Abstract

Abstract:  This research stems from the concern over the persistent gender bias in the construction of divorce law in Indonesia, as stipulated in Law Number 1 of 1974 on Marriage and the Compilation of Islamic Law (KHI). The legal norms that position the husband as the primary holder of the right to divorce (talak) and the wife as the passive party reflect relational inequality, which leads to social and legal injustice. Through a normative juridical approach with the mubadalah paradigm which emphasizes the principles of reciprocity and relational justice this study seeks to reconceptualize divorce law toward a gender-just model of amicable divorce. The findings reveal that the mubadalah paradigm can serve as an ethical and theoretical foundation for shifting the orientation of divorce law from a power-based relationship to one of mutuality, where divorce is understood as a joint process aimed at preserving the well-being and dignity of both parties. This study recommends reforming Islamic family law through amendments to the Marriage Law and the KHI, strengthening equality-based mediation institutions, and enhancing institutional capacity and public education from a gender perspective. Thus, amicable divorce based on mubadalah becomes not only a conceptual proposal but also a practical strategy toward a more just, humanistic, and compassionate Islamic family law in line with the spirit of rahmatan lil ‘alamin.   Keywords: Amicable Divorce, Mubadalah, Gender Justice, Islamic Family Law, Divorce Law.

Abstract

Penelitian ini bertujuan untuk menganalisis gaya belajar siswa berprestasi di Kelas V SD Negeri 3 Karangtengah. Jenis penelitian yang digunakan adalah kualitatif dengan teknik pengumpulan data berupa non tes menggunakan observasi, wawancara, dan dokumentasi. Keabsahan data penelitian ini menggunakan triangulasi sumber dan triangulasi teknik. Sumber dalam penelitian ini adalah guru, siswa dan orang tua siswa. Hasil penelitian menunjukkan bahwa lima siswa berprestasi di Kelas V SD Negeri 3 Karangtengah memiliki gaya belajar yang berbeda. Setiap anak memiliki gaya belajar yang mengarah pada gaya belajar visual, auditori, ataupun kinestetik. Metode pembelajaran yang digunakan oleh guru membantu gaya belajar siswa. Faktor internal dan eksternal berpengaruh pada gaya belajar yang dimiliki siswa. Faktor tersebut berupa faktor fisiologis, faktor psikologis, dan faktor lingkungan. Saran kepada siswa untuk memaksimalkan gaya belajar yang dimiliki masing-masing, dan guru perlu menggunakan metode pembelajaran yang lebih variatif.

Abstract

This research is motivated by the importance of entrepreneurship development in Islamic educational institutions as an effort to improve the quality of creative, innovative, and independent human resources in the era of globalization and digital transformation. The problem of this study is the lack of entrepreneurial culture development in Islamic educational institutions due to the limited role of leadership in supporting entrepreneurship programs. This study aims to analyze the role of leadership in developing entrepreneurship in Islamic educational institutions, the strategies implemented, and the supporting and inhibiting factors in its implementation. The research method used is a qualitative approach with library research. Data were collected through documentation studies from various sources such as scientific journals, books, articles, and other relevant documents, then analyzed using content analysis techniques. The results show that leadership has an important role in building an entrepreneurial culture in Islamic educational institutions through its functions as a visionary, motivator, innovator, facilitator, collaborator, and instiller of Islamic values. In addition, transformational leadership is considered effective in increasing creativity, innovation, and participation of school members in developing entrepreneurship programs based on Islamic values and digital technology.

Abstract

In the era of global disruption and uncertain economic dynamics, fostering an entrepreneurial spirit from an early age is no longer just an option, but a strategic urgency. Early childhood education plays a crucial role as the foundation for character and mindset formation. "Market Day" activities represent one of the efforts to build and nurture this entrepreneurial spirit in children from the very beginning. Through Market Day, children engage in a direct learning process, implementing the concept of "Learning by Doing." Consequently, they can experience firsthand the entire process required in entrepreneurial activities. Cultivating an entrepreneurial spirit from an early age is vital in preparing a future generation that is independent, creative, and adaptive.
