Abstract

The Special Region of Yogyakarta has experienced developments (or can also be termed as "regressions") in the enforcement of land regulation since time immemorial. A new chapter commenced following the enactment of Law No. 13 of 2012 on the Special Status of the Yogyakarta Special Region (UUK). One of the provisions in Article 7, Paragraph (2) of UUK pertains to land affairs, which, among other things, led to the issuance of the Yogyakarta Special Region Governor Regulation (Pergub) No. 34 of 2017 on Village Land Utilization. This research aims to identify the issues arising from the implementation of Pergub No. 34 of 2017 within the various institutions vested with authority in the implementation of this policy. A qualitative methodology was employed in this study, utilizing observation, interviews, and an intensive document analysis approach. Villages serve as the governing bodies directly responsible for Village-owned Land and are mandated to conduct an identification of Sultan/Pakualaman Ground for the purpose of changing its status to the ownership of the Sultan/Pakualaman. The Department of Land and Spatial Planning, acting as the facilitator for the planning and implementation of land affairs and spatial planning, subsequently carries out inventory, identification, and verification processes. Furthermore, it oversees the utilization of Village Land with the Right of Anggaduh. The implementation of Pergub No. 34 of 2017 on Village Land Utilization has been carried out by all relevant departments or stakeholders possessing authority and/or serving as facilitators on behalf of the Sultanate of Ngayogyakarta/Dutchy of Pakualaman.

Abstract

This paper aims to examine the contribution of agrarian reform in addressing the gerontocracy of agriculture in rural areas. The research specifically focuses on examining how the post-agrarian reform program in Gunung Kukusan hamlet has shifted land ownership and control from the older to the younger generation, and how agrarian reform has influenced changes in land management control. The research was conducted using a qualitative approach. Data collection techniques included in-depth interviews, observation, and documentation. Data analysis was carried out qualitatively by categorizing and visualizing the data. The research results clearly demonstrate the issue of agricultural gerontocracy, particularly the tendency to view agricultural activities as a secondary profession. Agrarian reform through asset restructuring and access restructuring does not bring about changes in land control, ownership, and management. Land certification serves as a confirmation of ownership rather than a direct transfer of ownership. The practice of land grabbing shows that management control is entirely in the hands of landowners, most of whom belong to the older generation. The youth lack the authority to make changes to the generations-old coconut farming practices. This situation underscores the need for agrarian reform policies that accommodate the issue of youth landlessness.

Abstract

This study aims to analyze the status and validity of the situation drawings issued by the Ministry of Home Affairs, Directorate General of Agrarian Affairs, and examine their strength as evidence in proving land rights. The method used is normative-empirical legal research with a statutory, case, and conceptual approach, using a case study of Decision No. 12/G/2024/PTUN.PLG. The results of the study indicate that situation drawings have an important role as administrative evidence in land cases, especially for land that does not yet have a measurement letter or certificate. In this case, the 1984 situation drawing was proven to be able to reveal procedural flaws in the issuance of certificates by the Land Office. The conclusion of this study confirms that legally issued and administratively verified situation drawings have sufficient evidentiary strength in explaining the boundaries, location, and control of land. Although not the main evidence, situation drawings have strategic value in resolving land disputes and emphasize the importance of procedural compliance in the land registration system in Indonesia. Penelitian ini bertujuan menganalisis kedudukan dan keabsahan gambar situasi yang diterbitkan oleh Departemen Dalam Negeri, Direktorat Jenderal Agraria, serta menelaah kekuatannya sebagai alat bukti dalam pembuktian hak atas tanah. Metode yang digunakan adalah penelitian hukum normatif-empiris dengan pendekatan perundang-undangan, kasus, dan konseptual, menggunakan studi kasus pada Putusan No. 12/G/2024/PTUN.PLG. Hasil penelitian menunjukkan bahwa gambar situasi memiliki peran penting sebagai alat bukti administratif dalam perkara pertanahan, terutama untuk tanah yang belum memiliki surat ukur atau sertipikat. Dalam perkara tersebut, gambar situasi tahun 1984 terbukti mampu mengungkap cacat prosedur penerbitan sertipikat oleh Kantor Pertanahan. Kesimpulan penelitian ini menegaskan bahwa gambar situasi yang diterbitkan secara sah dan diverifikasi secara administratif memiliki kekuatan pembuktian yang cukup dalam menjelaskan batas, lokasi, dan penguasaan tanah. Meskipun bukan bukti utama, gambar situasi memiliki nilai strategis dalam penyelesaian sengketa pertanahan dan menegaskan pentingnya kepatuhan prosedural dalam sistem pendaftaran tanah di Indonesia.
