Abstract

Perselisihan hubungan industrial masih terjadi di kalangan sektor industri. PT Philips Seafood Indonesia dan 40 buruh wanita yang berstatus pekerja lepas harian sekarang ini telah mengalami perselisihan dikarenakan adanya pemutusan hubungan kerja yang dilakukan oleh PT PSI yang menurut pihak buruh tidak sesuai dengan prosedur peraturan perundang-undangan yang berlaku. Berdasarkan perselisihan antara PT PSI dan pihak 40 buruh wanita tersebut terdapat dua permasalahan, yaitu bagaimana upaya penyelesaian sengketa pemutusan hubungan kerja buru PT Philips Seafood Indonesia Lampung Plant di Kota Bandar Lampung ? dan apa faktor penghambat dalam penyelesaian sengketa pemutusan hubungan kerja buruh PT Philips Seafood Indonesia Lampung Plant di Kota Bandar Lampung ? Tujuan penelitian mengamati dan menganalisis tiap skema penyelesaian sengketa antara 40 buruh wanita dengan PT PSI. Metode penelitian yang digunakan ialah penelitian normatif-empiris dengan pendekatan masalah normatif-terapan yang didukung dengan perselisihan yang terjadi antara PT PSI dan 40 buruh wanita yang telah melalui beragam upaya penyelesaian sengketa yang terdiri dari penyelesaian secara bipatrit dan tripartit (mediasi) yang telah dilakukan secara berjenjang pada bulan Februari 2023. Faktor yang mempersulit penyelesaian sengketa perselisihan hubungan industrial ini terjadi karena beberapa faktor salah satunya adalah tidak ada niat kesadaran dari pihak perusahaan untuk segera memenuhi hak-hak buruh yang mereka tiadakan, belum ada norma ataupun peraturan yang bersifat imperatif untuk memaksa para pihak untuk hadir dalam sidang mediasi.

Abstract

Purpose: The aim of this research is to determine the need to implement a policy of replacing E-KTP with Digital Population Identity (IKD) in South Lampung Regency and to determine the implementation of a policy of replacing E-KTP with Digital Population Identity (IKD) in South Lampung Regency. Research methodology: This study employs a normative empirical method using a descriptive analysis approach. Secondary data were acquired through meticulous literature review and subjected to qualitative analysis. Rigorous literature selection ensured data validity. The outcomes of the analysis served as the basis for accurate conclusions within the research. Results: The research results show that changing KTP-e to IKD needs to be done because of the implementation of Permendagri No. 72 of 2022 concerning Standards and Specifications for Hardware, Software and Digital Identity Card Blanks. This was implemented because the e-KTP was no longer in line with the dynamics of the need for population administration services supported by a digital system. Limitations: The implementation of changing e-KTPs to IKDs in the South Lampung Regency has not been optimal, because the acquisition of IKD activations has only reached 14.04% of the number of existing villages and sub-districts. In practice, any service still requires a physical KTP. Contribution: This research explains that IKD is a solution to the problem of the scarcity of e-KTP blanks, which has always been an obstacle in implementing e-KTP because of the relatively high demand for recording and printing identity cards.

Abstract

Penyelesaian konflik dalam konteks hubungan industrial memiliki peranan yang krusial untuk mempertahankan stabilitas dan produktivitas di lingkungan kerja. Penelitian ini bertujuan untuk menganalisis sejauh mana efektivitas metode Alternative Dispute Resolution (ADR) dalam mengatasi konflik yang terjadi dalam hubungan industrial. ADR, yang mencakup mediasi, arbitrase, dan negosiasi, memberikan pendekatan yang lebih fleksibel, cepat, dan ekonomis dibandingkan dengan proses litigasi konvensional. Penelitian ini menggunakan metode kualitatif dalam pendekatan studi kasus pada beberapa perusahaan di Indonesia yang telah menerapkan ADR untuk menyelesaikan konflik hubungan industrial. Penelitian ini juga mengadopsi metode yuridis empiris dan yuridis normatif. Hasil penelitian ini menunjukkan bahwa: 1. Penyelesaian sengketa pemutusan hubungan kerja antara buruh dan PT Philips Seafood Indonesia Lampung (PT PSI) telah melalui berbagai tahapan penyelesaian yang memanfaatkan mekanisme alternatif, termasuk perundingan bipartit dan tripartit. Namun, proses tersebut tidak membuahkan hasil yang diharapkan dan dilanjutkan ke tahap tripartit yang difasilitasi oleh mediator dari Dinas Ketenagakerjaan Kota Bandar Lampung, yang berlangsung secara bertahap hingga Februari 2023. Meskipun demikian, upaya tersebut tidak berhasil, sehingga diterbitkan Dokumen Anjuran Tertulis No: 568.40.III.06.05.IV.2023 yang ditandatangani oleh mediator. 2. Beberapa faktor yang menghambat penyelesaian sengketa antara 40 buruh wanita dan PT PSI meliputi kurangnya itikad baik dari pihak perusahaan dalam memenuhi hak-hak buruh yang terabaikan, tidak adanya norma atau regulasi yang mengikat untuk mewajibkan kehadiran para pihak dalam sidang mediasi, sikap kurang kooperatif dari pihak-pihak yang enggan mencari solusi atau kompromi, serta keterbatasan mediator yang tidak sebanding dengan jumlah kasus yang ditangani oleh Dinas Ketenagakerjaan Kota Bandar Lampung.

Abstract

Regional Head Elections (Pilkada) are a fundamental mechanism for strengthening local democracy and citizen participation. However, public understanding of the legal framework for regional elections often experiences gaps, resulting in uneven participation and a lack of public legal awareness. This study aims to: (1) analyze the level of public understanding of Law No. 10 of 2016 on Pilkada, (2) identify the effectiveness of legal socialization programs in increasing democratic awareness, and (3) formulate policy recommendations for strengthening legal education on Pilkada at the local level. The research method used a qualitative approach through focus group discussions (FGD) and in-depth interviews with the community of Pekon Tegalsari as the main participants, as well as analysis of related policy documents. The data were analyzed using thematic analysis to identify patterns of gaps in understanding and obstacles to socialization. The results of the study show that there is a significant gap between the design of election policies and public understanding, especially in terms of the rights and obligations of voters. Existing socialization programs have not been optimal in reaching all segments of society, especially marginalized groups. These findings emphasize the importance of an inclusive approach to legal socialization, involving synergy between local governments, educational institutions, local media, and civil society organizations to strengthen democratic legal awareness and active participation in elections.
