Abstract

Begal, a criminal action in Banyumas committed by offenders with violent and new operandi mode create unrest in society. Critical problem lies in the lack of a comprehensive approach in the science of criminology and victimology approach to find the root of the cause and countermeasures consistently correlated with the cause. This study used a qualitative sociologic juridical approach. The focus of the study are the factors that influence the occurrence of crime robber, and mitigation in Banyumas Police, which is done by using the approach of criminology, victimology and police functions. Factors that influence the occurrence of crime robber in Banyumas Police in criminology perspective is the economic factor, social environmental offender, the crime scene as possible, the impersonation of evil robber in other regions (including the role of the media), and the persistence of the fence. As in the perspective of victimology is a behavioral factor victim, victim's biological and psychological weaknesses, and situation. Begal crime prevention that has been done in Banyumas Police comprehensive enough that prevention is pre-emptive, preventive and repersif. However, there are still some obstacles in its implementation so that the expected duties and functions of the police in tackling crime needs to be improved.Keywords: Prevention of crime, crime robber, victimology, crimonology.

Abstract

Population problems have broad dimensional aspects so that partnerships are needed with the formation of Population Coalition. Central Java Province is one of the provinces in Indonesia which has a Population Coalition based on Decree of the General Chairperson of the Indonesian Coalition for Population and Development Number: 002/SK/KK-PROV/III/2019. Therefore, it is very important to examine the implementation of Population Coalition policies and the factors that influence their implementation at the provincial level. This research is qualitative research with a sociological juridical approach. The results showed that the Population Coalition policies in Central Java Province have been implemented under collaboration with the Youth Population Coalition and various related institutions/stakeholders in strengthening the Population, Family Planning, and Family Development programs. The factors that influence the implementation of the Central Java Province Population Committee regulation, facilities, and infrastructure, as well as community and cultural factors that still do not care about population problems.Keywords: Policy, Population Coalition, Population Program, Family Planning, Family Development.

Abstract

The number of corruption cases in the state administration system is increasing year after year. One of corruption cases occurred in the state administration system is corruption case of village funds. This study aims to identify the roles of and the obstacles faced by Kuningan District Prosecutor’s Office investigators in disclosing corruption cases of village fund allocation. This qualitative study applied a sociological juridical research method in which the data is presented in a systematic description and is analyzed by employing qualitative data analysis method. The results showed that Kuningan District Prosecutor’s Office investigators as law enforcement officers have a significant role in disclosing corruption cases of village fund allocation, namely identifying the crime of corruption, carrying out actions (full data, full bucket), conducting investigation, checking the suspects’ identity, and conducting detention and searches. Further, there are some obstacles faced by Kuningan District Prosecutor’s Office investigators in disclosing corruption cases of village fund allocation, including the mismatch between regulations and actual practices in the field and the lack of human resources, facilities and infrastructures, and community roles. Peran Penyidik dalam Mengungkap Kasus Korupsi Alokasi Dana Desa di Wilayah Hukum Kabupaten Kuningan Angka kejadian korupsi dalam sistem penyelenggara negara masih mengalami peningkatan dari tahun ke tahun. Salah satu tindak pidana korupsi yang banyak terjadi dalam sistem penyelenggara negara adalah korupsi dana desa. Penelitian ini bertujuan untuk mengetahui peran dan hambatan penyidik Kejaksaan Negeri Kuningan dalam mengungkap kasus korupsi alokasi dana desa. Penelitian ini merupakan penelitian kualitatif dengan metode penelitian yuridis sosiologis. Data disajikan dalam uraian sistematis dan dianalisa dengan menggunakan metode analisis data kualitatif. Hasil penelitian ini menjelaskan bahwa penyidik Kejaksaan Negeri Kuningan sebagai aparat penegak hukum mempunyai peran yang sangat aktif dalam mengungkap kasus korupsi alokasi dana desa yaitu menemukan adanya tindak pidana korupsi, melakukan tindakan (full data full bucket), melakukan tindakan penyidikan, memeriksa identitas tersangka, melakukan penahanan dan penggeledahan. Terdapat beberapa hambatan yang dialami oleh penyidik kejaksaan dalam mengungkap kasus korupsi alokasi dana desa di antaranya ketidaksesuaian antara peraturan dengan tindakan di lapangan, kurangnya sumber daya manusia, fasillitas dan sarana yang belum memadai dan kurangnya peran masyarakat.

Abstract

Marriage Age Maturity, PUP is a BKKBN program which regulates the age maturity limit for marriage, a minimum of 20 years for women and a minimum of of 25 years for men. This provision differs from the minimum marriageable age stated in the marriage act. The importance of PUP program is to prepare the adolescents entering the ideal age of marriage in the context of creating a quality family and controlling the population. In this case, Purbalingga Regency has a high level of early marriage. Thus, the PUP program is highly needed to realize the ideal age of marriage. Accordingly, the purpose of this study is to know the implementation of PUP in realizing the population control and developing family in Purbalingga Regency as well as revealing the factors that influence its implementation. This study employed juridical-empirical and qualitative approaches. The findings revealed the implementation of PUP program in Purbalingga Regency was realized in the form of KIE (Information and Education Communication). This was carried out by Dinsos Dalduk KB P3A in collaboration with PIK-R/M, Duta Genre, government agencies such as the health office, KUA, Ministry of Religious Affairs, Rural areas community development, and the participation of PLKB. However, this program was not fully implemented. Meanwhile, regarding the factors that influence its implementation, a supporting factors covered the partnership cooperation and support from religious leader and the community. The inhibiting factors, on the other hand, covered legal factors, law enforcement, means and facilities, personal factors, and social factors.Pendewasaan Usia Perkawinan (PUP)  merupakan program BKKBN yang mengatur tentang  pendewasaan batas usia  perkawinan yaitu minimal 20 tahun bagi perempuan dan laki-laki minimal berusia 25 tahun, yang mana ketentuan tersebut berbeda dengan aturan batas usia perkawinan dalam Undang-Undang Perkawinan.  Pentingnya program PUP adalah untuk mempersiapkan remaja memasuki usia  perkawinan yang ideal dalam rangka membentuk keluarga berkualitas dan sarana sarana pengendalian penduduk. Kabupaten Purbalingga mempunyai tingkat perkawinan muda nya tinggi sehingga program PUP sangat dibutuhkan untuk mewujudkan usia perkawinan yang ideal. Penelitian ini bertujuan mengetahui implementasi Program PUP guna mewujudkan pengendalian penduduk dan pembangunan keluarga di Kabupaten Purbalingga dan faktor yang mempengaruhi implementasi dengan menggunakan metode penelitian yuridis empiris dan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa implementasi program PUP di Kabupaten Purbalingga dilakukan dalam bentuk KIE (Komunikasi Informasi dan Edukasi) oleh Dinsos Dalduk KB P3A bekerja sama dengan PIK-R/M, Duta Gendre, instansi pemerintah seperti Dinas Kesehatan, KUA, Kementerian Agama, pembinaan institusi masyarakat pedesaan, peran serta PLKB. Namun program PUP tersebut masih belum  terlaksana  secara menyeluruh. Adapun faktor –faktor yang mempengaruhi implementasi berupa faktor pendukung yaitu kerja sama kemitraan dan dukungan para tokoh agama dan masyarakat sedangkan faktor menghambatnya berupa  faktor hukum, penegak hukum, sarana dan fasilitas,  faktor  personal, faktor sosial

Abstract

Traditional health services in Indonesia have been regulated in the Law No. 36 of 2009 about Health and in Government Regulation No. 103 of 2014 specifically. This paper is intended to discuss the legal protection of traditional health services and its forms. This study applies normative juridical methods. The results show that the level of legal protection for traditional health services is empirically lower than complementary and integration. This is proven by the absence of the right to obtain legal protection for traditional empirical health services. The legality of traditional empirical health services is only attested by Traditional Health Registered Letters (STPT) while complementary and integration is attested by a Certificate of Traditional Health Worker Registration (STRTKT) and Practice Permit Traditional Health Workers (SIPTKT).

Abstract

Cybercrime has resulted in astronomical losses for the business community. However, the reactive policy model must be more effective at preventing cybercrime, and the due process model is also inappropriate for combating cybercrime with a high level of speed and mobility. This study is normative legal research employing a conceptual strategy and case studies. The results indicate that the reactive model must be improved in order to prevent cybercrime. The model of due process is not appropriate for deterring cybercrime with a high degree of speed and mobility. The preventative law enforcement strategy is effective, but it requires a high level of law enforcement capability to detect and disable cybercrime, which is something that few Indonesian law enforcement officials possess. Prevention based on the user, which places responsibility on internet users, is fine for individuals but not for businesses. Based on collaboration between corporations, universities, civic society, and non-governmental groups, the collaborative model synthesizes the aforementioned paradigms. Because they are based on plans or roadmaps created by internet stakeholders, regulations, technical aspects, and law enforcement may be effectively implemented and developed.

Abstract

Hospitals as health service institutions with legal entities are places that are prone to disputes. Article 60 Law no. 44 of 2009 assigned the Provincial Hospital Supervisory Board to receive complaints and make efforts to resolve disputes employing mediation. An analysis of the forms of hospital disputes and their settlement model through the Provincial Hospital Supervisory Board is very important to be done to avoid misinterpretation and provide legal certainty about who is the authorized party to handle them. The research method used was normative juridical and empirical juridical. The results of this study are to obtain an analysis of the forms of complaints that can be submitted to the Provincial Hospital Supervisory Board including disputes over hospitals as health service facilities where medical personnel and health workers provide health services that are detrimental to patients; disputes between the hospital as a health service facility and the patient as the recipient of health services related to the implementation of the obligations of both parties; disputes between the hospital as a legal entity and the hospital workforce related to internal management; the disputes between hospital as a legal entity and the third parties related to non-medical cooperation; the disputes between hospital as a legal entity and the environment. The hospital dispute resolution model implemented by the Provincial Hospital Supervisory Board of Yogyakarta includes the hospital dispute resolution model by the Provincial Hospital Supervisory Board in collaboration with hospitals, the Hospital Supervisory Board, Provincial Health Office, Provincial Legal Representatives (Ombudsman), YLKI, and PERSI.Keywords: Provincial Hospital Supervisory Board, Disputes Form, Dispute Settlement Model.

Abstract

Desa Binaan merupakan program unggulan Unsoed. Desa Suro sebagai Desa binaan unsoed yang sudah 3 tahun , bersinergi dengan LAZ alirsyad dalam transfer ipteks. Tahun ke 3 melanjutkan program tahun pertama, dan ke dua , yaitu Tim pengabdi bersama masyarakat akan memberdayakan masyarakat untuk melanjutkan kegiatan agar bisa meningkatkan kesejahteraan di Desa Suro. . Ada dua permasalahan yang akan menjadi prioritas bagi LPPM, yang pertama banyaknya usia produktif yang tidak bekerja dan tidak melanjutkan sekolah. Yang ke dua yaitu Desa Suro merupakan penghasil singkong terbesar ke tiga di Kabupaten Banyumas. Permaslahanya adalah setiap panen raya petani mengalami kerugian. Hal ini dikarenakan singkong tidak tahan lama, harga penjualan singkongpun mengalami penurunan yang sangat drastis. Untuk membantu petani dalam mempertahankan harga, program ini akan melakukan pemberdayaan pengolahan singkong secara optimal menjadi tepung moccaf, sehingga di butuhkan tenaga ahli yang akan melakukan transfer ipteks dan dan alat untuk memproses singkong menjadi produk tepung Upaya yang dilakukan Tim melakukan transfer iptek, melalui sosialisasi, pelatihan, praktik dan kunjungan ke kelompok usaha rumah Mocaf di Banjar negara yang sudah berhasil dalam mempertahan kan harga dan mengolah singkong yang mempunyai nilai ekonomis. . Melalui Program desa Binaan ini yang dilakukan LPPM Unsoed bersinergi dengan mitra yang selama ini sudah mendampingi desa Suro, diharapkan dapat memberi solusi terhadap permasalahan yang dihadapi desa Suro, dapat, mengurangi kerugian dan mempertahankan harga yang sangat rendah pada saat panen raya singkong, dan ada akhirnya dapat meningkatkan penghasilan warga.

Abstract

Pembuktian adalah hal terpenting dalam hukum acara pidana dimana dalam suatu pembuktian akan ditentukan hukuman serta nasib yang akan diterima oleh seorang terdakwa dalam suatu persidangan sebagai akibat dari perbuatannya. Dalam suatu pembuktian hak-hak asasi serta nasib seorang terdakwa benar-benar akan ditentukan sehingga dalam pelaksanaan pembuktian harus sesuai dengan Undang- Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana agar terdakwa benar- benar mendapat hukuman sesuai dengan perbuatannya yang dengan seadil-adilnya hingga tidak memberatkan maupun meringankannya. Pembuktian Tindak Pidana Perkosaan terhadap Anak dalam Putusan Pengadilan Negeri Ternate Nomor 165/Pid.Sus/2017/PNTnr perlu dilihat bagaimana pembuktiannya dalam putusan tersebut serta apa akibat hukum yang timbul dari putusan tersebut bagi terdakwa. Dalam Pembuktian Tindak Pidana Perkosaan terhadap Anak dalam Putusan Pengadilan Negeri Ternate Nomor 165/Pid.Sus/2017/PNTnr terdapat tiga alat bukti sehingga sudah melebihi batas minimal pembuktian menurut Pasal 183 KUHAP yaitu minimal terdapat dua alat bukti yang sah disertai dengan adanya keyakinan hakim, alat bukti yang terdapat dalam putusan adalah keterangan saksi yang terdiri dari 3 orang saksi, alat bukti surat Visum Et Repertum, dan alat bukti keterangan terdakwa, yang mana dengan ini sudah melebihi batas minimum pembuktian yaitu dua alat bukti menurut Pasal 183 KUHAP. Dan setelah alat-alat bukti tersebut dihubungkan dengan unsur-unsur yang ada dalam Pasal 287 KUHP hakim memperoleh keyakinan bahwa terdakwa terbukti bersalah melakukan tindak pidana perkosaan terhadap anak dan akibat hukum dari putusan tersebut kepada terdakwa adalah jatuhnya putusan pemidanaan yang dimana akan menghukum terdakwa atas perbuatannya melakukan tindak pidana perkosaan terhadap anak.Kata Kunci : Pembuktian, Tindak Pidana Perkosaa nAnak, Akibat Hukum

Abstract

Penelitian ini bertujuan untuk mengetahui tingkat kesadaran hukum masyarakat terhadap manfaat Kartu Identitas Anak (KIA) dalam pelayanan administrasi kependudukan dan pengaruh faktor pendidikan, faktor kedisiplinan dan faktor motivasi terhadap kesadaran hukum masyarakat tentang manfaat Kartu Identitas Anak (KIA) di Desa Palabuan, Kec.Sukahaji, Kab. Majalengka. Penelitian ini menggunakan metode penelitian kuantitatif dengan pendekatan yuridis sosiologis dan spesifikasi penelitian deskriptif. Penelitian ini mengambil lokasi di Desa Palabuan, Kec. Sukahaji, Kab. Majalengka dengan responden sebanyak 40 warga. Pengambilan sampel penelitian menggunakan multistage random sampling. Jenis dan sumber data meliputi data primer dan data sekunder yang diperoleh dengan metode angket, dokumenter dan kepustakaan. Data yang terkumpul diolah dengan menggunakan metode coding, editing, dan tabulasi serta dianalisis dengan distribusi frekuensi analisis, tabel silang analisis, analisis isi dan analisis perbandingan. Hasil penelitian menunjukkan bahwa tingkat kesadaran hukum masyarakat terhadap manfaat Kartu Identitas Anak (KIA) dalam pelayanan administrasi kependudukan di Desa Palabuan, Kec. Sukahaji, Kab. Majalengka adalah sedang. Hal ini dibuktikan dengan hasil penelitian terhadap 4 (empat) indikator meliputi tingginya pengetahuan hukum masyarakat, tingginya pemahaman hukum masyarakat, banyaknya sikap hukum masyarakat yang kurang setuju, dan banyaknya perilaku hukum masyarakat yang kurang sesuai terhadap manfaat Kartu Identitas Anak (KIA) dalam pelayanan administrasi kependudukan. Faktor pendidikan cenderung tidak berpengaruh terhadap tingkat kesadaran hukum masyarakat tentang manfaat Kartu Identitas Anak (KIA), sedangkan faktor kedisiplinan dan faktor motivasi cenderung berpengaruh secara positif terhadap tingkat kesadaran hukum masyarakat tentang manfaat Kartu Identitas Anak  (KIA) dalam pelayanan administrasi kependudukan. Kata Kunci: Kartu Identitas Anak (KIA); Kedisiplinan; Kesadaran Hukum Masyarakat; Motivasi; Pendidikan
