Abstract

The village, as a legal construct, comprises both a governing body and its community members. However, development initiatives in these rural areas often fail to meet the needs of individuals with disabilities. This neglect leads to the marginalization of persons with disabilities, forcing them to live in isolation within rural environments. In response, the Government of Indonesia has enacted Law No. 8 of 2016 concerning Persons with Disabilities. This legislation aims to elevate the status of persons with disabilities to that of equal citizens, ensuring fair rights and opportunities for their active participation in village development. This study employs a normative juridical methodology by analyzing data from legal documents and literature, complemented by an empirical approach through interviews with relevant stakeholders. The research seeks to elucidate the rights of persons with disabilities within the framework of village development and to explore village government perspectives on their inclusion. Development efforts must shift toward a community-centered model that integrates the interests of the disabled population. Accordingly, the welfare of persons with disabilities in Lheu Eu Village, Darul Imarah District, Aceh Besar, must be grounded in humanitarian principles. Collaborative efforts among village government, the business sector, academia, and disability advocates are essential to realizing the legal mandate and regulatory framework that govern the inclusion of persons with disabilities in rural development.

Abstract

Purpose: This study addresses the marginalization of persons with disabilities in rural Indonesian villages, specifically examining the implementation of Law No. 8 of 2016 concerning Persons with Disabilities. This research seeks to enhance the status of persons with disabilities, ensuring equal rights and opportunities for their active participation in village development. Research methodology: This study employs a normative juridical methodology, analyzing data from legal documents and literature, complemented by an empirical approach through interviews with key stakeholders. This mixed-methods approach helps clarify the legal rights of persons with disabilities and gather insights into the perspectives of village governments on inclusion. Results: This study highlights the need for a community-centered development model that integrates the interests of persons with disabilities. This underscores the importance of adhering to human rights principles in ensuring the well-being of persons with disabilities in Lheu Eu Village, Darul Imarah District, and Aceh Besar. The study also emphasizes the necessity of collaborative efforts among village governments, businesses, academics, and disability advocates to implement legal mandates and regulatory frameworks for disability inclusion effectively. Limitations: The findings of this study are primarily based on qualitative data, which may not capture the full extent of the issues faced by people with disabilities in different rural contexts. Additionally, the research was limited to a specific geographic area, which may limit the generalizability of the results to other regions. Contribution: This study contributes to the body of knowledge on rural development and disability rights in Indonesia by providing a comprehensive analysis of the legal and social frameworks necessary for the inclusion of people with disabilities in village development. It offers practical recommendations to policymakers, village authorities, and other stakeholders to enhance the implementation of inclusive policies and practices.

Abstract

Qanun Number 9 of 2008 concerning the Development of Traditional Life and Customs provides 18 (eighteen) types of trials/disputes in which there are rules regarding minor offences being the authority of customary licenses while including serious criminal offences beyond traditional justice. The objective of this community service is to provide understanding to the people of Gampong Lamreung, Darul Imarah subdistrict, regarding Qanun Number 9 of 2008 concerning the Development of Traditional Life and Customs, as well as what efforts officials of the gampong and the community can make in dealing with minor crimes in Gampong Lamreung, Darul Imarah of Aceh Besar Regency. The methods used in this community service are in the form of counseling, lectures and questions and answers regarding the importance of Qanun Number 9 of 2008 concerning the Development of Traditional Life and Customs. The Aceh government has attempted to protect traditional life and customs through Qanun Number 9 of 2008 concerning the Development of Traditional Life and Customs. However, this Qanun is only known to government institutions and traditional leaders, even though the target of fostering and developing traditional life and customs is also aimed at the family circle, which is an important component in maintaining and preserving the development of Aceh's traditional life and customs.The follow-up to this community service is carrying out the same activities focused on the family environment. This is aimed so that the development of traditional life and customs can be implemented effectively.Keywords: Qanun, Tradition and Custom, Family
