Abstract

Gadai adalah suatu hak yang diperoleh seseorang yang berpiutang atas suatu barang bergerak atau tidak bergerak yang diserahkan kepadanya oleh seorang yang berutang atau oleh seorang lain atas namanya, dan memberikan kekuasaan kepada orang yang berpiutang itu untuk mengambil pelunasan dari barang tersebut secara didahulukan dari pada orang-orang yang berpiutang lainnya, dengan pengecualian biaya untuk melelang barang tersebut. Tujuan penelitian ini adalah untuk menjelaskan praktek gadai yang dilakukan oleh masyarakat di desa Karang Kedawung Kabupaten Jember dari sudut pandang hukum Islam. Penelitian ini adalah penelitian kualitatif deskriptif. Teknik observasi, wawancara dan dokumentasi adalah teknik yang dilakukan untuk mengumpulkan data yang dibutuhkan di dalam penelitian ini. Hasil penelitian ini menunjukkan bahwa pemanfaatan barang gadai (sawah) tidak sesuai dengan hokum Islam karena mereka mengikuti adat kebiasaan yang sudah lama ada yaitu gadai identik dengan pemanfaatan barang gadai.

Abstract

In reality, the customary rules of marriage between one indigenous people are different from other indigenous peoples, between one tribe is different from another, between those who are Muslim are different from those of other religions, as well as there are differences in marriage customs between urban and rural communities. other. Customs that have become a customary law will be more difficult and stronger because violations of them will meet with a sanction in accordance with the regulations that apply and are obeyed in that society. Including the custom followed by the people of Tenggulun Village, Solokuro District, Lamongan Regency where there is a prohibition on marriage caused by mangku dalan and temu corner when it is not complied with, then in the future the family will experience bad luck in the household. The results of the study found that customs in marriage in the form of prohibitions on mangku dalan customary marriages and corner gatherings carried out by the people of Tenggulun Village, Solokuro District, Lamongan Regency according to 'urf are included in 'urf shahih because they are considered not to conflict with syara law'. Meanwhile, according to Islamic law and Law No. 1 of 1974 there are no prohibitions like the above, and the public's reason for these prohibitions is only to get safety, good luck, and blessings from Allah SWT.

Abstract

Money Politics is an attempt to influence other people by using material rewards or can be interpreted as buying and selling votes in the political process, power and the act of distributing money, whether personal or party property, to influence voters' votes ahead of the day of the general election. The practice of Money Politics is carried out by giving money, basic necessities including rice, oil and sugar to the public with the aim of attracting public sympathy so that they vote for the party concerned. This type of research is library research (Library Research is a data collection technique by conducting a review study of books, literature, notes and reports. Islamic law and law view money politics, that is, they both consider money politics in elections is haram or prohibited. Meanwhile, the difference is that in Islamic law and law, money politics is viewed as an act that is prohibited by the Shari'a and acts of money politics are included in the category of risywah, whereas in positive law, money politics is viewed as an act that violates the law. -laws governing elections. Abstract

Dalam perkawinan, hukum adat di daerah-daerah tertentu memiliki sifat khusus, maksudnya hukum adat lebih dikedepankan daripada konstitusi tertulis misalnya hukum negara atau syariat Islam. Masyarakat Desa Tenggulun juga melaksanakan tradisi menghitung weton dalam tradisi pernikahan. Mula-mula menemukan kecocokan kedua mempelai melalui pemakaian perhitungan neptu kedua calon mempelai, lalu menemukan hari baik yang akan digunakan sebagai hari penyelenggaraan pernikahan. Pemakaian perhitungan weton yang paling penting dalam upacara pernikahan ialah untukmenentukan hari baik ketka penyelenggaraan ijab qabul, adapun untuk acara walimah menyesuaikan waktu ijab. Rumusan masalah dalam penelitian ini adalah: Bagaiman tinjauan ‘urf terhadap perhitungan weton dalam tradisi pernikahan adat Jawa di Pendekatan penelitian ini ialah penelitian kualitatif, yakni penelitian yang diajukan untuk menguraikan serta menganalisis fenomena, kejadian, aktivitas masyarakat, sikap, keyakinan, anggapan, gagasan orang secara individu maupun komunal. Dimaknai juga sebagai pencarian makna, pemahaman, pemahaman, pemaknaan mengenai sebuah kejadian, peristiwa atau kehidupan manusia dengan terlibat langsung maupun tidak langsung dalam setting yang diteliti, kontekstual, serta menyeluruh. Dari penelitian ini dapat disimpulkan sebagai berikut Praktik perhitungan weton di Desa Tenggulun Kecamatan Solokuro Kabupaten Lamongan dilakukan oleh perjangga, dalam pandangan ‘urf termasuk dalam ‘urf shahih karena telah memenuhi syarat untuk dapat dikatakan sebagai ‘urf yang dapat diterima. Syarat yang dimaksud ialah tidak bertentangan dengan syariat Islam, tidak menimbulkan kemafsadatan dan menghilangkan kemaslahatan, berlaku umum di kalangan kaum muslim, dan tidak berlaku dalam ibadah mahdhah.

Abstract

The shift in values in the practice of customary inheritance law in Indonesia is an inevitable phenomenon along with social, economic, and cultural developments in multicultural societies. Customary inheritance law, which was initially based on the principles of kinship, deliberation, and social balance, now faces challenges due to the entry of modern values, national law, and religious influences. This study aims to analyze the dynamics of these value shifts, the factors that drive change, and their implications for the social order of indigenous peoples. The research method used is a juridical-sociological approach with literature study. The results of the study show that the shift in the value of customary inheritance law is more influenced by modernization, urbanization, and awareness of gender equality. This shift has a positive impact in the form of growing the value of justice and the protection of women's rights, but it also has negative impacts such as weakening social cohesion and the fading of cultural identity. Thus, a strategy of reconstruction of customary inheritance law that is adaptive to the development of the times, without eliminating the values of local wisdom that are the main foundation of customary law.
