Abstract

In ASEAN and the EU, there is a social problem that underlies a similar problem that occurred in ASEAN and the EU regarding the authority of regional human rights institutions in deciding a case of human rights violations. ASEAN also does not have an independent judicial institution that functions to enforce human rights law independently. These factors are certainly an obstacle in the enforcement and protection of human rights in ASEAN in particular. This is different from the EU which has a more integrative law enforcement mechanism. In terms of upholding and protecting human rights, the EU has the European Court of Human Rights (ECHR). The judicial institution has a function to ensure that the human rights of the EU people are not violated and give the EU community the right to be heard in court for cases of human rights violations experienced.

Abstract

This research aims to analyze decision Number 203/Pdt.P/2023/PA.SJJ regarding granting marriage dispensations against the increasing number of household divorces. The research method used is normative juridical with a case approach. Data collection was carried out through literature study. The results of the research show that the granting of marriage dispensation by the Sijunjung Religious Court in decision Number 203/Pdt.P/2023/PA.SJJ was based on the judge's consideration that the Petitioners' petition did not conflict with statutory regulations, customary law, local wisdom, or religion and All decisions have gone through an ongoing legal process involving both families of the prospective bride and groom, both people. However, granting a marriage dispensation must still take into account aspects of the mental, physical and economic readiness of the prospective bride and groom. Apart from that, there needs to be preventive efforts from the government and society to reduce the number of underage marriages and requests for marriage dispensations, so as to reduce the number of household divorces, especially at an early age.

Abstract

The land sale and purchase dispute in this case drags the seller who has sold the same object to two buyers in two transactions. The second buyer (plaintiff) filed a lawsuit against the first buyer (Defendant II). The legal position is a dilemma. Both buyers feel they have rights to the disputed land because they have purchased the same object from the seller. To prove who the right buyer is, the judge needs to consider the principle of "good faith" as the basis for determining the buyer who deserves legal protection. The problem is, both buyers claim that they are buyers with good intentions. In protecting parties with good intentions in an agreement, regulations are needed that can provide legal certainty. In 2016 the Supreme Court held a plenary meeting and issued a Supreme Court Circular Number 4 of 2016, which provides a formulation regarding the criteria for buyers who have good intentions in purchasing land. In this study, it examines the first, the implementation of the Supreme Court Circular No. 4 of 2016 in court decisions. Second, the consideration of judges in deciding cases related to buyers in good faith is in accordance with applicable regulations. This type of research is normative research.

Abstract

Peran pemerintah daerah dalam mewujudkan negara kesejahteraan sangat besar, hal ini dikarenakan negara Indonesia dengan konsep negara kesatuan memilih asas desentralisasi, sehingga pemerintah daerah diberikan urusan pemerintahan oleh pemerintah pusat yang dikenal dengan istilah otonomi daerah, namun otonomi daerah sangat sulit terhindar dari praktik korupsi yang dilakukan oleh pejabat daerah, bahkan korupsi ini menjadi musuh besar yang sering menghantui pemerintah daerah. Hal ini disebabkan karena peran pengawas internal pemerintah tidak kuat, bahkan yang ada adalah sebagai bawahan dari kepala daerah. Permasalahannya adalah bagaimana merekonstruksi sistem pengawasan pemerintahan di daerah. Penelitian ini bertujuan untuk menganalisis sistem pengawasan pemerintah daerah, jenis penelitian ini adalah deskriptif analisis, dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil dari penelitian ini dalam rangka mengurangi terjadinya korupsi di pemerintah daerah adalah dengan cara memperkuat sistem pengawasan pemerintah daerah, antara lain; Pertama, aparat pengawas internal pemerintah harus diperkuat dengan undang-undang. Kedua, Paran DPRD juga harus dikembalikan sebagaimana ajaran trias politica Montesque, yaitu perannya sebagai kontrol terhadap pemerintah daerah dalam rangka mewujudkan Checks and Balances. Ketiga, Partisipasi Masyarakat juga memiliki peran penting untuk mencegah terjadinya praktik korupsi di pemerintahan daerah, karena dalam negara demokrasi tanpa adanya partisipasi masyarakat maka akan sulit untuk mewujudkan tata kelola pemerintahan daerah yang baik.     The role of local governments in realizing a welfare state is very large, this is because the Indonesian state with the concept of a unitary state chooses the principle of decentralization, so that local governments are given government affairs by the central government known as regional autonomy, but regional autonomy is very difficult to avoid corrupt practices carried out by regional officials, even this corruption is a big enemy that often haunts local governments. This is due to the role of internal government supervisors is not strong, even existing as subordinate to regional heads. The problem is how to reconstruct the peerintahan surveillance system in the regions. This study aims to analyze the local government supervision system, this type of research is a discriptive analysis, using a statutory approach (statute approach) and a conceptual approach (conceptual approach). The results of this study in order to reduce the occurrence of corruption in local governments are by strengthening the local government supervision system, including; First, the government's internal supervisory apparatus must be strengthened by law. Second, Paran DPRD must also be restored as the teaching of Montesque's trias politica, namely its role as a control of local government in order to realize Checks and Balances. Third, Public Participation also has an important role to prevent corrupt practices in local governments, because in a democratic country without public participation it will be difficult to realize good local governance.

Abstract

The study aims to determine the extent of the Indonesian Government's efforts to provide protection of Human Rights (HAM) in order to remain firmly adhered to the values of Pancasila. This research method is normative juridical, with a statutory approach using data analysis techniques and processing the results of primary material collection and secondary material collection. Novelty of this research provides a more comprehensive view of efforts to restore and improve human rights enforcement in post-New Order Indonesia, especially in the face of human rights violations that remain unresolved, such as the Tanjung Priok, Aceh, Semanggi, East Timor and Papua cases. This study also offers a solution based on Pancasila values as the basis for making legal policies, which have not been thoroughly applied by the government in law enforcement practices in Indonesia. The study results show that human rights enforcement in Indonesia is still far from the true meaning of justice, because it is still influenced by the interests of the authorities, law enforcement officials, and so on. Included in the enforcement of human rights is also still very far away from the values of Pancasila. Conclusion of this paper is that all formulations and policies of the State must be guided by the values of Pancasila, especially in the enforcement of human rights in Indonesia, although many cases that occur in law enforcement do not reflect Pancasila as the identity of the nation.
