Abstract

Perlindungan Hak Cipta di perlukan untuk mencegah pelanggaran hak ekonomi dan hak moral pencipta. Hak Cipta merupakan hak yang hasil karyanya di bidang ilmu pengetahuan, sastra dan seni. Salah satu bentuk ciptaan yang dilindungi Hak Ciptanya berdasarkan UU Hak Cipta adalah Desain Grafis. Desain Grafis merupakan bentuk hasil karya manusia yang berbentuk gambar, tulisan yang didalamnya memiliki makna tersendiri. Adanya UU Hak Cipta tersebut tidak membuat masyarakat Indonesia patuh akan perlindungan Hak Cipta. Masih sering terjadi penggunaan dan penggandaan Desain Grafis tanpa memperoleh izin dari Pencipta. Maka, tujuan penelitian ini adalah untuk mengkaji hak pencipta terhadap Desain Grafis yang digunakan dalam produk penjualan di Indonesia. Penelitian ini menggunakan jenis metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil penelitian ini adalah terdapat beberapa perlindungan hukum yang dapat dilakukan oleh pencipta yaitu preventif dan represif, dan memberikan sosialisasi pengetahuan mengenai pentingnya perlindungan HKI kepada masyarakat. Untuk mencegah terjadinya pelanggaran terhadap karya intelektualnya, pencipta dapap melakukan pendaftaran atau pencatatan atas Desain Grafisnya. Apabila pencipta dirugikan haknya, maka pencipta dapat mengajukan gugatan sebagaimana telah disebutkan di dalam UU Hak Cipta.

Abstract

The legal issues surrounding labor privacy within Artificial Intelligence (AI)-based surveillance systems have become increasingly urgent in line with the growing use of such technologies to monitor worker productivity. In Indonesia, a significant gap persists between the constitutional guarantee of privacy rights under the 1945 Constitution of the Republic of Indonesia and actual practices in the field, a problem further exacerbated by the absence of specific regulations on AI surveillance. This study employs normative legal research methods with statutory, conceptual, and comparative approaches to examine this gap. The analysis compares Indonesia’s legal framework with Singapore’s Personal Data Protection Act (PDPA) 2012 and Malaysia’s PDPA 2010, using the criteria of transparency, consent, and accountability. Progressive legal theory serves as the analytical foundation, emphasizing the necessity of legal adaptation to safeguard human rights in the digital era. The findings indicate that Singapore and Malaysia provide clearer protections through explicit consent requirements and stringent data governance mechanisms. Accordingly, this study recommends a progressive legal framework based on explicit consent, transparency, and accountability standards to balance business efficiency with workers’ rights.

Abstract

The Occupational Safety and Health Management System (SMK3) is imperative as a preventive measure to mitigate workplace accidents within a company's environment. Indonesia has enacted legal regulations regarding SMK3, specifically Government Regulation Number 50 of 2012 concerning the Implementation of the Occupational Safety and Health Management System. Nevertheless, the existence of these regulations does not consistently enhance workers' awareness of their safety while at work. This research employs an empirical research method, gathering data through literature studies as secondary data and interviews with the safety officer of PT. GPI as primary data. The research findings conclude that PT. GPI has implemented SMK3 in Indonesia. However, the implementation of SMK3 at PT. GPI in Batam cannot be deemed effective due to the presence of workers unwilling to comply with the applied regulations, ultimately leading to workplace accidents. In addressing this situation, the company needs to enhance strictness and supervision of each worker to ensure compliance with every applicable occupational safety and health regulation.
