Abstract

Marriage in Islam is a sacred and strong bond that aims to maintain self-respect and create a harmonious family life. Islam pays great attention to preserving marriage and preventing rifts that can destroy family harmony. However, in conditions that cannot be maintained, Islam regulates a way out through divorce with wise provisions, including the requirement for witnesses. There are differences of opinion among scholars regarding the requirement of witnesses in divorce. Some scholars do not require witnesses in divorce, while others consider it mandatory. This article examines the background of these differences of opinion and then provides an analysis using the ushul fiqh and maqashid sharia approaches. This approach focuses on a deep understanding of the existing evidence and the use of evidence by scholars to support their opinions. By understanding the concept of maqashid sharia, we can see that the presence of witnesses in divorce is in line with the objectives of Islamic law and provides legal certainty. The obligation to have witnesses in divorce, as also stated in Indonesian Family Law, is a stronger view in maintaining justice and ensuring protection for all parties, especially in dealing with the impact of divorce on children and families.

Abstract

Every year Muslims commemorate the feast of Idhul Adha. One form of celebration is done by sacrificing. Sacrifice is an amaliyah service whose provisions are regulated in Islam. Sacrifice according to etymology comes from Arabic, namely qaraba which means close. The word qurban is commensurate with the word al-udhiyyat which is defined as the name of an animal slaughtered on the Idhul Adha feast day and tasyrik days to draw closer to Allah. Whereas the term sacrifice means the slaughter of certain animals with the intention of drawing closer to Allah SWT, which is performed on the feast of Idhul Adha or in the days of Tasyrik which is the 11th, 12th and 13th of Dhulhijah. However, in Indonesia the implementation of slaughtering sacrificial animals in each region is carried out differently. Especially giving wages for slaughtering sacrificial animals. This article uses the analytical content method for the syllables' arguments and also uses the field research method, which is to gather information in the field related to the wages of slaughtering sacrificial animal sacrifices that occur in the middle of the community, especially the Tanjung Barulak district. Tanah Datar. The implementation of slaughtering sacrificial animals in the middle of the community is carried out differently. This is because this is a tradition that has been passed down for generations, both wages given in the form of meat, head, feet or parts of sacrificial animals are a reward for people who cut or clean sacrificial animals. The wages were still given but did not take from the sacrificial animal and then replaced the wages in the form of money taken or requested and collected from the sacrificial participants.

Abstract

One of the syar'i arguments in the study of ushūl fiqh is the al-’urf argument. In classical ushūl fiqh books, the argument of al-’urf tends not to be a special discussion chapter, but it is included in various studies of ushūl fiqh when a mujtahid performs legal istinbāth. It means that al-’urf becomes an external determining factor in the legal istinbāth process. Therefore a mujtahid, as required by Imam Syatibi, must master two sets of ijtihad; (1) Understanding and mastering the arguments (fiqh al-nash), and (2) Understanding the conditions under which the texts or propositions will be applied (fiqh al-wāqi'). The study of al-’urf is closely related to the second point: understanding the situation and conditions when doing legal istinbāth. It is where the urgency of the argument of al-’urf in the legal istinbāth process is seen. This study found that: (a) For the law to be established to find its purpose and benefit, a mujtahid must consider the al-’urf argument as a proposition from outside the existing text (nash) or as accompanying arguments for other arguments. (b) In subsequent developments (modern era), legal changes are not only determined by changes in conditions (al-ahwāl), times (al-azminah) and places (al-amkinah), but in subsequent developments also triggered by other changes. such as changes in the information, changes in the level of human need for certain objects, changes in the level of human abilities, changes in the matter of 'general al-balwā (inevitable needs). All of these are factors other than those that are generally recognized. (c) New (contemporary) problems that arise due to the development of science and technology (science) require a mujtahid to understand the various new problems that exist, especially in the fields of medical, economic and technological progress. By understanding the various changes and changes in the situation, condition, and place, it is hoped that the new laws are required to find their purpose (benefit) and wisdom. All of the problems in this research are examined with a library research approach while contextualizing new contemporary issues. Salah satu dalil syar’i dalam kajian ushūl fikih adalah dalil al-’urf. Dalam buku-buku ushūl fikih klasik, dalil al-’urf cenderung tidak menjadi bab pembahasan khusus, namun ia masuk dalam berbagai kajian ushūl fikih ketika seorang mujtahid melakukan istinbāth hukum. Artinya al-’urf menjadi faktor eksternal penentu dalam proses istinbāth hukum. Karena itu seorang mujtahid, sebagaimana disyaratakan Imam Syatibi, harus menguasai dua perangkat ijtihad; (1) Memahami dan menguasai dalil (fiqh al-nash), dan (2) Memahami situasi kondisi dimana nash atau dalil akan diterapkan (fiqh al-waqi’). Kajian al-’urf sangat berkaitan dengan poin kedua, yaitu memahami situasi dan kondisi ketika melakukan istinbāth hukum. Disinilah, terlihat urgensi dalil al-’urf dalam proses istinbāth hukum. Dari rumusan-rumusan masalah yang dikemukakan, maka ditemukan kesimpulan penelitian ini sebagai berikut: (a) Agar hukum yang ditetapkan menemukan tujuan dan kemaslahatannya, maka seorang mujtahid harus mempertimbangkan dalil al-’urf sebagai dalil dari luar teks (nash) yang ada atau sebagai dalil pendamping bagi dalil-dalil lainnya. (b) Dalam perkembangan selanjutnya (era modern) perubahan hukum tidak saja ditentukan oleh perubahan  kondisi (al-ahwāl), zaman (al-azminah) dan tempat (al-amkinah)saja, namun pada perkembangan selanjutnya juga dipicu oleh perubahan-perubahan lainnya seperti perubahan informasi, perubahan tingkat kebutuhan manusia terhadap objek tertentu, perubahan kadar kemampuan manusia, perubahan dalam soal ‘umum al-balwa (kebutuhan yang tak terelakkan). Semua ini adalah faktor-faktor lain diluar faktor-faktor yang umumnya dikenal. (c) Persoalan-persoalan baru (kontemporer) yang muncul karena perkembangan sains dan teknologi (ilmu pengetahuan) mengharuskan seorang mujtahid untuk memahami berbagai persoalan baru yang ada terutama dalam bidang kemajuan kedokteran, ekonomi dan teknologi. Dengan memahami berbagai perubahan, disamping perubahan situasi, kondisi dan tempat, maka diharapkan hukum-hukum baru yang diistinbāthkan menemukan tujuan (kemaslahatan) dan hikmahnya. Semua persoalan yang ada dalam penelitian ini dikaji dengan pendekatan kajian kepustakaan (library research) sembari melakukan kontekstual terhadap persoalan-persoalan baru kontemporer.

Abstract

The background of this study is the difference the committee has been chosen as the divider of dapua coupons, will distribute the coupons in the afternoon on the day before the slaughter day, they distribute coupons from one house to another, but in the distribution of dapua coupons there are differences from one house to another, some are given 2 coupons in one family consisting of 3 people,  There are 3 coupons in one family of 5 people and there are given 3 coupons in one family consisting of 7 people. When viewed in terms of habits or 'urf that usually apply in society in general, distributing qurban coupons is distributed equally. In this research method, the author conducted qualitatively, namely research carried out systematically by raising existing data in the field. Where researchers try to find information or sources that can be used as sources of research data at this writing is the head of the qurban, the committee that distributes coupons. To obtain data and material in this writing, the author immediately went to the field to get the desired data in the field by interviewing the source concerned. The results of the study concluded that the system used to distribute dapua coupons was carried out by calculating the number of families or based on KK (family cards), in terms of 'urf or custom is urf shahih, because it is in accordance with Islamic shari'a and brings fame to the community.

Abstract

This article explores the essence of marriage guardian in the perspective of Surah An-Nisa in the Koran and its relevance in modern society. Surat An-Nisa discusses the laws of marriage and women's rights, including the role of marriage guardian. This study analyzes verses related to marriage guardians and the interpretations of prominent scholars. The results show that the essence of marriage guardians, such as protecting women's rights and giving consent in good faith and being a mediator in resolving conflicts, remains relevant in maintaining a just marriage institution. However, challenges arise in the context of an increasingly inclusive and complex modern society. A solution is needed to integrate Islamic values that respect gender equality with tradition and modernity. An in-depth understanding of the essence of marriage guardians from the perspective of the Koran is important to support healthy and harmonious marriage relations in this era of globalization.

Abstract

The term bela negara (BN) has been widely used in Indonesian national discourse, often associated with state-led campaigns, ideological ceremonies, and symbolic narratives. However, its application has increasingly shown symptoms of conceptual excessivism, overused, abstract, and disconnected from everyday civic life. This article aims to reconstruct BN into a measurable and meaningful framework through an empirical, civic-based approach. By adapting behavioral and marketing evaluation models, such as customer satisfaction index (CSI), servqual, and theory of planned behavior, this paper proposes the model partisipasi bela negara (MPBN). The model offers six key dimensions: public awareness, perceived relevance, emotional engagement, civic intention, real action, and loyalty to the national narrative. These dimensions enable both scholars and policymakers to assess the effectiveness of BN initiatives based on citizen experience and engagement. The model serves as a strategic tool for transforming BN concept into a participatory, democratic, and context-sensitive concept, particularly relevant in today’s digital and pluralistic society. Rather than functioning as a rigid ideological imposition, BN should evolve into an inclusive civic identity that empowers public participation and strengthens national cohesion through trust, value, and meaningful contribution.

Abstract

Adapun maksud dari artikel ini adalah untuk mengetahui Pandangan Hukum Positif dan Hukum Pidana Islam terkait dengan tindakan catcalling serta sanksi dari perbuatan tindak pidana catcalling menurut hukum positif dan hukum islam. Motivasi penulis untuk membahas permasalahan ini ialah dilatarbelakangi dengan banyaknya masyarakat yang menjadi korban catcalling tetapi mereka tidak melaporkan ke pihak yang berwajib di karenakan mereka tidak mengetahui sanksi yang telah di tetapkan oleh pemerintah. Mereka juga menganggap hal itu biasa saja bahkan ada beberapa yang merasa bangga dengan godaan catcaller. Metode penlitian dalam artikel ini menggunakan penelitian empiris dan teknik analisa data menggunakan pendekatan kualitatif. Data yang diperoleh dari dokumen kemudian ditinjau dengan referensi dari buku, jurnal, artikel hukum positif dan hukum islam.  Setelah dilakukan penelitian ini dapat diambil kesimpulan bahwasannya catcalling dalam hukum positif merupakan suatu tindak pidana pelecehan seksuak secara verbal dengan hukuman yang telah diatur dalam UU Nomor 12 Tahin 2022 tentang Tindak Pidana Kekerasan Seksual (TPKS) yang terdapat pada pasal 5. Sedangkan didalam hukum Islam catcalling disebut juga sebagai penghinaan karena di dalam penghinaan terdapat unsur-unsur catcalling yang dihukum dengan hukuman takzir yaitu hukuman ditentukan oleh penguasa/ hakim
