Abstract

This research aims to analyze the application of the principle of nebis in idem in the handling of civil case Number 287/Pdt.G/2023/PA.Skh. which corresponds to the principle of contante Justitie and to know and analyze the handling of cases carried out by judges who examine, hear, and decide cases handled by the Sukoharjo Religious Court, by looking at the considerations of judges in applying the principle of nebis in idem. This research is normative legal research, using secondary data which is processed using qualitative techniques. The results of this study indicate that: (1) the handling of civil case Number 287/Pdt.G/2023/PA.Skh. in its decision is appropriate and has applied the principle of nebis in idem properly, because the elements of nebis in idem as required in the Civil Code have cumulatively been fulfilled; (2) the considerations given by the panel of judges in giving the decision are appropriate and correct based on applicable legal principles. (3) cases containing elements of nebis in idem must be filed an exception and an exception can only be filed in the first answer along with a rebuttal to the subject matter. It is recommended that in the future a dismissal process can be carried out before cases related to nebis in idem are examined and tried like the mechanism in the state administrative court, in order to provide legal certainty for justice seekers as well as implement the principles of fast, simple, and light costs.

Abstract

The development of information and communication technology has had a significant impact on various sectors of life, including the banking sector. The legal system has made essential safeguards to protect bank and customer data security. The latest information regarding developments in the Indonesian Kapital data leak case must be sought through trusted news sources or contacting authorities such as the OJK or Bank Indonesia to obtain accurate and up-to-date information. The Consumer Protection Law seeks to protect bank customers by limiting standard clauses that cannot be avoided in today's banking business world. The method in this research uses normative legal research. Issues in the banking world relate to the legal position of banking in cases of leakage of Indonesian Sharia Bank customer data and banking legal protection efforts that the legal system has carried out to protect the security of bank data and customer data. Two factors cause leaks of customer personal data, namely internal and external factors. Cases of customer data leakage are severe violations of privacy and information security. Banks, including Islamic banks, have a big responsibility in maintaining the confidentiality of customer data and protecting their personal information. If a data leak occurs, the bank could face legal and regulatory consequences, potentially harming its reputation. The method in this research uses normative legal research.

Abstract

Pembangunan ekonomi dan pertumbuhan ekonomi memiliki keterkaitan erat, tetapi keduanya memiliki makna dan dimensi yang berbeda. pertumbuhan ekonomi yang tinggi saja tidak selalu menjamin pembangunan ekonomi yang berkelanjutan dan inklusif. Fokus pada aspek-aspek kualitatif pembangunan, seperti pendidikan, kesehatan, dan distribusi pendapatan, juga merupakan bagian integral dari pencapaian pembangunan ekonomi yang seimbang dan berkelanjutan. pemerintahan Jokowi Jilid I ditandai den­gan optimisme tinggi atas prospek ekonomi. Target pertum­buhan ditetapkan di kisaran angka 7%. Namun, kondisi faktor ekster­nal yang kuiang kondusif dan bu­tuhnya koordinasi yang lebih baikantar K/L dalam mendorong in­vestasi menyebabkan target terse­but belum tercapai.Secara rata­-rata pertumbuhan ekonomi dalam periode 2014-­2018 kurang lebih 5%. Laju per­tumbuhan ekspor sebesar 3,76% lebih rendah daripada laju per­tumbuhan impor sebesar 4,56%. kebijakan ekonomi dalam konsep welfare state pada pemerintahan Presiden Joko Widodo. Jenis penelitian yang akan saya gunakan adalah metode penelitian dengan pendekatan yuridis-normatif. Pendekatan yuridis berarti penelitian ini akan mencakup analisis terhadap asas-asas hukum, struktur hukum, tingkat sinkronisasi hukum, perkembangan sejarah hukum. Pemerintahan Jokowi telah melaksanakan konsep welfare state melalui program dan inisiatif yang bertujuan untuk meningkatkan pertumbuhan ekonomi dan mengatasi ketidaksetaraan akan tetapi belum bisa mencapai peningkatan pertumbuhan ekonomi yang signifikan, program pembangunan ekonomi di era Jokowi perlu dievaluasi dari berbagai perspektif, termasuk tingkat keberhasilan terhadap pertumbuhan ekonomi, kesejahteraan masyarakat, dan keberlanjutan pembangunan Indonesia. Pemerintah belum bisa menciptakan masyarakat mandiri dengan terus menerus menerima produk barang maupun jasa dari luar, karena kurangnya upaya untuk meningkatkan kemandirian dan kedewasaan berpikir masyarakat dan para pelaku usaha.

Abstract

This research aims to examine unlawful practices committed by financing institutions in the process of transferring rights by using absolute power of attorney and examine the legal consequences of using absolute power of attorney against the law. The research uses a statutory approach and applicable regulations along with legal principles used to examine the problem under study. The conclusion obtained is that in practice there are still many financing institutions in collaboration with authorized officials who still practice debt and credit mixed with buying and selling, therefore the use of absolute power of attorney in the transfer process is a legal act prohibited by laws and regulations which can be canceled and null and void and is a form of abuse of circumstances and vigilante efforts. The legal consequences of the practice of unilateral transfer of rights using an absolute power of attorney are a form of legal smuggling where when the conditions for the validity of the agreement are not met, which include subjective conditions in the form of an agreement containing elements of unlawful acts and objective conditions regarding legal causes because they violate the Civil Code and Presidential Instruction Number 14 of 1982 concerning the Prohibition of the Use of Absolute Power of Attorney as a Transfer of Land Rights which was later replaced and refined in Government Regulation No. 24 of 1997 concerning Land Registration.

Abstract

The fashion industry is among the sectors with significant potential to cause environmental pollution, particularly through liquid waste discharge, carbon emissions, and microplastic contamination. Despite these risks, Indonesia’s existing legal framework remains general in nature and lacks specific provisions addressing the environmental impacts of the fashion sector. This study aims to analyze both national and international legal frameworks concerning the environmental health implications of the fashion industry, identify normative and implemented weaknesses in current regulations, and assess the potential for harmonization with international legal principles and sustainability approaches, such as Extended Producer Responsibility (EPR). Employing normative juridical methods and a comparative legal approach, the study finds that Indonesia’s national regulations have yet to effectively address the distinct characteristics and environmental risks associated with the fashion industry. The study concludes by underscoring the urgent need for the development of responsive sector-specific regulations, the reinforcement of supervisory and enforcement mechanisms, and the integration of international principles to promote an environmentally sustainable fashion industry.

Abstract

Malpractice, a criminal act in the healthcare field, creates legal problems when patients realize the impact. Medical negligence can harm patients, triggering risks that could have been avoided with medical prudence. Normative and sociological research supports the criminal law assessment of malpractice, focusing on maltreatment and negligence causing death. Sanctions are imposed by the medical professional organization and the immediate supervisor in charge, taking into account the ethical values and values of the profession. Punishment is only imposed if the act violates the law, and the form of malpractice needs to be adjusted to the development of science and the times.
