Abstract

This study discusses Islamic law in Morocco. The author focuses on the study of the government system and the development of Islamic law there. This study used descriptive qualitative method or so-called literature study /library research. Literature study examines data by exploring, observing, examining, and identifying existing knowledge in the literature to get a conclusion of truth, both philosophical and empirical. This study concludes that Morocco is a Muslim country, the population is more than 98% embraced Islam, the system of government is a democratic, social and constitutional monarchy that is based ongoverned by the 1972 constitution which was amended in 1980, 1992, and in September 1996. It has Mudawwana al-Usrah (2004) which is a contemporary family law in Morocco, family law which was originally still contained in fiqh books has become an implementing law. The legal system in Morocco is divided into two types of judiciary; Shari'a Court and Madaniyah Court (General Court). The existence of the renewal of private law (akhwal syakhsiyah) is guided by three principles, first, the principles and foundations of family law that are applied are the Maliki Mazhhab, second, paying attention to aspects of maslahah mursalah, third, the laws imposed in other Muslim countries The Moroccan government allows abortion for cases of rape and incest or incest or serious defects and incurable diseases of the fetus. last, Morocco is a country that allows polygamy. The issue of polygamy is regulated in the 1958 family law law Article 30 paragraph (1).

Abstract

This article examines the implementation of Al-Qur'an values in a set of Jambi local wisdom as per the familiar saying, "Adat is accompanied by syarak, syarak is accompanied by Kitabullah". The focus of the study in this article is the extent of the relationship between the community in Danau Teluk District and the values of the Koran contained in Jambi Malay customary law, which is termed the Parent UU Nan Limo. Jambi Malay cultural traditions and Islamic religion are an inseparable intertwining with one another with an emphasis on religion. This research is qualitative research, with data collected in the form of descriptions, detailed descriptions. The results of this research state that Induk Nan Limo has a close relationship with the values of the Al-Qur'an, this can be seen from the existence of Al-Qur'an verses which are the basis for each point of Induk Nan Limo Limo. Then the practice of applying the values of the Koran can be seen in the social life of society in its cultural customs. Artikel ini mengkaji tentang implementasi nilai-nilai Al-Qur’an dalam seperangkat kearifan lokal Jambi sebagaimana pepatah yang tidak asing lagi, “Adat bersendi syarak, syarak bersendi Kitabullah”. Fokus kajian dalam artikel ini adalah sejauhmana hubungan masyarakat di Kecamatan Danau Teluk dengan nilai-nilai al-Qur’an yang terdapat dalam hukum adat Melayu Jambi yang diistilahkan dengan Induk Undang Nan Limo. Adat budaya melayu Jambi dan agama Islam merupakan suatu jalinan yang tidak dapat dipisahkan antara satu dan lainnya dengan titik berat pada agama. Penelitian ini merupakan penelitian kualitatif, dengan data yang dikumpulkan berupa deskripsi, uraian detail. Hasil dari penelitian ini menyatakan bahwa Induk Undang Nan Limo mempunyai hubungan yang erat dengan nilai-nilai Al-Qur’an, hal ini dapat dilihat dari adanya ayat-ayat Al-Qur’an yang menjadi dasar pada tiap-tiap point dari Induk Undang Nan Limo. Kemudian praktik penerapan nilai-nilai Al-Qur’an dapat dilihat dalam kehidupan sosial masyarakat dalam adat budayanya.
