Abstract

This research aims to discuss the chronology of criminal acts of environmental pollution of ditches by PT Kalimantan Ferro Industry regarding the impact of environmental damage and the corporate accountability mechanism of PT Kalimantan Ferro Industry to resolve cases of ditch pollution in the surrounding environment. This research uses a normative juridical method sourced from secondary data. The research compares Law No. 32 of 2009 concerning Environmental Protection and Management with Article 88 of the Job Creation Law in Corporations, which eliminates absolute responsibility for corporate violations to protect the environment. The author analyzed the environmental problems caused by PT KFI's waste water management installation and the accountability mechanism for this case based on the perspective of the Job Creation Law in Corporations, which is known to have changed the rules regarding absolute responsibility for corporations. The results of this research show that corporate responsibility for waste pollution is now limited to administrative-level responsibility after the abolition of absolute responsibility.

Abstract

Terrorism is increasingly attracting public attention, especially with the existence of action of world terrorism that have occurred in several countries, one of which is the United States where the destruction of the twin towers on 9/11 occurred and became the forerunner of terrorist acts in Indonesia. To deal with the issue of national security, building awareness of national defense is one solution that can be done to anticipate terrorist acts occurring in the future. This article discusses the urgency of the Indonesian government to increase awareness of national defense and national defense in overcoming the problem of terrorist acts. The research approach method uses a normative juridical method with a legislative approach and a conceptual approach to examine the problem of terrorist acts in Indonesia. The data source for writing this article comes from a literature study whose sources come from books, papers, and journals related to the law on eradicating terrorism. In making this article, the author discusses how the ideality of handling terror acts in Indonesia over the collapse of the twin towers of 9/11 in the United States and the Dr. Azhari bomb case is connected to the improvement of the defense nation of the Republic Indonesia. The results of this study explain that through increasing awareness of defending the country and national defense, society can be more prepared and able to face the threat of terrorism and build a stronger and more stable Indonesia.

Abstract

Sehubungan dengan berlangsungnya tahapan kontestasi Pemilu 2024 di Indonesia, saat ini tingkat kesadaran bela negara warga negara Indonesia mulai luntur sehingga muncul sikap fanatisme yang negatif maupun kelompok masyarakat yang terkotak – kotak. Munculnya fanatisme yang berlebihan dari rakyat Indonesia ini maka menimbulkan banyak konflik baru seperti maraknya berita hoax, politik adu domba, kampanye fiktif, kampanye hitam, pencemaran terhadap nama baik seseorang, ujaran kebencian, hingga politik SARA yang sangat mengganggu ketertiban masyarakat Indonesia. Oleh karena itu, penelitian ini akan membahas pola tingkah laku warga negara Indonesia untuk menghadapi Pemilu 2024, serta mengkaji apa saja upaya pemerintah Indonesia bersikap terhadap lunturnya semangat bela negara Indonesia dalam menghadapi Pemilu 2024. Metode penelitian yang digunakan penulis adalah metode yuridis normatif yakni dengan cara mengumpulkan berbagai data informasi dari data sekunder, seperti buku, produk hukum undang - undang, e-book, jurnal ilmiah, dan penelitian terdahulu. Dengan adanya berbagai upaya pemerintah Indonesia untuk meningkatkan serta menjaga semangat bela negara rakyat Indonesia dalam ikut pemilihan umum 2024, diharapkan Pemilu 2024 bisa menghasilkan pemimpin yang terpilih berperilaku integritas kebangsaan bela negara yang tinggi berdasarkan dengan kepuasan mayoritas pemilihnya.

Abstract

  In relation to the ongoing stages of the 2024 General Election contestation in Indonesia, the level of national defense awareness among Indonesian citizens has begun to fade, resulting in negative fanaticism and fragmented community groups. The emergence of excessive fanaticism among the Indonesian people has led to many new conflicts, such as the proliferation of hoax news, divisive politics, fictitious campaigns, black campaigns, defamation, hate speech, and SARA-based politics (ethnicity, religion, race, and intergroup relations), which seriously disrupt the public order of Indonesian society. Therefore, this research will discuss the behavioral patterns of Indonesian citizens in facing the 2024 General Election, as well as examine the Indonesian government's efforts to address the declining spirit of national defense in confronting the 2024 General Election. The research method used by the author is a normative juridical method, which involves collecting various data information from secondary sources, such as books, legal products and legislation, e-books, scientific journals, and previous research. With the various efforts of the Indonesian government to enhance and maintain the spirit of national defense among the Indonesian people in participating in the 2024 General Election, it is expected that the 2024 General Election will produce elected leaders who demonstrate high national integrity and national defense behavior based on the satisfaction of the majority of their constituents.
