Abstract

Frequently, discordant married couples contemplate divorce as their final option for resolving household problems. Many do not realize that divorce is the beginning of the onset of new problems that affect not only married couples but also their offspring if they are already parents. This study seeks to find out the realization of the implementation of child support obligations after divorce at the Purworejo Religious Court with various factors that influence it. This investigation is limited to the years 2020 and 2021 in order to examine the most relevant cases, as the events are still relatively recent. This form of research employs a qualitative paradigm and is conducted in the field. This study's methodology employs a normative legal approach. On the basis of court records from the Purworejo Religious Court, researchers conducted direct observations and interviews with litigants. Even though the child's maintenance obligations have been stated in the decision of the Purworejo, the results of the study indicate that there are still many parents, particularly the father, who do not fulfill their responsibilities to provide a living for their children due to various factors, including lack of legal awareness, lack of awareness of the obligations of a father to provide for children, too involved parents in the household, social factors, and economic factors

Abstract

The study discusses the opinions of Yusuf Qardhawi and Masdar Farid Mas’udi about alms and tax. Where the researcher feels there is an interest to explore more deeply from this two opinions, the both have the uniqueness thought wich very clearly visible accros the ijtihad about the wage of alms and tax. Yusuf Qardhawi argue that alms and tax very different and payment method cannot put together. While Masdar Farid Mas’udi argue about alms and tax altought between alms and tought different but cannot separated and payment method can put together. As the main points is to examine the istinbāth law of Yusuf Qardhawi and Masdar Farid Mas’udi then to know the stronger arguments is used by Yusuf Qardhawi and Masdar Farid Mas’udi about alms and tax. This research is library research by Fiqh az-Zakat book and Pajak itu Zakat book accompanied by interview with character directly via whatsapps. The result research with all the author capabilities, maximally to try analyze from two opinion Yusuf Qardhawi’s opinion above is amore superior than Masdar Farid Mas’udi’s opinion. It can be accepted because his opinion is in harmony of common of cleric.

Abstract

Perkawinan adalah ikatan  yang sakral. Keluarga yang bahagia dan langgeng melalui perkawinan tidak hanya memerlukan persiapan fisik, tetapi juga persiapan sosial, ekonomi, emosional, dan tanggung jawab. Tujuan penelitian ini adalah untuk mediskripsikan upaya pasangan nikah muda dalam embangun keluarga yang sakinah. Dengan menggunakan analisis deskriptif, penulis mengumpulkan data dari lapangan, wawancara atau observasi, kemudian menambahkan beberapa informasi sebagai catatan. Dari hasil penelitian dapat disimpulkan bahwa alasan pasangan suami istri menikah sebelum usia sah di desa Banyusidi adalah karena keinginan pribadi pasangan tersebut sudah saling mencintai dan kemudian ingin segera menikah untuk menghindari suatu hal tidak diinginkan. Upaya yang dilakukan membangun keluarga yang sakinah oleh pasangan nikah muda di desa Banyusidi yaitu; saling mempercayai dan tidak curiga, saling mendukung dan memotivasi, menghargai pendapat, tidak pernah mengeluhkan masalah ekonomi.

Abstract

In order to raise the spirit of Indonesian Muslims, it is very important to present the thoughts of these figures so that their thoughts can become a foundation that is then applied in real terms in the life of the nation and state. Among the figures who can be a source of inspiration are Muhammad Syafi`I Antonio, Adiwarman Azwar Karim and also KH. Ma`ruf Amin. The purpose of this study is to determine the Islamic economic thoughts of the three figures and to compare them. The study was conducted using a qualitative method using library research that was analyzed descriptively analytically. The results of the study show that the roles and thoughts of Syafi'i Antonio, Adiwarman Karim, and Ma'ruf Amin in the development of Islamic economics highlight their contributions in strengthening the foundations of the economy according to Islamic sharia principles. Syafi'i Antonio is known for his practical approach in the business and financial sectors, while Adiwarman Karim developed an in-depth theoretical analysis for Islamic economics globally and nationally. Ma'ruf Amin advocates for fair and inclusive economic policies at the social and political levels of Indonesia. Although their approaches are different, the unity of the three figures' thinking lies in the rejection of usury and an approach that emphasizes justice and blessings in economic distribution. Collectively, the three provide a strong foundation for the development of a sustainable and relevant Islamic economy for Muslims, facing challenges and opportunities in various global and local contexts.

Abstract

Salah satu kewajiban suami ketika sudah membina rumah tangga adalah memberikan nafkah kepada istri dan anak-anaknya. Nafkah merupakan hal wajib yang harus diberikan kepada istri oleh suaminya. Ada kewajiban maka ada pula hak yang harus didapatkan. Ketika suami memberikan nafkah maka istri sepatutnya sudah melayani suami.  pertukaran peran pencari nafkah antara suami istri bukan lagi menjadi hal baru dalam sebagian masyarakat. Pertukaran peran tersebut disebabkan oleh beberapa alasan salah satunya karena kurangnya ataupun tidak adanya nafkah yang diberikan oleh suami. Penelitian ini bertujuan untuk menganalisis bagaimana Kompilasi Hukum Islam dan Maslahah mursalah dalam menyikapi permasalahan pertukaran peran pencari nafkah antar suami dan istri. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana perspektif kompilasi Hukum Islam dan maslahah mursalah terhadap permasalahan pertukaran peran pencari nafkah antar suami dan istri. Hasil dari penelitian praktik pertukaran peran pencari nafkah antar suami dan istri tersebut merupakan suatu kemaslahatan yang memenuhi kriteria maqashid syariah, dan termasuk pada kualifikasi maslahah dharuriyyah yaitu kemaslahatan yang bersifat esensial bagi kehidupan manusia dan maslahah hajiyyah yaitu kemaslahatan yang tujuannya untuk mengatasi suatu kesulitan hidup berupa kurangnya pemenuhan ekonomi dalam rumah tangga. Maslahah ini berkaitan dengan hifdzun nasl dan hifdzun mal yaitu menjaga keutuhan keluarga dan keturunan dan juga perekonomian dalam rumah tangga.
