Abstract

Kebakaran hutan dan lahan di Indonesia menjadi bencana tahunan yang menyebabkan Indonesia kehilangan keanekaragaman hayati, emisi karbon dan mengurangi nilai ekonomi hutan dan lahan. Agar lingkungan dapat dinikmati oleh generasi mendatang, hutan dan lahan yang rusak harus. Pembangunan yang dilakukan saat ini harus dapat dinikmati oleh generasi manusia saat ini tanpa mengurangi potensi generasi mendatang. Penelitian ini bertujuan untuk mengetahui perbaikan lingkungan hidup akibat kejahatan kebakaran hutan dan lahan oleh korporasi sebagai upaya pembangunan berkelanjutan. Penelitian ini menggunakan metode penelitian hukum doktrinal, dan menggunakan dua metode yaitu: Statute Aprroach dan Conceptual Appoach. Statuta Aprroach memeriksa berbagai hukum dan peraturan yang berkaitan dengan lingkungan. Sedangkan Appocach Copceptual berangkat dari pendapat atau pandangan yang berkembang dalam ilmu hukum, terutama yang membahas lingkungan. Perbaikan lingkungan hidup sebagai akibat tindak pidana kebakaran hutan dan lahan oleh korporasi sebagai upaya pembangunan berkelanjutan dapat dilakukan dengan penerapan Pasal 119 huruf c UU 32/2009. Sanksi pidana tambahan tersebut dapat dijatuhkan kepada korporasi untuk memulihkam fungsi lingkungan hidup, dengan diimplemetasikan sanksi pidana tersebut pada korporasi yang melakukan tindak pidana dapat mendukung pembangunan berkelanjutan agar pembangunan di masa sekarang tidak merusak lingkungan dan dapat dinikmati oleh generasi yang akan datang.

Abstract

Pandemi melanda hampir sebagian besar negara di dunia, lebih dari 1 tahun sejak pertama kali virus Corona ditemukan menginfeksi manusia. Para ilmuwan mencoba untuk membuat vaksin sebagai upaya menghentikan penyebaran virus corona. Pemerintah Indonesia sudah memastikan keamanan dan keefektifan vaksin. Pengadaan vaksin Covid-19 di Indonesia melalui beberapa jenis yaitu Sinovac, AstraZeneca dan Sinopharm. Program vaksinasi dilakukan menggunakan data kependudukan sebagai sumber data utama. Hal tersebut dapat menimbulkan banyak sekali potensi permasalahan. Selain itu, pemberian vaksin kadang tidak sesuai dengan kondisi riil di masyarakat. Tujuan kegiatan ini guna mencari solusi yang dapat digunakan untuk menyelesaikan permasalahan tersebut dengan melakukan kerjasama dengan karang taruna desa agar memaksimalkan potensi sosial kemasyarakatan guna mendata masyarakat sesuai dengan keadaan di lapangan. Artinya bahwa penyediaan data yang terupdate secara periodik dapat mendukung keselarasan pendataan vaksin di masyarakat. Luaran wajib yang disesuaikan dengan skema pengabdian berupa publikasi, pengabdian di jurnal ber-ISSN, publikasi kegiatan pengabdian di media massa online, publikasi pengabdian berupa vidio. Kegiatan pengabdian yang telah dilakukan dengan pengamatan langsung dan koordinasi dengan ketua RT 04 Desa Giritirto Kabupaten Wonogiri dan Ketua Karang Taruna mengenai verifikasi daftar penerima vaksin berdasarkan data kependudukan. Finalisasi dari kegiatan pengabdian ini adalah dengan menyusun laporan pelaksanaan dan luaran pengabdian.

Abstract

In the future, the child plays an important role in shaping the history, country and way of life of a country. In other words, children are the next generation of the nation. However, the potential for criminal behavior is also inherent in children. One of them is through theft. The factors that underlie children committing theft include family, environment, and even self. This study aims to determine and examine the factors that cause children to commit theft, as well as the efforts made to prevent this occurrence and law enforcement. This legal research uses descriptive analysis techniques by combining sociological or empirical approaches. Based on the results of the study, the main factors that encourage young people to commit theft in the Ngawi region are family, education, and economic factors. Poor education, weak economy, and a less harmonious family environment due to family conditions that are no longer intact due to divorce or death of parents, become additional factors in themselves. As a result, children lose positive role models on how to live their lives. To overcome this, efforts are needed to handle it as early as possible with various approaches and patterns of prevention, repressive, and curative handling.

Abstract

E-Filing is a service for sending or submitting Annual Tax Returns (SPT) electronically for individuals or entities (Companies or Organizations) to the Directorate General of Taxes via online and real time internet communication channels which are referred to as ASP (Application Service Provider or Service Provider Application). By utilizing this technology, Taxpayers (WP) no longer need to print all report forms and wait for receipts manually. Therefore, this research aims to determine the implementation of E-Filing in terms of the principle of legal certainty and its impact on society. This research uses a qualitative approach that is in accordance with the concept and scope of the problem. The data and information needed are taken from facts and events that have occurred. The results of the research are first, research shows that the use of E-Filing in SPT reporting in Indonesia has adequate legal certainty. This is because the mechanism and implementation have been regulated in the Decree of the Director General of Taxes. The E-Filing concept also provides significant benefits for Taxpayers, such as faster, more cost-effective and efficient reporting. Second, the impact felt by society. Taxpayers are happy with the E-Filing system design which is neat and easy to understand, so that it can increase tax compliance in submitting Annual Tax Returns. Thus, the use of E-Filing in SPT reporting is expected to improve tax compliance and improve tax performance in Indonesia.

Abstract

Political parties are often in the spotlight because of the corrupt behavior of their members with the aim of party interests. The forms of criminal acts of corruption by cadres or political party administrators have various modes, including bribery, buying and selling positions, extorting strategic sectors, harming state finances, abuse of authority and misuse of budgets in development programs. Although there are many cases where political parties are suspected of being in the vortex of enjoying the proceeds of criminal acts of corruption, until now criminal responsibility is still borne by individuals, whether cadres or administrators of political parties. This study aims to provide an overview of the criminal liability arrangements of political parties in corruption in Indonesia and to conduct a comparative study of the accountability of political parties in Indonesia and South Korea. The research method used is non-doctrinal by taking secondary data sources with legal, conceptual and grammatical approaches. The results show that Indonesia still includes political parties as corporations, however, political parties in Indonesia are legal entities that cannot be held criminally responsible. South Korea is an example of a country that regulates criminal acts of political parties through their respective laws. In general, South Korea imposes criminal responsibility on persons or administrators of party members, not on the party itself.

Abstract

Background: The dissemination of intimate content without consent, commonly known as revenge porn, has emerged as a serious form of cybersexual violence in the digital era. The perpetrators often use social media platforms to spread such content as a form of retaliation. This issue poses significant psychological, emotional, and social harm to victims, exacerbated by the lack of specific legal safeguards in Indonesia. Aims: This study seeks to explore the urgency of legal protection for individuals affected by revenge porn and assess the extent to which current Indonesian legislation provides such protection. Methods: Using a normative-empirical legal research method with both descriptive and futuristic approaches, this study collected data through literature analysis and interviews with law enforcement and victim support organizations. The data were analyzed through qualitative interpretation. Result: The study found that legal mechanisms to support victims of revenge porn are still highly inadequate. Existing laws, such as the Pornography Law and the Electronic Information and Transactions Law, lack specific provisions and may even criminalize the victims. Although institutions like the Witness and Victim Protection Agency (LPSK) exist, access to protection is limited and dependent on formal requests. Additionally, personal data protection remains underregulated. Conclusion: There is a pressing need for a more inclusive legal framework that offers specific protection for victims of digital sexual violence. The development and enactment of new legal instruments, such as the Sexual Violence Eradication Bill and the Personal Data Protection Bill, are essential to ensure justice and restore dignity for those affected by revenge porn.

Abstract

This study analyzes the idea and implementation of the Land Bank in Indonesia, comparing it with similar systems in other nations, especially the United States. This study aims to examine the Land Bank policy in Indonesia, juxtapose its frameworks with those in the United States, and formulate an optimal Land Bank concept suitable for implementation in Indonesia. This study employs a normative juridical methodology using comparative legal and philosophical methods. The findings indicate that although the Land Bank in Indonesia has the same aims as its counterpart in the United States, namely land management for public benefit, there are considerable disparities in operational and regulatory methodologies. In Indonesia, the Land Bank is mostly centralized and oriented towards social concerns, but in the United States, it is more decentralized and operates as a financial entity. The optimal framework for a Land Bank in Indonesia must emphasize justice, openness, and sustainability, while enhancing the function of Notary/PPAT and improving the integration of land information systems. This study underscores the significance of cooperation among the government, corporate sector, and communities to establish an efficient and sustainable Land Bank in Indonesia.

Abstract

The non-procedural placement of Indonesian Migrant Workers (PMI) remains a serious issue because it has the potential to result in exploitation, violence, and the crime of trafficking in persons. Such practices are generally carried out through illegal recruitment, the use of forged documents, and the deployment of migrant workers without complying with applicable legal procedures. This study aims to analyze the regulation of Indonesian positive law concerning the criminal offense of non-procedural placement of PMI and to examine the construction of criminal liability of its perpetrators from the perspectives of criminal law and trafficking in persons. This research employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that the regulation of non-procedural placement of PMI is governed by Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers and is closely related to Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons. Criminal liability may be imposed where the elements of criminal responsibility, fault, and the absence of grounds for the exclusion of criminal liability are fulfilled. Furthermore, where elements of exploitation, fraud, or abuse of the victim’s vulnerable position are present, perpetrators may also be prosecuted under the Anti-Trafficking Law. Therefore, the complementary application of both laws is necessary to ensure optimal legal protection for Indonesian Migrant Workers.

Abstract

This study examines and examines related issues, first, the considerations of judges in handling criminal acts of assault committed by members of the Indonesian National Armed Forces against their subordinates. Second, it examines criminal liability for criminal acts of assault committed by members of the Indonesian National Armed Forces against their subordinates. This study uses normative legal research methods that are both prescriptive and applied, with a statutory approach, a case approach, the criminal liability approach in the Criminal Code (KUHP), and a conceptual approach. The data collection technique used was a literature study, with research instruments consisting of court decisions, laws and regulations, and scientific literature. Furthermore, the analytical technique used was a deductive method. This study concludes that, first, judges should not only consider criminal liability for the direct perpetrator but also assess the possibility of criminal liability for the commander under Articles 129 and 132 of the Criminal Code. The existence of a command relationship between the perpetrator and the commander, the commander's knowledge of the violence that occurred, and indications of failure to carry out their supervisory, development, and prevention functions towards subordinates are relevant grounds for applying command liability. Second, criminal liability in the military environment still focuses on the direct perpetrator (direct perpetrator liability) as regulated in the Criminal Code, because the concept of command responsibility has not been explicitly regulated in the Indonesian military criminal law system.
