Abstract

Abstract: This research aims to clarify the reality of the Islamic Caliphate in light of the Sunnah of the Prophet. It also aims to know the truth of Hizbut-Tahrir, its opinions and efforts in establishing the Islamic Caliphate, so that the aspects of agreement and disagreement become clear. In writing this research, the researcher follows the analytical method, in that it relies on library sources and references instead of data taken from the applied study in society. Among the most important findings of the researcher is: The consensus of the majority of scholars - including Al-Nawawi - and Hizbut-Tahrir that the Islamic Caliphate is its goal is to manage religious affairs and organize worldly matters, and their disagreement over the appointment of the caliph and the conditions for its convening.

Abstract

Abstract

لقد أخرج الفكر الإسلامي لنا العديد من المدارس الفكرية والعلمية التي حوت بداخلها العديد من الشخصيات في شتى المجالات العلمية. ويعد السعدي والصابوني من أهم هذه الشخصيات في مجال التفسير، ويعد تفسيرهما موسوعة علمية جديرة بالدراسة والبحث لما فيهما من درر وفوائد علمية. يعمد هذا البحث الكشف عن الدلالة العقلية والاستدلال بها في تفسيري السعدي والصابوني بهدف إبراز مكانة العقل عندهما, وإبراز دور تفسيرهما في توضيح معاني القرآنية، ومدى ارتباط هذا الفن بالعلوم الأخرى ، وذلك من خلال عرض نماذج تقوم بتحليل السياقات التي تناولا فيها هذا المفهوم مع عقد المقارنة بينهما. وقد سار البحث على المنهج الوصفي التحليلي لإبراز الجوانب المعتمدة في الاستدلال بالعقل عند الشيخين المذكورين ، ومن أهم نتائج هذا البحث أن تفسير السعدي مبني على التفسير بالرأي المحمود، بخلاف الصابوني فإنه يعتمد على النصوص الشرعية خصوصا في شرح الآيات،كما يمتاز تفسير السعدي على الصابوني من حيث التركيز على فك المعاني بطريقة سهلة يفهمها كل من عرف العربية أي أنه يعتني بالمعنى أولا، بخلاف الصابوني حيث اعتمد على الظواهر اللغوية والبلاغية، وهذا زاد لتفسير الصابوني روعة على تفسير السعدي.

Abstract

This article seeks to analyze and focus on institutional Salafism, also referred to as Wahhabism. The term "Salafism" was not associated with Wahhabi doctrine until the 1970s. It is said that in the early 20th century, Wahhabis began calling themselves Salafis. In contemporary academic discussions, the terms "Salafism" and "Wahhabism" are sometimes used interchangeably. Using a library-based research method, this article concludes that not all Salafis hastily declare others as infidels, including the Wahhabis. They distinguish between apparent issues and hidden issues in the matter of individual takfir (excommunication). They hold that anyone who falls into acts of apparent polytheism, after the evidence from the Quran and Sunnah has been presented to them, is individually excommunicated. However, in hidden matters, a person is not declared an infidel unless their doubts have been entirely dispelled.

Abstract

The topic of interfaith relations has become a global discourse and has attracted the attention of many academics, especially regarding the relationship between Muslims and non-Muslims, specifically Jews in this study. Judaism has a long history with Muslims. The fluctuations in relations between the two parties have continued to occur, reaching their peak in the possession of land in Palestine in this modern era. The purpose of this study is to determine the image of Islamic relations in dealing with Jews based on the books of Sahih al-Bukhari and Sahih Muslim, as well as their contemporary context. The method used for data collection is the library research method. The data analysis technique employed in this study involved descriptive, analytical, and inductive approaches. The research findings indicate that there are 47 hadith topics in the Sahihayn that mention the words "Judaism," "Qurayza," "Qaynuqa'," and "Nadir." However, only 29 of these hadiths describe interactions between Muslims and Jews. In the Sahihayn, the forms of interaction between Muslims and Jews include cooperation, competition, and conflict. Examples of cooperative interactions include the hadith about the Jews of Khaybar working on the land, the Prophet pledging his armor to a Jew, and Ali ibn Abi Talib making a dowry ring for Fatimah from a Jew of Banu Qaynuqa'.

Abstract

The initiation of the minority fiqh concept for Muslims in countries with a non-Muslim majority is like a coin with two sides. On one side, it is seen as a threat to the established schools with their structured and well-defined methodologies, as it is often suspected of involving talfīq—combining opinions from various schools by selecting the most lenient fatwas. On the other hand, this concept represents an intellectual innovation aimed at helping minority Muslims remain committed to the principles of sharia amid a reality that does not fully support their religious practices. This paper critically investigates whether Qaraḍāwī adheres to a consistent methodology he designed, specifically whether he remains faithful to the principles he espouses or deviates by selectively borrowing opinions across schools. Taking some of his fatwas contained in his book entitled Fī Fiqh al-Aqalliyyāt al-Muslimah as the main object, this study argues that Qaraḍāwī, although, does talfīq in his fatwa by borrowing opinions from several ulama or schools, he consistently adheres to the methodology he established. This approach offers a legal framework that is accommodative yet rich in pragmatic nuances, resulting from a consistent synthesis of various opinions. Furthermore, on a broader scale, this concept provides a framework that balances flexibility with orthodoxy.AbstrakInisiasi gagasan fikih minoritas bagi umat Muslim di negara-negara dengan mayoritas non-Muslim ibarat koin dengan dua sisi. Di satu sisi, konsep ini dianggap sebagai ancaman bagi mazhab-mazhab yang memiliki struktur dan metodologi yang sudah mapan, karena kerap kali dicurigai mengandung unsur talfīq —menggabungkan pendapat dari berbagai mazhab dengan memilih fatwa yang paling ringan. Namun, di sisi lain, gagasan ini merupakan inovasi intelektual yang berupaya menjembatani Muslim minoritas agar tetap dapat berkomitmen pada prinsip-prinsip syariah di tengah realitas yang tidak sepenuhnya mendukung praktik keagamaan mereka. Tulisan ini bertujuan untuk mengkaji secara kritis apakah Qaraḍāwī konsisten dalam menerapkan metodologi yang ia rumuskan sendiri, khususnya apakah ia tetap berpegang pada prinsip-prinsip fikih minoritasnya atau justru hanya mengambil dan meminjam pendapat dari berbagai mazhab. Dengan mengambil beberapa fatwa yang terdapat dalam bukunya, Fī Fiqh al-Aqalliyyāt al-Muslimah, sebagai objek utama, artikel ini menunjukkan bahwa meskipun Qaraḍāwī melakukan talfīq dengan meminjam pendapat dari berbagai ulama atau madzhab, dia tetap berpegang pada metodologi yang ia bangun. Pendekatan ini menawarkan panduan hukum yang akomodatif namun juga penuh dengan nuansa pragmatis sebagai hasil dari sintesis berbagai pendapat yang dilakukan secara konsisten. Selain itu, dalam lingkup yang lebih luas, konsep ini menawarkan sebuah kerangka yang dapat menyeimbangkan antara fleksibilitas dengan ortodoksi.

Abstract

During his second term, President Joko Widodo took decisive action by dissolving two prominent Islamist organizations in Indonesia, Hizbut Tahrir Indonesia (HTI) and the Islamic Defenders Front (FPI). This study explores how the Indonesian government has sought to strengthen its position and gain the trust of nationalist and moderate Islamic factions through anti-Islamist policies. By utilizing Islam as a political tool, the administration has fostered nationalism while suppressing Islamist and conservative movements. Employing a case study and fiqh siyasah conceptual approach and analyzing secondary data from books, journals, and media, this research examines three key questions: how Indonesian presidents have historically interpreted Islamism, how identity has been used to fuel animosity between Islamists and Jokowi’s administration, and the impact of dissolving Islamic organizations on Indonesia's democratic future. The findings reveal that religion has been exploited for political purposes, posing a threat to freedom of expression and assembly in a democracy, while Jokowi’s administration has strategically used Islamism to consolidate its power and public trust. This matter, in fact, gains legitimacy from the political jurisprudence that the Islamic group seeks to promote.

Abstract

This article explores the concept of moderation held by the State through the program run by the Ministry of Religious Affairs named Moderasi Beragama (Religious Moderation). The discussion consists of religious moderation throughout history of Indonesia, highlighted it as a moderate approach supported and organised by the state, including its strategies and challenges. This qualitative research uses content analysis as an analytical method of collecting data from primary and secondary sources. The study showed that Religious Moderation was campaigned by the State through several programs, strategies and a similar proposed agenda started even from the New Order era to the disruption era. Constructed by the multi-religious theological concept of moderation and strengthened by the State constitutional basis, the program met challenges that should develop some strategies to implement religious moderation effectively and efficiently. Although radicalism has not been completely eradicated, at least the state has committed to fostering religious harmony and moderation through inclusive state policies and collaborative efforts with various religious and community stakeholders.
