Abstract

In ASEAN and the EU, there is a social problem that underlies a similar problem that occurred in ASEAN and the EU regarding the authority of regional human rights institutions in deciding a case of human rights violations. ASEAN also does not have an independent judicial institution that functions to enforce human rights law independently. These factors are certainly an obstacle in the enforcement and protection of human rights in ASEAN in particular. This is different from the EU which has a more integrative law enforcement mechanism. In terms of upholding and protecting human rights, the EU has the European Court of Human Rights (ECHR). The judicial institution has a function to ensure that the human rights of the EU people are not violated and give the EU community the right to be heard in court for cases of human rights violations experienced.

Abstract

The land sale and purchase dispute in this case drags the seller who has sold the same object to two buyers in two transactions. The second buyer (plaintiff) filed a lawsuit against the first buyer (Defendant II). The legal position is a dilemma. Both buyers feel they have rights to the disputed land because they have purchased the same object from the seller. To prove who the right buyer is, the judge needs to consider the principle of "good faith" as the basis for determining the buyer who deserves legal protection. The problem is, both buyers claim that they are buyers with good intentions. In protecting parties with good intentions in an agreement, regulations are needed that can provide legal certainty. In 2016 the Supreme Court held a plenary meeting and issued a Supreme Court Circular Number 4 of 2016, which provides a formulation regarding the criteria for buyers who have good intentions in purchasing land. In this study, it examines the first, the implementation of the Supreme Court Circular No. 4 of 2016 in court decisions. Second, the consideration of judges in deciding cases related to buyers in good faith is in accordance with applicable regulations. This type of research is normative research.

Abstract

The study aims to determine the extent of the Indonesian Government's efforts to provide protection of Human Rights (HAM) in order to remain firmly adhered to the values of Pancasila. This research method is normative juridical, with a statutory approach using data analysis techniques and processing the results of primary material collection and secondary material collection. Novelty of this research provides a more comprehensive view of efforts to restore and improve human rights enforcement in post-New Order Indonesia, especially in the face of human rights violations that remain unresolved, such as the Tanjung Priok, Aceh, Semanggi, East Timor and Papua cases. This study also offers a solution based on Pancasila values as the basis for making legal policies, which have not been thoroughly applied by the government in law enforcement practices in Indonesia. The study results show that human rights enforcement in Indonesia is still far from the true meaning of justice, because it is still influenced by the interests of the authorities, law enforcement officials, and so on. Included in the enforcement of human rights is also still very far away from the values of Pancasila. Conclusion of this paper is that all formulations and policies of the State must be guided by the values of Pancasila, especially in the enforcement of human rights in Indonesia, although many cases that occur in law enforcement do not reflect Pancasila as the identity of the nation.

Abstract

The role of local governments in realizing a welfare state is very large, this is because the Indonesian state with the concept of a unitary state chooses the principle of decentralization, so that local governments are given government affairs by the central government known as regional autonomy, but regional autonomy is very difficult to avoid corrupt practices carried out by regional officials, even this corruption is a big enemy that often haunts local governments. This is due to the role of internal government supervisors is not strong, even existing as subordinate to regional heads. The problem is how to reconstruct the peerintahan surveillance system in the regions. This study aims to analyze the local government supervision system, this type of research is a discriptive analysis, using a statutory approach (statute approach) and a conceptual approach (conceptual approach). The results of this study in order to reduce the occurrence of corruption in local governments are by strengthening the local government supervision system, including; First, the government's internal supervisory apparatus must be strengthened by law. Second, Paran DPRD must also be restored as the teaching of Montesque's trias politica, namely its role as a control of local government in order to realize Checks and Balances. Third, Public Participation also has an important role to prevent corrupt practices in local governments, because in a democratic country without public participation it will be difficult to realize good local governance.

Abstract

The position of Extraordinary Members (Anggota Luar Biasa/ALB) of the Indonesian Notary Association (INI) as Substitute Notaries during internship activities carries strategic significance and legal implications. ALBs who have fulfilled the necessary requirements may be appointed to temporarily carry out a notary’s duties, offering them valuable experience and skill development. This study seeks to examine the legal standing of ALBs in such roles and how these internship activities are implemented. Employing a normative juridical approach, the research is based on Law Number 2 of 2014 concerning the Position of Notaries and the notary profession's code of ethics. The findings show that although ALBs possess limited authority, they are legally accountable for every deed they produce during their appointment. Each notarial deed must explicitly mention the status of the ALB as a Substitute Notary, in accordance with the applicable legal provisions. Any deviation from proper procedures can lead to the deed being legally defective or declared null and void. Therefore, the role of ALBs as Substitute Notaries must be exercised with caution and adherence to professional ethics. In addition, the position of ALBs in internship activities as Substitute Notaries also influences the violations committed as substitute notaries.

Abstract

This research analyzes the legal implications of issuing banking covernotes without authentic deeds, focusing on notary responsibility and consumer protection in Indonesia. Using a normative juridical method, this study examines regulations, legal principles, and relevant case studies to address the normative vacuum surrounding covernotes. The findings indicate that while covernotes function to expedite credit disbursement pending the completion of mortgage certificates, they lack the executory legal force of authentic deeds. Consequently, covernotes serve primarily as moral guarantees, leaving banks vulnerable during debtor defaults and exposing debtors to legal uncertainty regarding collateral status. The absence of specific regulations in the Notary Law (UUJN) creates significant risks for all parties. The study highlights that notaries bear full liability for the content of covernotes; negligence or falsification of information can lead to civil lawsuits for unlawful acts, administrative sanctions, and criminal charges for forgery. From a consumer protection perspective, the current reliance on covernotes places debtors in a weak position due to information asymmetry and a lack of binding legal protection. The research concludes that specific regulations are urgently needed to clarify the legal standing of covernotes, ensuring that the efficiency of banking transactions does not compromise legal certainty and justice for consumers and creditors alike

Abstract

The village head election (pilkades) represents a form of local democracy that ideally provides rural communities the means to directly choose their leaders. However, in Bangkalan Regency, pilkades are frequently marred by political conflicts leading to violence and fatalities. This phenomenon presents serious challenges in law enforcement, healthy democratic practices, and the protection of human rights at the local level. This study aims to analyze the dynamics of violent culture within pilkades in Bangkalan and assess the effectiveness of existing regulations in preventing and addressing these conflicts. The socio-legal approach is applied, supported by case studies of violent incidents in pilkades. The discussion focuses on regulatory weaknesses governing pilkades, ineffective law enforcement by the police and judicial institutions, as well as the role of money politics and the lack of government officials' neutrality that exacerbates the situation. Furthermore, this research highlights the influence of local culture, which tends to legitimize violence in political rivalry. The findings reveal that the interaction between strong political influence, personalized campaigns, and local culture creates significant challenges in maintaining electoral integrity. Political actors often resort to intimidation and money politics, increasing the risk of violence. Local governments must collaborate with law enforcement agencies, educate the public, and implement consistent oversight and legal enforcement. In regions like Madura, a culture of violence and patronage intensifies conflicts. A culturally sensitive legal approach, monitoring of violent actors, and community empowerment are critical to fostering peaceful, fair, and democratic elections.

Abstract

This study explores the effectiveness of community-driven governance in managing natural resources in post-conflict rural areas. The object of research focuses on governance models in the departments of Caquetá and Cesar, Colombia, where community-based initiatives have been implemented to address socio-environmental challenges. The main problem identified is the limited success of top-down regulatory approaches in promoting sustainability and legal compliance in these regions. The primary objective of the research is to assess the role of local participation in improving governance outcomes. To achieve this, the study employs a qualitative approach, using case studies and interviews to gather data from local stakeholders involved in natural resource management. The main findings suggest that community-driven governance models significantly enhance legal protection for public resources, fostering stronger compliance with environmental regulations and promoting sustainable practices. These models empower local communities, increase their engagement in decision-making, and improve the long-term management of resources. The research concludes that integrating community-driven approaches into national and regional legal frameworks is essential for achieving more effective and sustainable environmental governance. These findings contribute to the understanding of how governance can be adapted to better address the needs of vulnerable communities in post-conflict settings.

Abstract

This research aims to analyze decision Number 203/Pdt.P/2023/PA.SJJ regarding granting marriage dispensations against the increasing number of household divorces. The research method used is normative juridical with a case approach. Data collection was carried out through literature study. The results of the research show that the granting of marriage dispensation by the Sijunjung Religious Court in decision Number 203/Pdt.P/2023/PA.SJJ was based on the judge's consideration that the Petitioners' petition did not conflict with statutory regulations, customary law, local wisdom, or religion and All decisions have gone through an ongoing legal process involving both families of the prospective bride and groom, both people. However, granting a marriage dispensation must still take into account aspects of the mental, physical and economic readiness of the prospective bride and groom. Apart from that, there needs to be preventive efforts from the government and society to reduce the number of underage marriages and requests for marriage dispensations, so as to reduce the number of household divorces, especially at an early age.
