Abstract

Akta notaris seharusnya dapat memenuhi asas keseimbangan perjanjian. Hal ini dikarenakan Notaris adalah pejabat umum yang seharusnya menjamin pertukaran hak dan kewajiban secara adil diantara para pihak melalui akta yang dibuatnya. Penelitian ini menganalisis putusan hakim tentang pembatalan perjanjian sewa beli mobil dan implementasi asas keseimbangan dalam klausul pembatalan perjanjian sewa beli mobil yang dibuat di hadapan Notaris berdasarkan Putusan Mahkamah Agung Nomor 480K/Pdt/2020. Metode penelitian ini adalah yuridis normatif dengan bahan utama data sekunder yang diperoleh melalui studi dokumen. Hasil penelitian ini adalah sewa beli yang dibuat berdasarkan perjanjian dengan akta Notaris yang mengandung unsur dominasi kehendak salah satu pihak (penjual sewa) adalah tidak sah. Sewa beli mobil dianggap tidak sah karena Akta Sewa Beli Mobil Nomor 12 yang dibuat oleh Notaris AMKS tidak memenuhi syarat objektif sahnya perjanjian, yaitu kausa halal. Implementasi asas keseimbangan dalam klausul pembatalan perjanjian sewa beli mobil yang dibuat di hadapan Notaris adalah bentuk usaha penempatan para pihak dalam kedudukan yang seimbang dengan cara pembatasan wanprestasi sebagai syarat batal perjanjian, pencantuman klausul tentang prosedur khusus yang harus ditempuh sebelum melakukan pembatalan perjanjian, pembatalan perjanjian melalui pengadilan, dan pencantuman klausul kewajiban pengembalian biaya yang telah diterima oleh Penjual Sewa. Kata Kunci: Notaris, Akta Sewa Beli Mobil, Asas Keseimbangan Perjanjian

Abstract

Artikel ini membahas tentang pembatalan akta perjanjian pengikatan jual beli, akta kuasa menjual dan akta jual beli oleh Majelis Hakim Pengadilan Negeri Mataram. Pembatalan ini memenuhi unsur adanya perjanjian simulasi dalam proses pembuatan akta dimaksud. Terdapat pertentangan antara kehendak dan pernyataan yang tidak diketahui oleh pihak ketiga. Agar terwujudnya perbuatan simulasi, harus terdapat penyimpangan antara kehendak dan pernyataan. Adapun permasalahan yang diangkat adalah putusan Pengadilan Negeri Mataram Nomor 234/Pdt.G/2020/PN.Mtr yang membatalkan akta autentik sebagai penyalahgunaan keadaan merupakan perjanjian simulasi serta bagaimana implikasi pembatalan akta berdasarkan misbruik van omstagdigheden yang merupakan perjanjian simulasi yang berlaku bagi para pihak dan pihak ketiga yang beritikad. Untuk menjawab permasalahan tersebut digunakan metode penelitian yuridis normatif dengan melakukan pendekatan bahan kepustakaan. Adapun analisis data dilakukan secara diagnostik. Hasil penelitian ini, perjanjian simulasi merupakan penyimpangan dari syarat objektif dan subjektif suatu perjanjian. Ini berakibat sebuah perjanjian batal demi hukum atau dapat dibatalkan sepanjang dimintakan oleh pihak yang berkepentingan. Dengan begitu, Notaris dalam menjalankan jabatannya wajib mengedepankan sikap kehati-hatian agar akta autentik yang dibuatnya terbebas dari unsur perjanjian simulasi. Kata kunci: akta; pembatalan; perjanjian simulasi.

Abstract

The developments of technology make interaction between humans is easier, for example in the term of using social media. The Notary use is not prohibited, but the Notary should obey to the Notary Code of Ethics as a guide to Notary behaviours. The problems that will be discussed in this study are regarding the inclusion of a Notary position on social media and the procedure for imposing sanctions by the Notary Honorary Council against Notaries who violate the Notary Code of Ethics. In order to answer this problem, a normative juridical research method with a descriptive research typology is being used. The results of the analysis show that a Notary who lists his position on social media violates Article 4 paragraph (3) of the Notary Code of Ethics. This can be reviewed based on 2 (two) factors, namely aspects of forming personal branding and the Notary Code of Ethics. The Notary Honorary Council in carrying out its authority takes action based on reports both actively and passively. In giving the number of ethical sanctions, the Notary Honorary Council refers to the quantity and quality of the violations committed by the Notary. Based on this, Notaries are still allowed to use social media without including their position on social media. For the public, if they see someone who has listed the position of a Notary on social media, they can report it to the Notary Honorary Council. In addition, there is a need for a revision of the Notary Code of Ethics, especially regarding self-promotion because it does not follow the development of science and technology.

Abstract

The existence and role of state civil apparatus in the field of public services has a strategic position if without the role of state civil apparatus,the state's obligation to serve its citizens will not be carried out. The problems faced in the implementation of public services include the organizational management system that has not been maximized, the occurrence of disciplinary violations committed by state civil apparatus, poor performance, poor quality of public services provided, a lot of overlapping state civil apparatus, not maximally provided by the state, and Often there is the implementation of tasks that are not in accordance with their duties and responsibilities. At this time, the election of regional heads is a source of problems for mutations on a large scale, usually the elected regional heads make changes in the form of changing and decreasing positions to changing the workplace of an state civil apparatus. Then how is the governance of the state civil apparatus centralized and how is the merit system in managing the state civil apparatus. The research method used in this study uses qualitative methods, namely a research method by means of interviews, observation, documentation in collecting data, then on the data that has been found a data analysis will be carried out. According to the Indonesia State Civil Apparatus Act Law, the state civil apparatus recruitment system in Indonesia is inappropriate for regional head officials to transfer state civil apparatus for political reasons, based on proximity and others. If the regional head transfers his state civil apparatus without paying attention to the regulatory aspects, then a regional head has violated the law. The implementation of state civil apparatus governance in Indonesia is currently regulated by many rules, so that the legal rules for state civil apparatus governance support strongly. However, in terms of substance there are still many problems. There are so many rules that are not considered by regional head officials in transferring or promoting state civil apparatus.

Abstract

This research analyzes cases related to legal protection for grant givers who have fallen into poverty, even though grants are given free of charge and without receiving compensation, for Muslims based on Article 210 paragraph (1) the Compilation of Islamic Law there is a limitation on the amount of the grant, namely it cannot exceed one third to protect the rights of his heirs. The type of research used is doctrinal, taken from literature studies of statutory regulations. Based on the results of this research analysis, the implementation of grants for Muslims in Indonesia must follow the provisions in the form of pillars and grant conditions that have been determined in the Compilation of Islamic Law, including provisions regarding the maximum limit for grant implementation of 1/3 (one third) of the grantor's assets. The grant is null and void if it violates the provisions of Article 210 paragraph (1) of the Compilation of Islamic Law, this is because it violates the objective terms of the agreement. In Singapore there are restrictions when releasing an object through a grant in Singapore. In particular, the determination of rights and interests over land in Singapore is regulated by statutory regulations and the Controller of Residential Property as the Land and Property Registry Agency is a Singapore government institution that has authority over land in Singapore. Apart from being regulated in the Civil Code, grants are also regulated in the Compilation of Islamic Law in Indonesia.

Abstract

Akta risalah RUPS Perseroan Terbatas yang dilakukan melalui media elektronik yang dilakukan pada saat fenomena COVID-19 karena adanya kebijakan pembatasan sosial (social distancing) di Indonesia. Hal ini mengharuskan pelaksanaan RUPS dilaksanakan secara daring. Permasalahan dalam penelitian ini kedudukan hukum akta risalah RUPS yang dilaksanakan secara daring dan kewenangan Notaris dalam mengesahkan akta risalah RUPS yang dilaksanakan secara daring namun pada peraturannya mewajibkan kehadiran Notaris secara fisik dihadapan kedua belah pihak. Adapun hasil penelitian yaitu Kedudukan hukum akta risalah RUPS Perseroan Terbatas yang dilaksanakan melalui media elektronik adalah sah ketika telah ditandatangani. Tandatangan yang digunakan adalah tandatangan elektronik karena RUPS dilaksanakan secara daring. Tanda tangan diisi oleh ketua rapat dan paling sedikit satu orang pemegang saham yang ditunjuk oleh peserta RUPS atau akta risalah RUPS dibuatkan akta Notaris. Hal ini sejalan dengan ketentuan Pasal 90 Undang-Undang Perseroan Terbatas. Kemudian urgensi kewenangan Notaris yang dimana Notaris mengesahkan akta risalah RUPS yang diselenggarakan secara daring harus mendapatkan kepastian hukum. Dalam Pasal 15 Ayat (3) Undang-Undang Jabatan Notaris telah ditegaskan bahwa Notaris dapat mensertifikasi dokumen elektronik, namun dalam pelaksanaanya tidak ada payung hukumnya mengenai teknis dan tata caranya yang jelas sehingga menyebabkan kebimbangan dari Notaris untuk melaksanakannya.

Abstract

This study discusses the conditions of supervision carried out by the Financial Services Authority (OJK) in supervising the implementation of the provisions contained in Article 7 and Article 26 of the Financial Services Authority Regulation Number 33/POJK.04/2014 concerning the Board of Directors and Board of Commissioners of Issuers or Public Companies and Article 8 point a Financial Services Authority Regulation No. 34/POJK.04/2014 concerning the Nomination and Remuneration Committee of Issuers or Public Companies regarding the obligation to obtain recommendations from the board of commissioners or the nomination committee for the appointment, replacement and/or dismissal of members of the board of directors and board of commissioners of a public company. The Board of Directors and the Board of Commissioners are organs of a limited liability company whose appointment, replacement and/or dismissal must be carried out in accordance with the provisions of laws and regulations. However, in reality there is a violation committed by the public company of the above obligations as can be seen based on the Central Jakarta District Court Decision Number 660/Pdt.G/2019/PN Jkt.Pst. The study was conducted using a normative juridical research method by examining secondary data in the form of documents and regulations. Furthermore, to strengthen and confirm the data, interviews were also conducted with authorized officials at OJK.
