Abstract

This paper aims to formulate a methodological pattern for Indonesian fiqh, which is a method for developing Indonesian Islamic law and giving an appreciation of Indonesian traditions. It is important to formulate this pattern in order to establish a methodological direction or starting point in establishing effective Islamic law in Indonesia and accordance with the socio-cultural conditions of the community. Several previous studies have contributed in establishing this methodological direction, but are not yet comprehensive. Through the study of comparative texts that analyzed using an Islamic legal philosophy approach to the thoughts of Hasbi Ash-Shiddieqy, Hazairin, and Abdurrahman Wahid, this paper concludes that the Indonesian fiqh methodology departs from the spirit to utilize fiqh so that it can be applied in Indonesian society mediated by local customs. To utilize the fiqh, the technical methodologies are various, but the pattern based on the fiqh methodology has a few things in common, that are utilizing "disagreed" legal sources, especially 'urf and istislah, using a meaning approach rather than just a lafaz approach, and applying ijtihad istiṣlāhī supported by bayani and qiyasi. This methodological pattern can be used to unify the various offers of Indonesian fiqh methodologies which in the future can be referred in formulating Islamic law in Indonesia.

Abstract

Ideas about environmental jurisprudence from Islamic boarding school intellectuals tended to experience stagnation after the KH era. Sahal Mahfudz and KH. Ali Yafie. However, the development of these ideas in the form of programs continues in many Islamic boarding schools. This article examines these developments at the Tebuireng Islamic Boarding School. The Tebuireng Islamic Boarding School was chosen because in recent years it has succeeded in making rapid developments in the field of waste management and has been recognized by the Ministry of the Environment as a model Islamic boarding school. To reveal the environmental preservation program at the Tebuireng Islamic Boarding School and its position as a continuation of environmental jurisprudence studies, this field research chose a qualitative type with an anthropological approach. In-depth interviews and participant observation were carried out to maximize data mining. As a result, it is known that environmental conservation efforts at the Tebuireng Islamic Boarding School, which began with a waste management program, are a series of long-term programs towards comprehensive environmental preservation including land, water and air. All parts of this long-term program were carried out with awareness of the need to actualize the ideas of environmental jurisprudence that had been initiated by Islamic boarding school intellectuals and their example.

Abstract

Studies of Islamic law in Indonesia have generally framed wasiat wājibah (mandatory will) merely as a normative innovation, without providing a comprehensive account of the epistemic processes and socio-cultural dialectics underpinning its formulation. This article examines the rationale behind wasiat wājibah in the drafting process as a form of institutional ijtihād (reasoning) responsive to the plural realities of Indonesian Muslim society. Employing a library-based method within a socio-legal framework, the study analyzes the Compilation of Islamic Law (KHI) alongside its official preparatory documents, legal periodicals, judicial decisions, and relevant regulations from other Muslim-majority jurisdictions. The findings reveal that the construction of wasiat wājibah under Article 209 of the KHI—which grants rights to adopted children and adoptive parents—emerged from an interplay among textual sources of the Sharīʿah (Islamic law), local ʿurf (custom) practices, and the maqāṣid al-sharīʿah (objectives of Islamic law) framework. This construction synthesizes naṣṣ (Qurʾān and hadith), customary adoption traditions, the views of Ibn Ḥazm, and legal precedents from Egypt and Morocco, as reflected in each stage of the KHI’s formulation. The study argues that wasiat wājibah functions as a legal instrument that is adaptive, progressive, and responsive to the demands of substantive justice in Indonesia’s plural Muslim society. It further recommends developing wasiat wājibah models to accommodate marginalized groups excluded from inheritance distribution while preserving the integrity of the foundational principles of the Sharīʿah.

Abstract

Artikel ini membahas aplikasi kritik hadis Ali Mustafa Yaqub dalam karyanya yang berjudul Hadis-hadis Bermasalah. Bahasan ini dipandang penting karena Ali Mustafa Yaqub memiliki peran besar dalam dinamika kajian hadis kontemporer di Indonesia dan Hadis-hadis Bermasalah adalah karya yang mendokumentasikan peran tersebut. Pembahasan dalam penelitian pustaka ini akan penulis lakukan menggunakan metode deskriptif dengan analisis yang akan memunculkan dua aspek aplikasi metode kritik hadis, yaitu alur dan kecenderungan rujukan. Melalui penelitian ini, diketahui bahwa alur kritik hadis Ali Mustafa Yaqub dalam Hadis-hadis Bermasalah adalah: a) Memaparkan pertanyaan; b) Menulis redaksi hadis beserta uraian rawi dan sanadnya; c) Mendeskripsikan kualitas sanad beserta penyimpulan kualitas hadis; d) Mengajukan padanan hadis lain untuk kemungkinan mengangkat kualitas hadis yang diteliti; e) Mendeskripsikan kritik matan beserta penyimpulan kualitas hadis; dan f) Mengemukakan refleksi sebagai bentuk tawaran pemahaman kepada masyarakat. Di beberapa jenis hadis, Ali Mustafa Yaqub tidak hanya melakukan analisis kualitas dengan kritik sanad, melainkan juga dengan kritik matan dengan parameter keselarasan dengan kaidah bahasa, Al-Qur’an atau hadis sahih, fakta historis dalam sirah nabawi, dan akal sehat atau sunnatullah. Adapun kecenderungan referensi yang dirujuk Ali Mustafa Yaqub adalah kitab-kitab yang berisi komentar tentang hadis problematis, dengan contoh nama pengarang: Al-Albani, Ibn Hibban, Al-Suyuthi, Al-Sakhawi, Ibn Hibban, dan Al-Minawi.

Abstract

The debate about the hujjah (cogency) of hadith has been going on since the classical era but has found a new chapter in the contemporary era. Since the classical era rejected the hujjah of hadith because of its transmission factor, the contemporary era (the modernist group) discusses it with a very radical question: whether hadith can be used as hujjah. It is important to trace the causes of these differences to maintain the continuity of hadith studies, between classical and contemporary. This article traces it by focusing on identifying the impact of modernist Muslim thought on the contemporary theory of the hujjah of hadith. To do this, this research targets three data: the theory of the hujjah of hadith in the classical era, the theory in the contemporary era, and the thoughts of modernist Muslims. The first data was extracted from Maḥmūd Ṭaḥḥan's book, the second data was from the work of al-Idlibī and Jasser Auda, and the third data was summarized from three books: the works of Aḥmad Amīn, Abū Rayyah, and al-Sibā'ī. The first and second data were analyzed comparatively and then connected to the third data which was analyzed through content analysis. Through this, it is confirmed that the contemporary theory of the hujjah of hadith is the impact of modernist Muslim thought which doubts the validity of hadith, the authority of the Prophet, and the revelation of hadith. Two contemporary theories of the hujjah of hadith emerged as counter and evaluative responses to three themes that modernist Muslims doubt.[Perdebatan tentang kehujjahan hadis memang telah terjadi sejak era klasik, namun mendapati babak baru dalam era kontemporer. Jika diskusi di era klasik menolak kehujjahan hadis karena faktor transmisinya, era kontemporer (kelompok modernis) mendiskusikan hal itu dengan pertanyaan yang sangat radikal, yakni apakah hadis memang bisa dijadikan hujjah. Perbedaan itu penting dilacak penyebabnya untuk menjaga kesinambungan kajian hadis, antara klasik dan kontemporer. Artikel ini melacak hal itu dengan fokus pada identifikasi dampak pemikiran muslim modernis pada teori kehujjahan hadis kontemporer. Untuk melakukannya, penelitian ini menggali tiga data, yakni teori kehujjahan hadis era klasik, kehujjahan hadis era kontemporer, serta pemikiran-pemikiran muslim modernis. Data pertama digali dari kitab Maḥmūd Ṭaḥḥan, data kedua dari karya al-Idlibī dan Jasser Auda, lalu data ketiga dirangkum dari tiga kitab: karya Aḥmad Amīn, Abū Rayyah, dan al-Sibā’ī. Data pertama dan kedua dianalisis secara komparatif lalu dihubungkan dengan data ketiga yang dianalisis melalui analisis konten. Melalui hal itu, terkonfirmasi bahwa teori kehujjahan hadis kontemporer merupakan imbas dari pemikiran muslim modernis yang meragukan validitas hadis, otoritas Nabi, dan kewahyuan hadis. Dua teori kehujjahan hadis kontemporer muncul sebagai respons kontra dan evaluatif atas tiga tema yang diragukan muslim modernis tersebut.]
