Abstract

Background. Holistic and interconnected studies on halal certification, sharia regulations, and moral regulations as real manifestations of the conservative movement in Indonesian Islamic legal policy are still limited. Aim. This article examines the dynamics of conservatism in Islamic legal policy in Indonesia, focusing on halal certification, sharia-based local regulations (sharia regional regulations), and moral regulation. The central issue addressed is how conservative movements influence the formulation and implementation of Islamic legal policies at both national and local levels. Method. This study employs a library research method with a descriptive qualitative approach, analyzing academic literature, legal documents, and relevant empirical data. Result. The findings reveal that halal certification, sharia regulations, and moral policies serve not only as instruments of religious and consumer protection, but also as tools for social control, economic selection, and consolidation of majority identity politics. However, these policies present challenges such as unequal access, potential discrimination against minorities, and the narrowing of civil liberties. The study underscores the importance of developing fair, inclusive, and dialogical Islamic legal policies to promote social cohesion and justice within a multicultural society.

Abstract

The difference between salaf scholars and modern scholars about the successor to successors. Salaf scholars state that "successor inheritance" does not exist, and with the principles of naqliyyah and ijma 'Companions, hold firm that the problem of "inheritance" is qat'i, ta'abbudi, not ta'aqquli, not ijtihadi, and they uphold ijma 'Companions because there is a basis for the words of the Prophet Muhammad about it. Whereas modern scholars (khalaf) in KHI and Hazairin thought stated that "successor inheritance" exists and has the inheritance rights of his parents who died, and they (modern scholars) put the issue of "successor inheritance" of zanni, ta'aqquli, and ijtihadi, for the sake of social benefit in Indonesia.

Abstract

This study examines employee job satisfaction through authentic leadership practices, organizational-trust in leader and interaction between the two. The study was conducted at the STAI At-Tahdzib Jombang and took 23 educator and adminsitration staff randomly as sample of the study. The data were analyzed by simple regression analysis, multiple regression analysis and moderate regression analysis. The analysis shows authentic leadership has a positive effect on job satisfaction. The positive influence of authentic leadership on job satisfaction is lost when multiple and interacts with organizational-trust in leader. Organizational-trust in leader has a positive effect on job satisfaction. The positive effect of organizational-trust in leader on job satisfaction does not disappear when multiple and interacts with authentic leadership. Organizational-trust in leader has no effect of strengthening or weakening the influence of authentic leadership on job satisfaction. The interaction between authentic leadership and trust in organizational leadership has no effect on job satisfaction.

Abstract

Background. The development of the Islamic finance industry and the demands of modern financial transactions encourage innovation in contracts to respond to the increasingly complex needs of society. Aim. This study aims to determine the relevance of the Hybrid Contract concept with Maqashid al-Shari’ah introduced by Jasser Auda, as well as to explain how the law applies to Hybrid Contracts in the modern financial industry. Methods. The research uses a qualitative approach, which includes three stages, namely description, formulation and interpretation. Results. Hybrid Contract is a collection of several contracts contained in a contract that is agreed upon by both parties, both jointly and reciprocally, so that all legal consequences of the collected contracts and all rights and obligations arising from it are seen as a single entity that cannot be changed and separated. DSN-MUI in an effort to combine contracts took two models, namely multiple contracts (mujtami’ah) and multiple contracts (muta’addidah). Faced with Maqashid al-Shari’ah Jasser Auda, Hybrid Contracts are relevant in an effort to validate all cognition, holism, multi-dimensionality and intent.

Abstract

Latar belakang. Reasuransi merupakan suatu jenis usaha yang bersifat intema sional. Sebagai suatu usaha yang bersifat internasional, perusahaan reasuransi mempunyai ruang lingkup dan operasional secara global, Persoalan penting yang perlu di bahas dalam penelitian ini diantaranya bagaimana telaah konseptual reasuransi di Indonesia ? persoalan ini bisa dipecahkan melalui pendekatan normatif, persoalan kedua berkaitan dengan bagaimana reasuransi dalam perspektif maqhasid al-syari’ah ? persoalan ini bisa dipecahkan melalui pendekan filosofi, dengan mencari benang merah antara konsep dan praktek reasuransi itu sendiri. Metode, Penelitian ini merupakan study kepustakaan (library reseach) Pendekatan dalam penelitian ini menggunakan teologi-filosofis dengan memposisikan resuransi Syari’ah dalam konteks teologis dan Maqasid al-Shari’ah dalam konteks filosofis. Secara operasional, pendekatan pertama digunakan untuk menggali dasar hokum, pedoman teknis hingga pada aspek pemberlakuan Asuransi Syari’ah di Indonesia. Pendekatan kedua digunakan untuk menarik benang merah antara reasuransi dengan Maqasid al-Shari’ah, teknik analisis isi (Content analisis) yaitu mempelajari pesan-pesan yang ada diberbagai literature mulai dari kosa kata, pola kalimat dan latar belakang situasi Hasil, Dalam ketentuan Investasi, perusahaan asuransi selaku pemegang amanah wajib menginvestasikan dana yang terkumpul dan investasi wajib dilakukan sesuai dengan syariah. Dalam pengelolaan dana investasi, baik tabarru’ maupun saving, dapat digunakan akad Wakalah bil Ujrah dengan mengikuti ketentuan seperti di atas, akad Mudharabah dengan mengikuti ketentuan fatwa Mudharabah.Aspek kemaslahatan yang terkandung dalam konsep reasuransi ini bersifat bertumpu pada aspek dhoruri dan hajiyat konsep pertama menempatkan reasuransi sebagai pokok pemenuhan pelimpahan tanggungjawab yang diberikan oleh cending company kepada penanggung kedua walau pada hakikatnya ada Quota Share baik keuntungan maupun resiko. Aspek paling pentingnya terletak pada perjanjian reasuransi itu sendiri.

Abstract

Background. Operationally, finansial lease transaction focuses more on the financing aspect of the Lessor given to the lesse, where the lesse will bear all aspects of maintenance and responsibility for the goods he rents.Aim. This study aims to examine financial leases in the perspective of Islamic law.Methods. This type of research is a qualitative research with a descriptive approach that uses the literature study method as the completion methodology. With the object of research, the Leasing case is seen from the point of view of Islamic law, and how Islam answers these problems.Results. From the point of view of Islamic law, finance leasing transactions tend to be similar to the concept of ijarah or ijarah vomitiyah bi al-tamlik which is used as the basis for making the DSN MUI fatwa on shari'ah leasing. This fatwa provides an overview of the legal basis, rights and obligations of the Lessor, Lessee and other parties involved in this contract. Applicatively, as long as it does not harm either party, the financial leasing law is basically allowed.

Abstract

Background. The formulаtіon of the concept of а dіfferent Іslаmіc pensіon fund between the Compіlаtіon of Іslаmіc Economіc Lаw (KHES) аnd Fаtwа No.88/DSN-MUІ/XІ/2013.Aim. Thіs study exаmіnes the need for hаrmonіzаtіon of regulаtіons relаted to Іslаmіc pensіon funds so thаt there іs unіformіty аnd hаrmony of legаl provіsіons іn Іslаmіc pensіon fund regulаtіons.Methods. Thіs reseаrch study uses а lіterаture study аpproаch.Results. The legаl hаrmonіzаtіon of Іslаmіc pensіon funds аccordіng to Supreme Court Regulаtіon No. 2 of 2008 concernіng Compіlаtіon of Shаrіа Economіc Lаw аnd Fаtwа No. 88/DSN-MUІ/XІ/2013 concernіng generаl guіdelіnes for іmplementіng pensіon progrаms bаsed on shаrіа prіncіples whіch аre іn contrаcts аnd dіspute resolutіon, іn the KHES thаt іs used іs the Grаnt Аgreement іn the prаctіce of Іslаmіc pensіon funds, the grаnt contrаct іs іn the form of gіvіng funds (Mаrhun Bіh) from the Gіver Work (Wаhіb) to Workers (Mаuhub lаh) іn іmplementіng shаrіа pensіons. Whereаs іn the fаtwа usіng the Bі Syаrt Grаnt Аgreement, bаsіcаlly the Grаnt іs аbsolute іn the sense thаt the Grаnt іs pаrt of the tаbаrru' contrаct whіch іs for help or аskіng for help, thаt іs, someone who donаtes hіs property meаns thаt the ownershіp of the object іs trаnsferred. Іn the fаtwа relаtіng to аn explаnаtіon regаrdіng dіsputes between pаrtіes аnd the enаctment of the dаte for the determіnаtіon of the fаtwа "іn the event of а dіspute between the pаrtіes іn іmplementіng pensіons bаsed on shаrіа prіncіples through delіberаtіon, medіаtіon, аrbіtrаtіon or court іn аccordаnce wіth аpplіcаble lаws аnd regulаtіons". Meаnwhіle, іn terms of KHES, jurіdіcаlly, іt іs resolved through relіgіous courts. Іn relаtіon to thіs dіshаrmony, іt tends to be better іf the legаl substаnce іs mаde up of lаws аnd regulаtіons whіch the process relаtіvely does not requіre а lengthy legіslаtіve process (through POJK, PMK, PBІ, SEMА etc.) whіch аccommodаtes the two sіdes of the dіfferences thаt exіst.
