengajukan permohonan dispensasi kawin ke Pengadilan Agama. Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan telah menentukan batas usia minimum bagi laki-laki dan perempuan untuk menikah dengan pertimbangan kematangan usia dan psikologis, demi terwujudnya tujuan pernikahan tersebut. Penelitian ini menggunakan metode yuridis-empiris, yang akan melihat Pengadilan Agama sebagai lembaga yang  berwenang, memiliki pertimbangan-pertimbangan tertentu dalam mengabulkan permohonan dispensasi kawin dengan tujuan untuk memenuhi hak-hak masyarakat.

Abstract

Prostitution is a form of sexual deviation and disease of society and also against Indonesian morality. Therefore, its existence is a problem for the Indonesian nation. One of the causes is that criminal formulation policies are set within KUHP specifically article 296 jo. article 506 only discussing about criminal responsibility for a pimp. The other parties involved in such prostitution as prostitutes (sex workers) and client of prostitutes are not convicted unless one or both are committed in marriage, so it can be convicted under article 284 which qualifies for a felony in adultery. Based on these issues, this research aims to learn and analyze criminal policy for client of prostitutes in positive laws in Indonesia and criminal policy for client of prostitutes to realize substantial justice. The results of this research show that criminal policy for client of prostitutes in positive laws is not optimal. The arrangement of prostitution in particular article 296 jo. 506 KUHP only disscuss about criminal resonsibility for a pimp, so there is a legal vacuum in Indonesia's penal formulation policy that regulates prostitution. The government's policy to close brothels in Indonesia still raises problems as it is not followed by reformulation of criminal laws that regulate prostitution crimes. Thus, it has been necessary for criminal policy either by penal or non-penal efforts to realize the laws expected by society and to attain substantial justice (the perfect justice). The author's recommendation would be to include new legal norms governing prostitution crimes and encourage governments to legitimize RUU KUHP and RUU PKS.[]Praktik prostitusi ini menjadi problematika tersendiri bagi bangsa Indonesia. Salah satu penyebabnya adalah rumusan pemidanaan yang diatur dalam KUHP khususnya Pasal 296 jo. Pasal 506 hanya berkaitan dengan pertanggungjawaban pidana muncikari. Pihak lain seperti pekerja seks komersial dan pengguna jasa prostitusi tidak dimintai pertangungjawaban, kecuali bila salah satu terikat hubungan perkawinan (Pasal 284 KUHP). Penelitian ini ditujukan untuk mengetahui dan menganalisis mengenai kebijakan kriminal bagi pengguna jasa prostitusi dalam hukum positif di Indonesia dan kebijakan kriminal bagi pengguna jasa prostitusi yang berkeadilan substansial. Hasil penelitian menunjukkan bahwa criminal bagi pengguna jasa prostitusi dalam hukum positif Indonesia belum optimal. Pengaturan mengenai prostitusi khususnya dalam Pasal 296 jo. Pasal 506 KUHP hanya berkaitan dengan pertanggungjawaban pidana bagi muncikari (hal ini didasarkan karena KUHP/WvS masih dipengaruhi budaya hukum Belanda dan Prancis), sehingga menimbulkan adanya kekosongan hukum dalam kebijakan formulasi hukum pidana di Indonesia yang mengatur terkait praktik prostitusi. Upaya non penal melalui penutupan lokalisasi juga masih menyisakan permasalahan karena tidak diikuti dengan reformulasi hukum pidana yang mengatur terkait kejahatan prostitusi. Oleh karenanya, dibutuhkan kebijakan kriminal baik melalui pendekatan penal maupun non penal yang berkeadilan substansial untuk mewujudkan keadilan yang dicita-citakan masyarakat. Adapun rekomendasi penulis adalah dengan memasukkan norma hukum baru yang mengatur mengenai kejahatan prostitusi dan mendorong pengesahan RUU KUHP dan RUU PKS.

Abstract

Background. The increasing number of cases involving advertising installation companies that neglect safety standards has raised significant legal concerns, particularly regarding consumer protection. The background of this study lies in the unlawful acts committed by such companies, which often result in physical, material, or psychological harm to the public. This research aimed to determine the extent of the responsibility of advertising companies in committing unlawful acts and analyze the legal liability for unlawful acts by advertising companies that result in consumer harm. Research Method. This research uses a normative juridical method with a statutory and conceptual approach. Legal materials were sourced from primary legal norms, such as the Indonesian Civil Code, especially Article 1365 and supported by secondary sources, including academic literature and expert interpretations. The analysis was conducted qualitatively by classifying legal principles, doctrines, and case examples. Findings. The findings indicate that unlawful acts, as defined in Article 1365 of the Civil Code, are interpreted broadly in Indonesia. These acts may include violations of others' rights, neglect of legal obligations, conduct contrary to public decency, and actions against societal norms of caution. Advertising companies that disregard structural safety, proper licensing, or installation procedures can be held civilly liable if their actions cause harm to others. Conclusions. Advertising installation companies bear full legal responsibility for any consumer harm resulting from their unlawful conduct. To ensure accountability, stronger regulatory oversight and enforcement mechanisms are needed to protect the rights and safety of the public.

Abstract

The rapid growth of fintech lending in Indonesia requires adequate regulation and protection for consumers, especially fund recipients, who face high risks such as intimidation and sexual harassment, high-interest charges, and misuse of personal data by fintech lending platforms. For this reason, protecting fund recipients is a primary need because it involves protecting life and property, which is integral to the benefit of maqashid sharia. The main objective of this research was to detail the concepts of empowerment and justice as pillars of protection for fund recipients in fintech lending from a maslahah perspective. The research used normative juridical methods with statutory and conceptual approaches and analyzed secondary data from document studies in a descriptive qualitative. The results showed that empowerment and protection of fund recipients in fair fintech lending align with the principle of maslahah, contribute positively to the welfare of society, and support the growth of a sustainable fintech lending industry ecosystem, and offering hope for a better future.
