Abstract

Hibah merupakan salah satu bentuk peralihan hak atas tanah kepada pihak lain yang biasanya dilakukan ketika pemberi maupun penerima masih hidup. Permasalahan dalam penelitian ini adalah akibat hukum yang timbul akibat pembatalan hibah atas sebidang tanah terkait pemberi hibah yang ditelantarkan oleh anak selaku penerima hibah menurut Hukum Perdata ? dan perlindungan hukum bagi pemberi hibah hak atas sebidang tanah terkait pemberi hibah yang ditelantarkan oleh anak selakuĀ  penerima hibah menurut hukum perdata ? Teori Hukum yang digunakan Teori Akibat Hukum menurut R.Soeroso dan Teori Perlindungan Hukum menurut Satjipto Rahardjo. Dari Hasil penelitian ini memberi kesimpulan yang membatalkan sertipikat hak atas tanah yang diterima oleh penerima hibah (tergugat) dikarenakan menelantarkan pemberi hibah(penggugat), yang dimana Pasal 1688 ayat 3 menegaskan bahwa jika penerima hibah menelantarkan maka hibah itu batal demi hukum dan di perjelas dalam putusan pengadilan negeri yang menjadi dasar acuan pembatalan sertipikat hak atas tanah dan akta hibah.

Abstract

This study aims to explore the supervision of judges from the perspective of the Pancasila philosophy and identify its implementation in Indonesian judicial institutions. The Pancasila philosophy is seen as a moral and ethical foundation that guides the behavior of judges in carrying out their duties. This research is library research with the meaning of judge supervision as the material object and Pancasila philosophy as the formal object. Research findings show that in the context of Pancasila, supervision of judges is not only legal, but also moral and ethical. The success of judges' supervision is reflected in the ability of judicial institutions to respect Pancasila values, such as justice, legal certainty, and balance between rights and obligations. The implementation of supervision of judges in Indonesia is realized through various mechanisms, such as the Honorary Council of Judges, the Honorary Court of Supreme Judges, and the Honorary Court of the Regional Representative Council. This study contributes to illustrating the relationship between the Pancasila philosophy and the practice of supervising judges in Indonesia, as well as offering an in-depth understanding of the challenges and potential improvements in implementing judicial supervision. The implications of this research can provide a basis for policy reform and improvement of the judge supervision system to strengthen the integrity and effectiveness of judicial institutions in Indonesia.

Abstract

The purpose of this study is to find out reform of the law on the division of joint property divorce. 50-fifty provisions regarding the sharing of joint assets are often applied rigidly in accordance with the provisions of Article 97 of the KHI. The resulting output does not provide a sense of justice to the parties. This research is normative law with a substantive analysis approach to the provisions of Article 97 of the KHI. The results showed that the sharing of joint assets was regulating (regelen) not coercive (dwingon). In certain cases, this provision can be deviated by contextualizing it through the maqashid sharia approach to the substance of the case. The amount of the contribution of either party to the acquisition of joint assets and commitment to the sacred promise of marriage is a modifying element ('illat) in the case of sharing of joint assets. Maqashid shari'ah as an instrument in law making (istinbath) plays a very large role in this case, especially if the case presented is closely related to distributive justice where the elements of benefit and the purpose of the law are the main benchmark in seeking justice. Contextual reasoning and a substantive approach to the purpose of article 97 KHI by prioritizing psychological and contributive aspects to the case of division of joint property will make the article flexible. In the event that the role of one party is greater in the acquisition of joint property and there is an attitude of inconsistency of one party towards marital commitment, it becomes a ratio legis of reduced share of joint property of the former husband and wife.
