Abstract

Islamic religious traditions in Indonesia carried out by a group of muslim communities ideally have legitimacy from valid legal sources. Interestingly, most of them do not fully understand this source but they believe in its benefits, as is the tradition of reciting Surah al-Waqi'ah which is carried out routinely at Pesantren Tebuireng which is believed to bring property based on a hadith. Using a descriptive quantitative approach, this research examines the level of understanding and trust of the students towards the activities carried out and the hadith behind based on the theory of living hadith studies. In addition, the test employs Bloom's taxonomy theory as an approach to evaluate activities based on a questionnaire. The goal, this research can provide a clear statistical description of the related problems. As a result, the students on average already have strong beliefs in terms of their affective and psychomotor aspects. However, in the cognitive aspect, it still needs to be improved so that later the tradition and the legal sources behind them can be properly integrated

Abstract

Without knowledge of the asbāb al-wurūd, individuals can easily misunderstand hadiths. Moreover, the specific hadith under consideration serves as a source of Islamic jurisprudence (jurispridential hadith or hadith of fiqh), thereby potentially leading to errors in legal interpretations. To mitigate such occurrences, this article aims to elucidate the concept of asbāb al-wurūd both theoretically and practically in the context of understanding fiqh-related hadiths. This research addresses three key questions: a) the definition and principles of asbāb al-wurūd; b) the significance of hadith in Islamic jurisprudence; and c) the application of asbāb al-wurūd in interpreting fiqh-related hadiths. Through a literature review and qualitative descriptive analysis, data is gathered from diverse reliable sources, including journal articles, traditional texts (turāth), scholarly works, and credible documents. The findings demonstrate that asbāb al-wurūd involves studying the contextual background of hadiths to discern their intended meanings. Furthermore, the application of asbāb al-wurūd in fiqh-related hadiths encompasses six functions: specifying the general, defining the absolute, elaborating on the universal, clarifying abrogated rulings (naskh), providing legal reasoning (taṣrīḥ), and explaining ambiguities (musykil).

Abstract

This article examines the understanding of Asbāb Wurūd al-Ḥadīth through a socio-cultural approach and its application within the Indonesian cultural context. The reinterpretation of hadiths with asbāb al-wurūd must always consider historical, social, and cultural factors to reveal the underlying contexts, whether they involve questions posed to the Prophet Muhammad or other circumstances. This study emphasizes the importance of investigating hadiths through a socio-cultural lens for a more comprehensive and contextual analysis. The research aims to uncover various implicit meanings embedded within the social, cultural, and traditional dimensions of the hadith, providing broader insights into their relevance and applicability in different cultural settings, particularly within Indonesia. Conceptually, this research is a literature review employing qualitative methods. The analysis utilizes descriptive techniques alongside a contextual approach developed by John Dewey, which focuses on situational and environmental factors influencing hadith transmission. The key findings of the study include the identification of several hadiths analyzed through socio-cultural dimensions that can be applied within the Indonesian cultural framework. These examples include: (1) the hadith about wearing sandals during prayer (social aspect), (2) the hadith about wearing a turban (cultural aspect), (3) the hadith about women’s leadership (political aspect), and (4) the hadith regarding the command to bathe on Fridays (economic aspect). In conclusion, the socio-cultural approach offers a significant contribution to contextualizing hadiths and adapting them to the unique cultural conditions in Indonesia, enhancing their relevance and applicability in modern society.

Abstract

Hadis-hadis yang kontradiktif atau hadis mukhtalif seringkali menimbulkan kebingungan dalam menentukan suatu hukum. Oleh karena itu, penelitian ini mengkaji tentang bagaimana para ulama fikih dan ulama hadis mengambil hukum yang bersumber dari hadis-hadis yang kontradiktif tersebut. Objek penelitian ini adalah metode yang digunakan oleh ulama fikih dan ulama hadis sebagai dasar dalam pengambilan hukum serta mengkomparasinya sehingga dapat diketahui formula atau rumusannya. Penelitian ini merupakan kajian kepustakaan dengan menggunakan analisis isi sebagai teknik analisis data. Hasil penelitian ini menunjukkan bahwa antara ulama hadis dengan ulama fikih mempunyai urutan metode yang sama dalam menyelesaikan hadis-hadis yang kontradiktif, yaitu metode al-jam'u, nasakh, tarjih dan tawaqquf. Hanya saja, Imam Abu Hanifah mempunyai urutan yang berbeda, yaitu metode nasakh, tarjih, al-jam'u dan tawaqquf. Komparasi metode yang digunakan oleh kedua kalangan ulama tersebut baik muhaddisin maupun fuqaha' bersepakat mendahulukan metode al-jam'u sebagai usaha untuk tidak menganggurkan salah satu hadis dengan hadis lainnya. Namun berbeda dengan Imam Abu Hanifah yang lebih mendahulukan metode nasakh daripada metode al-jam'u sehingga konsekuensinya terdapat hadis yang tidak digunakan.

Abstract

Paradigma epistemologi konstruksionisme penting dipaparkan karena hal ini menjadi pondasi dalam berpikir dan memandang bentuk sumber pengetahuan, apakah itu berupa hakikat yang sebenarnya atau sesuatu yang dibangun oleh masyarakat, sehingga, melalui paradigma ini seseorang dalam melakukan penelitian secara lebih akurat. Artikel ini memiliki tujuan untuk memaparkan secara komprehensif terkait paradigma epistemologi konstruksionisme sebagai landasan dalam penelitian sosial, baik itu dalam tataran konsep maupun penerapannya. Dengan menggunakan metode penelitian pustaka dan pendekatan kualitatif, tulisan ini menggunakan analisis deskriptif untuk menggali data pada berbagai sumber. Adapun sumber data utama dalam tulisan ini adalah buku berjudul “The Foundations of Social Research: Meaning and Perspective in the Research Process” yang ditulis oleh Michael Crotty, sedangkan sumber data penunjang adalah berbagai buku ilmiah, artikel jurnal, dan beberapa dokumen lain yang dapat dipercaya. Hasil dari tulisan ini menunjukkan bahwa konstruksionisme merupakan salah satu paradigma dalam epistemologi yang dapat dijadikan basis berpikir untuk melakukan penelitian sosial, baik itu penelitian lapangan seperti pendekatan fenomenologi maupun penelitian pustaka seperti pendekatan hermeneutik. Selain itu, paradigma epistemologi ini saat diterapkan dalam penelitian sosial akan selalu mengikuti 4 elemen pokok, yaitu epistemologi, sudut pandang teoritis, metodologi, dan metode.

Abstract

Studies of Islamic law in Indonesia have generally framed wasiat wājibah (mandatory will) merely as a normative innovation, without providing a comprehensive account of the epistemic processes and socio-cultural dialectics underpinning its formulation. This article examines the rationale behind wasiat wājibah in the drafting process as a form of institutional ijtihād (reasoning) responsive to the plural realities of Indonesian Muslim society. Employing a library-based method within a socio-legal framework, the study analyzes the Compilation of Islamic Law (KHI) alongside its official preparatory documents, legal periodicals, judicial decisions, and relevant regulations from other Muslim-majority jurisdictions. The findings reveal that the construction of wasiat wājibah under Article 209 of the KHI—which grants rights to adopted children and adoptive parents—emerged from an interplay among textual sources of the Sharīʿah (Islamic law), local ʿurf (custom) practices, and the maqāṣid al-sharīʿah (objectives of Islamic law) framework. This construction synthesizes naṣṣ (Qurʾān and hadith), customary adoption traditions, the views of Ibn Ḥazm, and legal precedents from Egypt and Morocco, as reflected in each stage of the KHI’s formulation. The study argues that wasiat wājibah functions as a legal instrument that is adaptive, progressive, and responsive to the demands of substantive justice in Indonesia’s plural Muslim society. It further recommends developing wasiat wājibah models to accommodate marginalized groups excluded from inheritance distribution while preserving the integrity of the foundational principles of the Sharīʿah.
