Abstract

Sasaran dari kegiatan pengabdian masyarakat ini adalah anggota komunitas Sahabat Mata khususnya mereka yang belum pernah mendapatkan pelatihan pijat dan mereka yang merasa memerlukan pengembangan terhadap kemampuan pijatnya. Berdasarkan pelatihan diperoleh hasil bahwa mereka yang belum pernah mendapatkan pelatihan pemijatan masih memerlukan bimbinganlebih lanjut untuk kemudian dapat disalurkan pada panti-panti yang sudah ada, sedangkan mereka yang sudah pernah mengikuti pelatihan sebelumnya sudah dapat disalurkan pada panti pijat-panti pijat atau sudah memiliki keberanian untuk berpraktek. Dengan demikian dapat disimpulkan bahwa proses pelatihan/pengabdian masyarakat dalam bentuk pelatihan pijat ini dapatdikatakan berhasil memberikan pengetahuan dan keterampilan bagi para tunanetrakhususnya mereka yang bernaung dibawah Yayasan Komunitas Sahabat Mata.

Abstract

Article 16 paragraph (3) of the Act No. 41 of 2004 on Waqf, describes the permissibility of movable properties as a waqfobject. One of them is the Intellectual Property Rights (IPR). The provision is clarified by Government Reg ulation No. 42 of 2006, which explains that the waqfobject of movable properties can be divided into two, namely waqfwith movable properties other than money, and the form of cash waqf ( waqf with money). The IPR is a kind of the first one. This provisions different from the provisions of Islamic jurisprudence which explains that the waqf object must be unmovable properties. This research will further explain the provisions of the law and the philosophical foundations of the permissibility of IPR ass the object of waqf in this modern era. This discussion aims to create a new formulation of the provisions of waqf with the normative approach to the research resources, such as Law no. 41 of 2004 on Waqf, government regulations, and related regulations a s well as the books of fiqh and uṣūl al-fiqh. The results of this study presents the epistemolo gical and methodological foundation of Intellectual Property Rights (IPR) waqf.***Pasal 16 ayat (3) Undang-Undang (UU) No. 41 Tahun 2004 tentang Wakaf menjelaskan kebolehan benda bergerak sebagai objek wakaf, salah satunya adalah Hak atas Kekayaan Intelektual (HAKI). Ketentuan tersebut diperjelas dengan ketentuan pelaksana UU No. 41 Tahun 2004 yang diatur dalam Peraturan Pemerintah No. 42 Tahun 2006, yang menjelaskan bahwa objek wakaf benda bergerak dibedakan menjadi dua, yaitu wakaf benda bergerak selain uang, dan wakaf benda bergerak berupa uang. Adapun wakaf HAKI merupakan wakaf benda bergerak selain uang. Ketentuan tersebut berbeda dengan ketentuan fikih yang menjelaskan bahwa benda yang diwakafkan haruslah benda yang tidak bergerak. Penelitian ini lebih lanjut akan menjelaskan ketentuan hukum dan landasan filosofis diperbolehkannya wakaf HAKI menjadi objek wakaf yang sangat mungkin dilakukan di era modern ini. Pembahasan ini bertujuan membuat formulasi baru dari ketentuan wakaf yang penting untuk dibahas dengan pendekatan normatif terhadap sumber-sumber penelitian dari baik UU No. 41 Tahun 2004 tentang Wakaf, Peraturan Pemerintah dan UU terkait serta kitab-kitab fikih dan uṣūl al-fiqh yang relevan. Abstract

Modern retail market, especially in Central Java experiencing tremendous growth lately, based on the data, in 2004 the number reached 1,496 traditional markets, while the modern market amounted to 232. Different conditions occurred in 2008, the number of traditional market just reached 1,443 while the modern market reached 399. That means there is a negative growth in traditional markets. In 2010 the modern retail market growth reached 10.2% (1,852 outlets). This condition is one side has a positive effect because it means showing the high investment in the real sector, but on the other result in the more traditional markets entrapment, especially the modern retail market using the franchise system to begin operations 24 hours per day. Therefore, the protection of traditional markets as the center of economic activities of small and medium-sized enterprises should be done to ensure the sustainability of small and medium enterprises.

Abstract

Abstract

Land wakaf is an action that has institutionalized in the structure of Indonesian society. In order to improve surety and legal protection for the existence of wakaf, Act No. 41 Year 2004 concerning Wakaf is created as the center of the regulation of Wakaf in Indonesia. In connection with land wakaf, based on the research, it is found that the regulation of land wakaf after the legalization of wakaf Act is clearer and stricter also more detailed in regulating various matters related to wakaf compared to the previous regulation. In relation to the area of land wakaf, the total area of land wakaf that has been registered in the Land-Affairs Office of Semarang City is as much as 56, 457. 4 m2, scattered at 104 locations in Semarang City region. Meanwhile, the area of land that has not been registered at the Land-Affairs Office of Semarang City is as much as 6, 015 m2, scattered at 29 locations in 7 districts. There are several factors hindering the implementation of Wakaf Act demanding to perform the registration of land wakaf after the legalization of Wakaf Act, which are, lack of socialization from the related institutions about the importance of performing registration of land wakaf, legal awareness of the caretakers of land wakaf that is still relatively low, and unavailability of fund used for performing registration of land wakaf.

Abstract

The regulation of Sharia Information Technology-Based Peer to Peer Financing Services (LPBBTI) is essential for its operational and supportive role in creating a prudent Sharia LPBBTI ecosystem. In July 2022, the Financial Services Authority issued a new regulation, Financial Services Authority Regulation No. 10/POJK.05/2022, which replaced the previous one. This research analyses the legal relationship, operational procedures, and protection of Sharia LPBBTI users under the latest regulation. The study applied normative juridical research and used relevant legal materials obtained through document studies. The findings reveal that POJK No. 10/2022 regulates the legal relationships between parties and protects service users but does not restrict the relationship between recipients and organisers of Sharia LPBBTI. Additionally, the regulation does not provide alternative dispute resolution mechanisms outside the court and only applies to licensed Sharia LPBBTI operators, leaving illegal operators outside its scope.Pengaturan Layanan Pembiayaan Bersama Berbasis Teknologi Informasi Syariah (LPBBTI) sangat signifikan sebagai pijakan operasional dan untuk mendukung ekosistem LPBBTI syariah yang prudent. Pada bulan Juli 2022, Otoritas Jasa Keuangan menerbitkan Peraturan Otoritas Jasa Keuangan (POJK) No. 10/POJK.05/2022 yang menggantikan POJK No. 77/POJK.01/2016. Fokus kajian dalam studi ini adalah bagaimana hubungan hukum, operasional, dan perlindungan hukum pengguna LPBBTI syariah diatur dalam peraturan terbaru tersebut? Penelitian ini tergolong dalam penelitian yuridis normatif dengan meng­guna­kan data sekunder yang dilakukan melalui studi dokumen. Dari hasil analisis kualitatif meng­hasilkan temuan bahwa POJK No. 10 Tahun 2022 telah mengatur hubungan hukum para pihak tetapi tidak mengatur hubungan hukum antara penerima dana dengan penye­leng­gara LPBBTI syariah. Adapun beberapa hak pengguna layanan diatur sebagai bentuk per­lindungan hukum. Namun di sisi lain, POJK No. 10 Tahun 2022 tidak menyediakan alternatif penyelesaian sengketa di luar pengadilan. Aturan yang terdapat dalam POJK No. 10 Tahun 2022 bersifat teknis dan hanya mengatur penyelenggara LPBBTI syariah yang resmi, sehingga tidak mencakup penyelenggara LPBBTI ilegal.

Abstract

With the exponential rise in crowdfunding, several pertinent issues have come to the fore. These include unauthorized access to personal data, exorbitant interest rates for funding recipients, and investor fund security concerns. Other issues, such as aggressive debt collection practices and misuse of donated funds, also warrant attention. The underdeveloped state of crowdfunding regulations in Indonesia, which offers insufficient legal certainty and protection, is often blamed for these issues. Thus, a thorough examination of the legal and regulatory framework governing crowdfunding in Indonesia is crucial. This study scrutinizes the legal norms, identifies, and harmonizes the diverse regulations applicable to crowdfunding in Indonesia. The findings underscore the necessity for enhancements in the laws and regulations pertinent to crowdfunding. Key areas of focus should include establishing a legal status for crowdfunding platforms, setting fair interest rates, fortifying investor fund security mechanisms, penalizing illegal crowdfunding activities, and intensifying oversight of fund usage in donation-based crowdfunding schemes. Equally crucial is the imposition of penalties for regulatory breaches in crowdfunding, reflecting a genuine commitment towards ensuring justice and legal certainty in all crowdfunding transactions.

Abstract

This study aims to analyze the application of the murabaha contract in the BTN Syariah Margonda Home Ownership Credit (KPR) product from the perspective of Islamic law. In the face of increasing demand for usury-free housing, BTN Syariah offers a solution through the murabaha contract, which guarantees home financing without involving the element of interest. Through cooperation with PT ABC Group, BTN Syariah Margonda provides a more transparent and fair financing alternative for the community. This research method uses a normative-empirical approach with interviews, observations, and documentation studies. The results show that the application of the Murabaha contract at BTN Syariah Margonda is in accordance with Sharia principles, where the profit margin is determined from the start, and the installments are fixed throughout the payment period. However, the main challenge is the need for a more public understanding of the differences between sharia and conventional mortgages. Nevertheless, the murabaha contract provides a positive impact in the form of financial certainty for customers and supports stable financial planning without being trapped in usury practices. This research also identifies the need to increase public education on the advantages of Sharia-based financing and the importance of the role of property developers who fully implement Sharia principles.

Abstract

A gift is a voluntary agreement without compensation, either to heirs or other people. However, its implementation will have an impact on conflict when the grantor suffers from illness. Of course, this has different legal implications than for healthy people. This study focuses on the opinions of Wahbah Al-Zuhaili and KHES. This research method uses library research, which is qualitatively analytical through a historical approach and a statute approach. The data analysis method uses the fiqh muqaran approach. The results of the research show that first, the law of giving sick people maqasid Shariah values is found in the following aspects: protecting religion, protecting the soul, protecting the mind, protecting property, and protecting offspring. Second, Wahbah al-Zuhaili classified illness conditions as serious illness and non-severe illness. Conditions of serious illness that cause death before one year has passed, the law applies to people who are seriously ill and cause death. Meanwhile, for illnesses that are not serious or do not cause death, the grantor may commit with the recipient to pay for life until death, as stated in Article 454 paragraph 2. Third, KHES specifically includes grants for seriously ill people in articles 724–727.

Abstract

Sharia Securities-Based Crowdfunding (Sharia SBC) has significant potential in supporting the development of halal MSMEs in Indonesia. Halal MSMEs often face limited access to conventional financing The presence of Sharia SBC, based on information technology, can serve as an alternative source of funding in accordance with Sharia principles for halal MSMEs. This study aims to examine the regulations governing Sharia SBC and its impact on the development of halal MSMEs. The research method used is a qualitative approach with descriptive analysis. Data is collected from secondary sources such as literature studies, and analysis of regulatory documents. The results indicate that mature and comprehensive regulations are crucial to support the success of Sharia SBC. Existing regulations, such as the Financial Services Authority Regulation Number 57 of 2020 amended by OJK Regulation No. 16/POJK.04/2021 of 2021 provide a basic framework for the operation of Sharia SBCs. However, challenges persist, including the lack of Sharia financial literacy among MSMEs and investors, as well as the need to enhance technological infrastructure and accessibility of the SBC platform. Properly regulated, Sharia SBCs can enhance halal MSMEs' access to capital, thereby boosting their business growth and sustainability. Optimizing regulations and improving education and infrastructure are essential to maximizing the potential of Sharia SBC in supporting the development of halal MSMEs in Indonesia.
