Abstract

Constitutional Court Decision No. 36 / PUU-X / 20012 regarding Testing Act No. 22 of 2001 on Oil and Gas lead the Executive Agency for Upstream Oil and Gas (BP Migas) dissolved. BP Migas declared contrary to the Constitution, specifically Article 33 UUD 1945 because its presence causes the state to lose the right to control oil and gas resources. To provide certainty in the operation of upstream oil and gas after the dissolution of BP Migas, the President issued Presidential Decree No. 9 of 2013, which it formed a surrogate agency BP Migas, the Special Unit of Upstream Oil and Gas (SKK Migas). The subject matter which analyzed these include the existence of SKKMigas that replaces the duties and functions of BP Migas when the review of the Constitutional Court Decision No. 36 / PUU-X / 2012, and how should form upstream oil and gas management arrangement that takes into account the role of state enterprises. The results of this study can be concluded that the existence of SKK Migas is basically the same as BP Migas which has been dissolved. This happens because SKK Migas given the same functions with the task of which is owned by BP Migas. The establishment of SKK Migas to take over the management of upstream oil and gas indicate there are no fundamental changes in the system of management of oil and gas resources after the Constitutional Court Decision No. 36 / PUU-X / 2012, the changes in question are related to the state control over the natural resources of oil and gas. To build energy independence, there must be a concern of the government at the State Company (National Oil Company, NOC).

Abstract

This research’s title is Grant of Joint Property to Children Through Private Deed (Analysis of Decision Number 287 PDT.G/2022/PA/MDO). The object of this research is Derden Verzet (Third Party Resistance) case Number 287Pdt.G/2022/PA/Mdo at the Manado Religious Court, Indonesia. The objective of this research is to analyze whether joint property that has been donated through a private deed remain joint property or the child's personal property and the strength of the evidence of a private deed in granting joint property to a child at the Manado Religious Court. This study uses a normative juridical legal research type with a statute approach and a case approach. The results of the study show that in the Manado Religious Court Decision Number 287Pdt.G/2022/PA/Mdo, the Judge confirmed that joint assets that have been donated to children through a private agreement are still recognized as valid, thus the joint assets that have been donated are no longer included in joint assets but rather the property of the children as recipients of the grant. The private deed of grant of joint assets from the Defendants to the Opponents has the power of proof because it is recognized as signed by Defendant II as the party who signed it.

Abstract

This study analyzes the role of SPIP, the internal control of Indonesia, within the broader framework of Public Financial Management (PFM) and how it influences the appropriation of health budgets to achieve Sustainable Development Goal 3 (SDG 3). In contrast to previous studies, which have predominantly focused on the coverage of health budgets, SPIP emerges, theoretically, as a moderating variable intervening between the relationship between expenditure on health and health results. Using JKN coverage, Indonesia's National Health Insurance program and chief tool for pursuing universal coverage for health, for tracking the realization of SDG 3, a dataset of 538 municipalities for a period of five years, from 2018 until 2022 (2,690 observations), the study conducts Moderated Regression Analysis using Generalized Least Squares, considering heteroscedasticity, as well as autocorrelation, for estimation. While the results confirm that a greater appropriation of the health budget promotes the success of JKN, whose impact is significantly boosted by SPIP due to the enhancement of transparency, accountability, and due utilization of the budget, evidence exists that points towards a strong internal control, when complemented with effective management of the budget, facilitating a catalyst towards SDG 3 realization. Furthermore, it provides impetus towards another motivation for policymakers to increase sustainability, along with greater inclusivity, for health developmental efforts, strengthen strategies for health budgeting, and realize SPIP implementation strategies.

Abstract

The role of the fisheries sector is very large in Morotai Island Regencymust be utilized as much as possible for the prosperity of society. So far, many fishery products have been stolen by foreign fishing boats. By opening up investment for fishing companies, diversifying the utilization and processing of marine products as well as providing assistance to local fish entrepreneurs and providing fishing gear assistance to fishermen is one of the solutions for the development of the fisheries sector in South Halmahera Regency which can be planned for the future.The research method used in this study is the normative legal research method as material to initiate researchers in carrying out an inventory of statutory approaches (statute approach), comparative law (comparative approach), and case studies (case approach). The characteristics of this study fully use secondary data, consisting of primary legal materials; secondary legal materials; as well as tertiary legal materials. The results of the research show that in practice, the development of maritime potential in South Halmahera Regency experiences various challenges and opportunities. Efforts to deal with these obstacles include moderating stakeholders to analyze and describe what is best for the development of maritime potential in South Halmahera Regency, North Maluku Province. It is very important to equate perceptions and common interests so that the policies that are being implemented can run well until the end. Carrying out bureaucratic reform by summarizing the administrative system, including mobile bureaucratic services, both at sea and on land by using boats/ships that are connected to services and the internet so that it makes service easier for the community. Next is to open up investment opportunities as wide as possible so that investment can come easily to the Bintan Regency area. With easy investment into then indirectly. will improve the economy of the people in South Halmahera Regency itself.The capital aspect can be overcome by providing financial assistance to fishermen. It can be in the form of distributing people's business credit, direct investment, CSR of large companies, or through fishing cooperatives where the government provides the widest possible capital assistance in the form of capital equipment and operational equipment such as boats, boat engines, nets, bait, navigational equipment, environmentally friendly technology, fuel, and processing plants and fish auctions which result in destructive fishing.

Abstract

The degradation of polymer is known, but the effect of CNT composite is the less studied concept. In this article, the effect of CNT on degradation is presented. The first stage involved a literature study for reaction mechanisms in oxidative thermal degradation of Polypropylene (PP). A reaction model is then developed by considering mass balance on various reactive species. Literature is reviewed to find or estimate the model parameters. The parameters not found in the literature are fitted. The model equations are solved after assuming initial conditions and values of various parameters. After the PP polymer degradation modeling comparison drown between PP and PP/MWCNT composite by making a hypothesis based on Arrhenius equations (activation energy increases, the rate constant decreases, and therefore the rate of reaction decreases). The result shows that the CNT composite takes much time to degrade as compared to the polymer.

Abstract

Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja telah membuka ruang bagi pelaku Usaha Mikro Kecil (UMK) untuk bisa mendaftarkan badan usahanya menjadi perseroan terbatas. Meskipun sudah ada aturan hukum yang mengaturnya, namun saat ini masih banyak pelaku usaha UMK di Kota Ternate di Kelurahan Makassar Timur yang belum mendaftarkan badan usahanya karena belum mengetahui aspek hukum tentang pendirian perseroan perorangan. Solusi yang ditawarkan melalui kegiatan Pengabdian Kepada Masyarakat ini adalah dengan melakukan penyampaian materi kepada Pelaku Usaha UMK mengenai aspek hukum tentang pendirian perseroan perorangan. Metode pendekatan yang digunakan adalah dengan metode ceramah dan tanya jawab. Adapun target luaran kegiatan Pengabdian Kepada Masyarakat ini adalah terlaksananya kegiatan penyuluhan hukum kepada kepada Pelaku Usaha UMK di Kelurahan Makassar Timur Kota Ternate, dan hasil dari kegiatan ini dapat terpublikasi melalui jurnal pengabdian masyarakat.
