Abstract

The primary function of banks is to gather public deposits and extend credit. While banks aim for profit, they also play a crucial role in enhancing societal welfare, which requires adherence to prudential principles. Unfortunately, banking crimes committed by managers often occur, adversely affecting both the institutions and the public. This study explores the application of prudential principles in banking as a state responsibility, the nature of violations associated with banking crimes, and the enforcement of Banking Law in Indonesia. The research analyzes court decisions related to banking crimes from 2015 to 2020, focusing on the relevant legal substances. Employing a judicial normative method that includes statutory, conceptual, and case analyses, the findings indicate that violations typically arise from managers with decision-making authority and access to internal data, leading to breaches of Banking Law and standard operating procedures (SOPs). Courts respond to these violations with criminal sanctions, while the Financial Services Authority (OJK) revokes licenses as necessary. Recommendations include appointing OJK supervisors with banking expertise and clarifying Article 49, paragraph (2), letter b of the Banking Law to prevent misinterpretation.

Abstract

Wali murid Sekolah Generasi Mulia yang menjadi mitra kegiatan kami, berlokasi di Kabupaten Banyumas, Propinsi Jawa Tengah. Pada saat ini, mitra memenuhi kebutuhan air minum melalui pembelian air isi ulang, sedangkan air hujan memiliki potensi sebagai sumber air minum meskipun pH nya rendah (berkisar 5-6). Selain itu, mitra belum memahami kaitan antara air hujan dan konservasi sumber daya air. Tujuan program pengabdian adalah meningkatkan pemahaman terkait pemanfaatan air hujan sebagai sumber air baku minum dan konservasi sumber daya air melalui teknologi elektrolisis dan Pemanen Air Hujan (PAH). Metode dilakukan dengan diseminasi teknologi dan pelatihan. Berdasarkan hasil diseminasi teknologi, metode elektrolisis mampu menaikkan pH air hujan dari 6,4 menjadi 9 dalam waktu sekitar 21 jam. Sedangkan, teknologi PAH mampu menjaga pengisian air tanah melalui drainase vertikal. Selain itu, Peningkatan pemahaman mitra terhadap teknologi mengalami peningkatan signifikan (32% menjadi 95%). Pemahaman mitra terhadap teknologi yang dikenalkan merupakan faktor penting dalam mendukung optimalisasi pemanfaatan air hujan dan keberhasilan konservasi sumber daya air di daerah kawasan pemukiman.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) in Banyumas possess considerable potential to contribute to the regional economy through export activities. However, numerous MSMEs encounter significant challenges, particularly in understanding export procedures, adhering to international quality standards, and developing effective global marketing strategies. Our community engagement initiative aims to enhance the preparedness of Banyumas MSMEs to access international markets through a structured coaching clinic program, conducted in collaboration with Association of Small and Medium Enterprises and Industries of Banyumas (ASPIKMAS) The implementation methodology encompasses comprehensive training sessions and targeted mentoring programs. The anticipated outcomes include an improvement in the knowledge and competencies of MSME actors regarding export processes, as well as an expanded understanding of international market opportunities. It is expected that this initiative will significantly enhance the global competitiveness of Banyumas MSMEs, thereby fostering economic growth and sustainability in the region.

Abstract

The concept of balance is vital in work contracts, where mutual fulfillment of rights and obligations ensures justice. Specifically, this study will focus on the balance principle within the service bond work agreement at Lion Air Group, by examining its relevance and the legal protection it offers to pilots. Utilizing a normative juridical approach, the research analyzes the Lion Air Group Service Association Work Agreement. Findings reveal that the agreement between PT. Lion Mentari Airlines and its pilots employs standard clauses which fail to uphold the balance principle. There is an evident imbalance in the rights and obligations of the parties involved. Emphasizing the balance principle is crucial in standard contract agreements to address this disparity. The significance of this principle in work agreements extends to enhancing worker welfare, safeguarding against unjust practices, preventing illegal actions, strengthening industrial relations, and reducing workplace disputes. Overall, the study highlights the urgent need for equitable balance in work contracts to ensure fair and just treatment of all parties involved

Abstract

In Bekasi City, HIV/AIDS cases are relatively high, and adolescents are said to be vulnerable to HIV/AIDS transmission. Hence, Dinas Pengendalian Penduduk dan Keluarga Berencana, Bekasi City, needs to carry out the prevention according to Bekasi Mayor Regulation Number 125 of 2021. This research aims to determine the implementation of the HIV/AIDS prevention law among adolescents in increasing youth resilience by Dinas Pengendalian Penduduk dan Keluarga Berencana, Bekasi City, and the factors that influence the implementation of it. This research is qualitative research with an empirical juridical approach and descriptive specifications. The research informants were 5 (five) people. Types and sources of data include primary data and secondary data. The results of the research show that the implementation of the law on preventing HIV/AIDS among adolescents has been implemented well as measured by 4 (four) parameters, namely setting targets for preventing HIV/AIDS among adolescents, establishing partnerships in preventing HIV/AIDS among adolescents, facilitating HIV/AIDS prevention among adolescents with partners and establish HIV/AIDS prevention activities. Factors that tend to influence the implementation of HIV/AIDS prevention law among adolescents in increasing youth resilience consist of supporting factors, which at least include regulations regarding HIV/AIDS prevention, the readiness of human resources to carry out activities, and the availability of adequate facilities, and inhibiting factors which at least include difficulty for partners to work together, psychological counselling services which are only available 1 (one) for all adolescents in Bekasi City and unequal funding.

Abstract

This research discusses the Legal Protection for Trademark Rights Holders for Similarities in Principal Based on Law Number 20 of 2016 concerning Trademarks and Geographical Indications in Supreme Court Decision No. 796 K/Pdt.Sus-Hki/2023 with Linda Anggraeningsih and Muhammad Shakeel as the Plaintiff and Defendant Parties and the legal consequences of the decision for the parties. The purpose of this research is to analyze whether the parties have received legal protection as trademark rights holders and also the legal consequences arising from the Supreme Court's decision. This research uses a normative juridical research approach method that relies on secondary data obtained through literature studies with qualitative normative methods. The results of research and discussion in this study can be concluded that Linda Anggraeningsih has not received legal protection for her Trademark Rights because the lawsuit she won in the Commercial Court was canceled by the Cassation Decision. Supreme Court Decision Number 796 K/Pdt.Sus-HKI/2023 canceled Decision Number 3/Pdt.Sus-Merek/2023/PN.Niaga.Jkt.Pst which results in Umamascarves Trademark is still entitled to produce and market its products because it remains validly registered in PDKI so that it gets legal protection for its trademark.

Abstract

This study aims to analyze the legal protection of Trademark rights under Law Number 20 of 2016 on Trademarks and Geographical Indications within the context of Supreme Court Decision Number 1349 K/Pdt.Sus-HKI/2022. This research employs a normative juridical research methodology with a case approach and analytical descriptive research specifications. Secondary data sources encompass primary, secondary, and tertiary legal materials. Data collection for this research utilizes library research methods, subsequently presented in the form of narrative texts, employing qualitative normative methods as a data analysis approach. Based on the discussions, it can be concluded that the Plaintiff, as the owner of the ERG Trademark, received limited legal protection for their Trademark rights in Supreme Court Decision Number 1349 K/Pdt.Sus-HKI/2022, which does not align with the provisions of Law Number 20 of 2016 on Trademarks and Geographical Indications

Abstract

Hospitals as health service institutions with legal entities are places that are prone to disputes. Article 60 Law no. 44 of 2009 assigned the Provincial Hospital Supervisory Board to receive complaints and make efforts to resolve disputes employing mediation. An analysis of the forms of hospital disputes and their settlement model through the Provincial Hospital Supervisory Board is very important to be done to avoid misinterpretation and provide legal certainty about who is the authorized party to handle them. The research method used was normative juridical and empirical juridical. The results of this study are to obtain an analysis of the forms of complaints that can be submitted to the Provincial Hospital Supervisory Board including disputes over hospitals as health service facilities where medical personnel and health workers provide health services that are detrimental to patients; disputes between the hospital as a health service facility and the patient as the recipient of health services related to the implementation of the obligations of both parties; disputes between the hospital as a legal entity and the hospital workforce related to internal management; the disputes between hospital as a legal entity and the third parties related to non-medical cooperation; the disputes between hospital as a legal entity and the environment. The hospital dispute resolution model implemented by the Provincial Hospital Supervisory Board of Yogyakarta includes the hospital dispute resolution model by the Provincial Hospital Supervisory Board in collaboration with hospitals, the Hospital Supervisory Board, Provincial Health Office, Provincial Legal Representatives (Ombudsman), YLKI, and PERSI.Keywords: Provincial Hospital Supervisory Board, Disputes Form, Dispute Settlement Model.
