Abstract

Joint assets are assets acquired during marriage outside of gifts or inheritance. What this means is the assets obtained through the efforts of the husband and wife during the marriage before the divorce occurred. Based on the positive book that applies in Indonesia, joint property in marriage is contained in Law number 1 of 1974, whereas in Islamic law there are no regulations. The purpose of this research is to find out what the judge's decision was in joint property case No. 177/Pdt.G/2023/Pa.Kng and No. 763/Pdt.G/2023/PA.Kng, how Islamic law and positive law review the decision and to analyze the results of the comparison between Islamic law and positive law on the judge's decision in joint property case No. 177/Pdt.G/2023/Pa.Kng and No. 763/Pdt.G/2023/PA.Kng This research uses qualitative methods with a descriptive data collection approach. The type of research used is field research. The data sources used are primary and secondary data sources. The data collection techniques used were interviews and documentation. The research instruments used were interview guides and documentation formats. The data analysis technique used is qualitative data analysis. The data that the author obtained was then reduced, presented and concluded using comparative descriptive analysis techniques. The conclusion in this research is that based on the decision of the Panel of Judges it can be concluded that from the various considerations that have been made, in case No. 177/Pdt.G/2023/Pa.Kng The Hakım Council did not accept the joint property lawsuit because the lawsuit submitted could not be clearly proven regarding the status and specifications of the joint property. Meanwhile, in case No. 763/Pdt.G/2023/PA.Kng The Panel of Judges accepted the joint property lawsuit because each party had agreed to divide the joint property into two parts. Judging from Islamic law and positive law, sourced from the Al-Qur'an Surah Ah-Imran verse 159, Al-Maidah verse 1, Qaidah Fiqh "Harm must be eliminated" and the Civil Code, the decision not to accept joint property entitlement in the case No. 177/Pdt.G/2023/Pa.Kng and the decision to accept the joint property claim in case No. 763/Pdt.G/2023/PA.Kng is permitted because it is in accordance with Islamic law and positive law. Based on the comparison results, it can be concluded that the judge's decision regarding the joint property dispute in case No. 177/Pdt.G/2023/Pa.Kng and No. 763/Pdt.G/2023/PA.Kng both according to Islamic law and positive law, the decision of the Panel of Judges not to accept and accept the joint property claim is appropriate.

Abstract

The issue with the research is that it attempts to examine the administrative openness of the Libyan Ministry of Health from an Islamic point of view. The purpose of this research is to determine, from an Islamic point of view, how transparent the administrative processes of the Libyan Ministry of Health are. The objective also is to determine the factors that contribute to administrative openness as well as the obstacles that stand in the way of administrative transparency. The technique that was used in this research was an analytical descriptive one, and it was aimed at describing and analysing the administrative transparency of the Libyan Ministry of Health from an Islamic view. The findings demonstrated that the Islamic viewpoint of administrative openness centered on honesty and the practical application of the principles of honesty and integrity for the purpose of appeasing Allah. According to the findings of the research, established norms of administrative openness should be rapidly agreed upon and implemented in all institutions under the jurisdiction of the Libyan government. ِ The implications of study indicates the Islamic perspective of administrative transparency on the ministry of health in Libya.

Abstract

Jual beli merupakan sebuah perikatan antara penjual dan pembeli untuk memindahkan kepemilikan dengan cara pertukaran. Dalam praktik jual beli yang dilakukan masyarakat, banyak obyek yang dijadikan sasaran jual beli contohnya jual beli lapak pedagang kaki lima. Di Pasar Malangbong juga terdapat jual beli lapak pedagang kaki lima. Pada praktiknya lapak yang dibeli oleh pedagang terkadang di tempati dengan cara cuma-cuma karena adanya perubahan bangunan Pasar dan mereka tidak mempunyai hak atas lapak tersebut sehingga ditemukan bahwa status kepemilikan lapak tersebut tidak dimiliki oleh pedagang. Maka dari itu rumusan masalah yang akan dibahas oleh peneliti adalah bagaimana proses pelaksanaan jual beli lapak di Pasar Malangbong, Kecamatan Malangbong, Kabupaten Garut dan bagaimana tinjauan Hukum Islam terhadap pelaksanaan jual beli lapak di Pasar Malangbong Kecamatan Malangbong Kabupaten Malangbong. Sehingga tujuan penelitian ini adalah untuk menjawab kedua pertanyaan sebelumnya. Metode penelitian yang digunakan oleh peneliti adalah metode penelitian kualitatif. jenis data pada penelitian ini bersifat deskriptif kualitatif, data yang diperoleh pada penelitian ini bersumber dari wawancara, observasi, dan dokumentasi. Setelah itu proses analisis data yang digunakan pada penelitian adalah pengumpulan data, pengolahan data, penyajian data, dan penarikan kesimpulan. Berdasarkan hasil peneliti yang dilakukan di Pasar Malangbong, bahwa lapak Pasar tersebut adalah milik pemerintah dan tidak dimiliki perorangan. Sehingga pada dasarnya pedagang boleh menempati tanpa membeli. Namun pada kenyataannya terjadi praktik jual beli lapak Pasar yang dilakukan oknum luar kepada pedagang secara sembunyi-sembunyi dengan adanya ancaman yang di berikan penjual kepada pembeli. Dalam hal ini, praktik jual beli lapak Pasar belum sesuai dengan tinjauan Hukum Islam dan termasuk jual beli yang dilarang, baik oleh pemerintah maupun dalam agama Islam.

Abstract

Gadai merupakan praktik muamalah yang saat ini sedang ramai dilakukan oleh masyarakat. Akan tetapi terdapat permasalahan yaitu dalam penentuan objek gadai, yang berbeda hukum dalam Kitab Undang-Undang Hukum Perdata dan Kompilasi Hukum Ekonomi Syariah, di mana objek gadai pada Pasal 1150 Kitab Undang-Undang Hukum Perdata mengatur tentang objek yaitu hanya benda bergerak yang dapat dijadikan objek gadai, sedangkan dalam Pasal 376 Kompilasi Hukum Ekonomi Syariah yang mengatur tentang marhun atau objek gadai yaitu harus bernilai atau memiliki nilai rupiah. Adapun permasalahan dalam penelitian ini adalah bagaimana perbedaan dan persamaan objek gadai dalam KUHPerdata dan KHES serta bagaimana hukum masing-masing objek gadai menurut KUHPerdata dan KHES. Penelitian ini bertujuan untuk meneliti komparasi hukum objek gadai dalam Kitab Undang-Undang Hukum Perdata dan Kompilasi Hukum Ekonomi Syariah (Pasal 1150 KUHPerdata & Pasal 376 KHES). Penelitian ini menggunakan metode kepustakaan (library research) dan teknik dokumentasi. Selanjutnya data yang diperoleh diolah secara kualitatif dengan reduksi data (data reduction), penyajian data (data display), dan terakhir penarikan kesimpulan serta verifikasi untuk mencapai tujuan penelitian. Hasil penelitian ini adalah persamaan objek gadai dalam KUHPerdata dan KHES bahwa penyerahan objek gadai itu saat akad berlangsung, pemberi gadai bertanggung jawab atas biaya perawatan barang, si penerima gadai harus bertanggung jawab atas barang tersebut, si penerima gadai berhak menahan barang sampai lunas hutangnya, dan si penerima gadai mengingatka n kembali jika sudah jatuh tempo. Kemudian perbedaan objek gadai dalam KUHPerdata dan KHES yaitu objek gadai dalam KUHPerdata hanya benda bergerak saja sedangkan dalam KHES marhun yaitu semua benda yang bernilai atau yang mempunyai nilai rupiah. Dari persamaan dan perbedaan tersebut dapat diambil hukum yang menjelaskan masing-masing objek gadai.

Abstract

Prenuptial agreement adalah perjanjian pranikah yang dibuat oleh pasangan yang akan menikah sebelum melangsungkan pernikahan yang isinya diserahkan kembali kepada pasangan tersebut, baik berupa kewajiban suami istri ataupun perjanjian lain selama tidak melanggar norma agama, norma hukum, norma kesusilaan, dan adat istiadat. Prenuptial agreement di Indonesia masih dianggap tabu dan tidak lumrah dilakukan karena membahas tentang hak dan kewajiban suami istri serta pembagian dan pemisahan harta, juga dianggap bukan budaya ketimuran yang mengedepankan kekeluargaan dan sensibilitas. Fenomena tersebut perlu untuk diteliti mengenai relevansi dan status hukumnya dalam Hukum Islam. Oleh karena itu, penelitian ini bertujuan untuk mengetahui bagaimana praktik prenuptial agreement dengan mengambil studi kasus di Kecamatan Kramatmulya, dan bagaimana status hukum serta relevansinya dengan Hukum Islam. Metode penelitian yang digunakan adalah penelitian kualitatif dengan menggabungkan dua jenis data, yaitu data yang diperoleh dari penelitian lapangan (field research) berupa wawancara dan data  kepustakaan (library research) yang berasal dari buku-buku maupun artikel jurnal. Teknik pengumpulan data yang digunakan pada penelitian ini adalah library research (tinjauan kepustakaan), wawancara serta dokumentasi. Wawancara dilakukan terhadap pasangan yang sudah menikah yang ada di Kecamatan Kramatmulya secara purposive sampling. Semua sumber data yang penulis peroleh, kemudian direduksi, disajikan, dan disimpulkan dengan menggunakan teknik analisis deskriptif. Dari hasil penelitian yang penulis lakukan di Kecamatan Kramatmulya Kabupaten Kuningan dapat disimpulkan bahwa terdapat 2 pasangan yang melaksanakan prenuptial agreement yang isinya berupa hak dan kewajiban suami istri, tempat tinggal ketika sudah menikah, izin istri untuk bekerja dan melanjutkan pendidikan, hak asuh anak, perselingkuhan serta finansial. Namun prenuptial agreement tersebut tidak dituliskan dan tidak didaftarkan di notaris ataupun pegawai pencatat nikah sehingga tidak memiliki kekuatan hukum. Dalam perspektif Hukum Islam prenuptial agreement hukumnya mubah, dan praktek prenuptial agreement yang ada di Kecamatan Kramatmulya tidak bertentangan dan relevan dengan hukum Islam meskipun tidak dituliskan tetapi prenuptial agreement tersebut diekspresikan dalam bentuk lisan, serta  prenuptial agreement wajib untuk dipenuhi.

Abstract

The Islamic perspective on the veil is bound and limited by the concept of aurat. Some scholars view the face as not part of the aurat, therefore the face does not have to be covered with a veil. Others see and conclude that the face is a woman's private parts, so it is mandatory for women to cover their faces with a veil. Cultural, social and political perspectives also follow the veil trend in society. This research aims to look at the motivation for using the veil as practiced by students at the Faculty of Sharia and Law (FSH) UIN Ar-Raniry. Next, these motivations are analyzed with a review of Islamic law and culture. The determination of locus is because FSH students are well-known (familiar) with legal matters, so the use of the veil should at least be considered based on a scientific approach. Apart from that, we want to get a detailed and detailed picture of the laws of the veil and the various responses to its use in society. There were ten female students who wore the niqab who were interviewed for several different reasons. The results obtained are related to the motivation to use the veil among students because (1) they follow along with seniors without knowing the reasons and urgency in more depth; (2) often take part in studies, because wearing the veil is understood as sunnah and is inspired by other people.

Abstract

Background: The problem with the study is that the problem of bank liquidity in Libyan Islamic banks is exacerbated by the excess of bank liquidity coverage. (2): Purpose: The study aims to learn about Libyan banks' experience in reducing bank liquidity from an Islamic perspective: Malaysian banks are a model. The study highlights the importance of highlighting Libyan Islamic banks' experience in reducing bank liquidity from the perspective of Islamic Malaysian banks as a model. (3) Method: The study followed a qualitative approach to evaluating internal and external factors, circumstances and variables associated with Libyan Islamic banks' experience in reducing bank liquidity from an Islamic perspective. Individual open interviews were conducted with employees of Libyan Islamic Banks, estimated at 15 employees from Libyan Islamic Banks. Fifteen questions were posed to participants, centered on internal control and its elements on bank liquidity and its components from an Islamic perspective. The study found several findings, (4) Results: including that bank liquidity risk is the risk to banks and may amount to a crisis related to the bank's lack of cash that enables it to fulfil its day-to-day duties to customers. And (5) Conclusion: include an attempt to adopt a peace model and to open the door to short, medium and long-term investments in order to maintain the levels and rates of bank liquidity of Libyan Islamic banks.

Abstract

This study aims to analyze the practice of the Khanduri Blang ritual in Samuti Makmur Village, Bireun Regency, Aceh Province from the perspective of Qawa’id Fiqhiyyah. The Khanduri Blang ritual is a religious tradition that involves a series of activities; offerings, and prayers carried out by the Acehnese people in order to commemorate or celebrate an event. This study uses a qualitative approach, data were collected through in-depth interviews, observations, participation and analysis of the Khanduri Blang ritual text. The results of the study show that principles such as mashlahah (benefit), mafsadah (badness), istihsan (virtue), and urf (tradition) in Qawa’id Fiqhiyyah are the basis for assessing the suitability of the ritual with Islamic values. In addition, the Khanduri Blang ritual is not only a series of religious activities, but also a manifestation of how the principles of Qawa’id Fiqhiyyah are rooted in the religious and cultural practices of the Acehnese people. The implications of this study provide a deeper understanding of the relationship between religion, culture and Islamic legal principles in a society.
