Abstract

Grant is one of the legal acts that is basically regulated in positive legal provisions in Indonesia, both civil law and Islamic law. However, in practice there are still some problems related to the change process, as a legal provision, of course, grants have pillars and conditions that must be met, which if there is one pillar that is not fulfilled, the contract of the grant can be canceled. In this regard, Decision Number 236/Pdt.G/2017/PA. Pal there is a request for grant cancellation made by the biological son of the grantor, so in this study the author will examine the juridical review of the grant cancellation process in religious courts as happened in Decision Number 236/Pdt.G/2017/PA. Pal to find out whether it is in accordance with applicable legal provisions. This research is qualitative research with the type of normative juridical research or legal research, literature approach or (labrary research). The results of this study show that the practice that occurred in Decision Number 236/Pdt.G/2017/PA. Pal in the case of mauhub (property granted) violates the provisions of article 210 paragraph (1) of the KHI where the maximum grant is only 1/3 of the total property of the grantor, but in this decision exceeds 1/3 part. Therefore, in the examination of the case, the Judge granted part of the plaintiff's claim, namely declaring void the grant 154/PT/IV/2009 dated April 6, 2009

Abstract

The increasing complexity of modern finance requires a strong ethical and legal framework. Islamic law offers a foundation such as Sharia principles that can effectively curb economic violations. This study develops an integrative framework by integrating fiqh al-jinayah into corporate management and offers targeted policy recommendations. Using a normative-doctrinal methodology, this research combines a comprehensive literature review with thematic content analysis of corporate Sharia policies and a comparative examination of Sharia-compliant and non-Sharia-compliant practices. The study's findings indicate that empowering the Sharia Supervisory Board (DPS) and conducting internal Sharia audits to institutionalize the values of amanah, siddiq, and ta'zir significantly enhances transparency and accountability. These measures help prevent embezzlement, fraud, and money laundering while promoting profit-sharing financing models. The moral approach of Sharia law complements the existing legal regime by addressing the root causes of corporate misconduct, linking divine accountability with procedural rigor. The research contribution seeks to align corporate regulations by incorporating ta'zir-based sanctions for financial violations, explicitly granting the Sharia Supervisory Board (DPS) sanctioning authority, and implementing ethics-based capacity-building programs for executives and board members. This initiative paves the way for integrating Islamic legal principles into modern business processes and strengthening corporate governance with a Sharia-based value orientation.

Abstract

Hiwalah merupakan sistem yang luar biasa yang selaras dengan kehidupan manusia, terutama karena banyak aspek kehidupan sehari-hari yang melibatkan interaksi sosial dan keuangan, atau muamalah. Lebih dari sekadar cara untuk melunasi utang, hiwalah berfungsi sebagai mekanisme untuk mengalihkan kewajiban atau dana keuangantidak hanya antar individu tetapi juga antar kelompok atau lembaga, seperti yang terlihat dalam sistem perbankan modern. Pada intinya, hiwalah melibatkan pengalihan utang dari debitur asli (muhil) kepada pihak ketiga (muhal alaih) yang juga berutang dalam jumlah yang sama, dengan syarat kedua utang tersebut memiliki nilai yang sama. Dalam pengaturan ini, kreditur (muhal) memperoleh hak untuk menagih utang dari pihak ketiga, berdasarkan pernyataan dari debitur asli seperti: Saya telah menugaskan Anda hak untuk menagih utang saya dari si fulan, karena ia berutang kepada saya dengan jumlah yang sama dengan yang saya berutang kepada Anda. Mohon untuk menagihnya darinya. Jika kreditur menyetujui pengalihan ini dengan sukarela, debitur asli tersebut kemudian dibebaskan dari kewajibannya. Di lembaga keuangan Islam, hiwalah dipraktikkan dengan landasan saling mendukung dan solidaritas. Tujuannya adalah untuk meringankan beban keuangan masyarakat dan mendorong keadilan dalam mengelola utang. Hiwalah juga membantu menjaga kelancaran sirkulasi keuangan, yang berkontribusi pada stabilitas ekonomi masyarakat secara keseluruhan. Yang terpenting, semua transaksi hiwalah dilakukan tanpa unsur riba, dengan tetap berpegang pada etika keuangan Islam.

Abstract

Abstract  Regulations in Indonesia state that a child under the age of 18 is under the authority of their parents, who are obligated to care for, educate, and meet the child’s needs, as stipulated in Article 47 paragraph (1) of Law No. 1 of 1974 on Marriage. Based on this provision, this study examines the legal issues in Decision Number 376/Pdt.G/2021/PA.Klk of the Religious Court of Kolaka, which granted a claim for the revocation of parental authority and simultaneously appointed a guardian for an individual who was already 20 years and 4 months old.The research addresses two main issues: the inappropriateness of the legal subject who, according to positive law, is already an adult; and a procedural defect in the form of the combination of two different types of cases in a single proceeding—namely, a contentious claim (contentiosa) and a non-contentious petition (voluntair).This study adopts a normative legal approach with two methods of analysis: statutory approach and case study approach. The sources of data include primary, secondary, and tertiary legal materials. The analysis reveals that the court’s decision is inconsistent with the principles of civil procedural law, which clearly distinguishes between claims and petitions. Furthermore, the appointment of a guardian for a legal subject who has reached adulthood without proving legal incapacity contradicts the provisions of Islamic law, the Indonesian Civil Code, and the Compilation of Islamic Law.Thus, the ruling contains both formal and material errors. This study highlights the importance of consistent application of the legal age of adulthood and formal clarity in the submission of cases in religious courts. Keywords: Parental Authority, Guardianship, Civil Procedural Law, Adult Child, Religious Court

Abstract

Standard clauses that are imbalanced in working capital financing contracts, with a case study on Decision No. 13/Pdt.G/2011/PN. End. The approach used is normative juridical, by examining laws and regulations, doctrines, and judicial considerations. Data were collected through library research covering various legal sources, including primary materials such as the Indonesian Civil Code (KUHPerdata), Law Number 8 of 1999 concerning Consumer Protection (UUPK), and Decision No. 13/Pdt.G/2011/PN.End. Secondary materials used include legal books and journals. Tertiary materials include legal dictionaries and encyclopedias. The results show that clauses granting unilateral authority to the business party, eliminating the debtor’s right to objection, and establishing irrevocable absolute power have violated the principle of contractual justice and the provisions of Article 18 of Law Number 8 of 1999 concerning Consumer Protection. Such clauses are declared null and void because they fail to meet the elements of free agreement and lawful cause in contract law. Therefore, there needs to be a reassessment of the practice of standard contracts in the financing sector to ensure fair legal protection for consumers.

Abstract

The research aims to analyze the legality and constitutional implications of appointing active members of the Indonesian National Armed Forces (TNI) as Cabinet Secretary from the perspective of Law Number 34 of 2004 concerning the TNI and fiqih siyasah. This doctrinal legal research uses legislative, conceptual, and comparative approaches. Data are from manuscript studies of legal materials and fiqih siyasah. The results show that the appointment of active military personnel to strategic civilian positions is contrary to the spirit of military reform and the principle of civilian supremacy. From the perspective of fiqih siyasah, this policy violates the principles of al-'adalah, al-amanah, and al-shura. As a result, it has the potential to undermine bureaucratic accountability, create conflicts of interest, and threaten the democratization of government. Consistency of legislation, strengthening of sharia-based governance ethics and the constitution to maintain the integrity of the state power structure are needed.

Abstract

Abstract  This study examines the practice of transferring fiduciary collateral objects by debtors through pawning without obtaining the creditor’s consent, with a particular focus on the District Court Decision of Tanjung Karang Number 1012/PID.SUS/2024/PN TJK. The increasing economic demands of society have encouraged the use of credit facilities from financing institutions, which commonly rely on fiduciary security as regulated under Law Number 42 of 1999. This instrument grants privileged rights to the fiduciary recipient. However, in practice, debtors frequently commit default by transferring the collateral object without the creditor’s written consent, thereby violating the provisions of Article 23 paragraph (2) of the Fiduciary Law. The purpose of this research is to analyze the legal provisions regarding the transfer of fiduciary collateral objects without creditor approval under Law Number 42 of 1999, as well as to examine the debtor’s legal liability in the case involving PT Adira Dinamika Finance Tbk. The research method employed is normative juridical, using statutory, case, and analytical approaches. Primary data sources consist of Law No. 42 of 1999 and the Indonesian Civil Code, supported by secondary data from academic literature and legal journals. The data were analyzed using a descriptive qualitative method. The findings indicate that the transfer of fiduciary collateral objects without written approval constitutes a criminal act, punishable by imprisonment of up to two years and a fine of Rp50,000,000, as stipulated in Article 36 of the Fiduciary Law. In the case of defendant Rio Aditia, it was proven that default and unlawful conduct occurred, resulting in financial losses for PT Adira Dinamika Multi Finance, Lampung Branch. Therefore, the creditor is entitled to claim compensation and execute the fiduciary collateral object based on the principle of droit de suite. Keywords: Fiduciary Collateral, Transfer of Objects, Creditor, Debtor

Abstract

Based on the Supreme Court’s annual reports from 2021 to 2023, there has been a significant increase in cassation-level cases involving joint property disputes. The number rose from 156 cases in 2021 (including remaining cases from 2020) to 167 in 2022, and further to 238 in 2023. This upward trend indicates growing dissatisfaction with the resolution of joint property cases in terms of justice and benefit for the disputing parties. This research aims to analyze the legal argumentation in resolving joint property disputes at the cassation level from a justice perspective, focusing on two Supreme Court decisions: Number 78/K/AK/2021 and Number 298/K/AK/2022. These decisions reveal contrasting interpretations of justice. In case 78/K/AK/2021, the division was 70% to the wife and 30% to the husband, differing from Article 97 of the Compilation of Islamic Law (KHI), which mandates equal distribution. Conversely, case 298/K/AK/2022 upheld a 50:50 division. The study uses a qualitative method with a normative juridical approach, analyzing Supreme Court jurisprudence, relevant positive law, and statutory provisions. Joint property division in Indonesia is governed by the Civil Code, Law No. 1 of 1974, customary law, and KHI, with varying approaches based on legal traditions and societal values. The findings suggest that legal interpretations should consider philosophical, juridical, and social dimensions. Therefore, justice in joint property division may require flexible proportions (e.g., 70:30), rather than a rigid 50:50 split, to reflect each party’s actual contributions and to uphold fairness and benefit for all parties involved.

Abstract

Perceraian dalam hukum Islam merupakan suatu perbuatan atau langkah yang dilakukan oleh sepasang suami istri jika berada dalam hubungan rumah tangga tidak dapat dipertemukan kembali dan jika diteruskan akan menimbulkan Madharat baik untuk suami, istri, anak dan lingkungannya. Begitu dalam Menurut hukum Islam, perceraian dilakukan dengan cara yang baik menciptakan manfaat bagi semua pihak yang berkepentingan, hal ini dapat terjadi jika memang tidak dapat lagi terwujudnya tujuan dari pernikanhan itu sendiri, sebagai mana yang tertulis di pasal 3 kompilasi hukum islam. Perceraian dapat terjadi dan dapat dikabulkan jika memenuhi alasanya, dapat dilihat pada pasal 19 peraturan pemerintah No 9 tahun 1975 jo, dan di pasal 116 kompolasi hukum islam. Metode penelitian ini mengarah pada penelitian kepustakawanan (library study), mengacu pada penerapan hukum, dan penegakan hukum di Indonesia dalam mewujudkan keadilan, kemaslahatan, perdamaian dan kedamian dalam masyarakat.
