The preamble of the 1945 Constitution philosophically and constitutionally, based on the basic philosophy of Pancasila and the 1945 Constitution, every citizen has equal opportunity in terms of employment, accessing public facilities, obtaining life and decent living, including for persons with disabilities. Law No. 8 of 2016 on Persons with Disabilities emphasizes that "Persons with disabilities are part of an Indonesian society with equal standing, rights, obligations, and roles". Article 5 of Law no. 8 of 2016 on Persons with Disabilities that: "Every person with disabilities has equal rights and opportunities in all aspects of life and livelihood".

The purpose of this study is to analyze the setting of the education right for child labour in workingrelationships. The method used in this study is empirical normative. The results showed that the regulationof the fulfillment of the education right for child labour in the working relationship have not been maximal,because there is still a legal void in the Employment Law and the absence of synchronization of Law No.20 of 2003 on the National Education System, Government Regulation No. 48/2008 on Education Funding.The implementation of the 20% education budget has not been achieved so that uneven education is enjoyed.Therefore, a revision of the rules on the fulfillment of educational rights for child labour in an integrated andharmonious working relationship is required.

Transportasi laut memegang peranan yang sangat penting untuk memudahkan pengangkutan orang dan barang. Disamping itu, transportasi juga berperan sebagai penunjang, pendorong dan penggerak bagi pertumbuhan daerah yang memiliki sumber daya alam yang besar. Mengingat pentingnya angkutan laut maka perlunya hukum untuk mengatur sistem keselamatan pengangkutan laut yang diatur dalam Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran. Dalam hal keselamatan pelayaran harus menjadi perhatian oleh perusahaan yang bergerak di bidang pelayaran hal ini ditegaskan dalam Pasal 40 ayat (1) yang intinya menegaskan bahwa perusahaan angkutan di perairan pertanggungjawab terhadap keselamatan dan keamanan penumpang dan/atau barang yang diangkutnya.Walaupun terkadang pengangkutan dengan menggunakan kapal laut seringkali menimbulkan suatu permasalahan bagi pelayaran penumpang. Salah satunya adalah tidak terpenuhinya persyaratan teknis kelaiklautan dan persyaratan pelayanan minimal angkutan penyeberangan. Sehingga tidak sedikit penumpang mengalami kerugian baik materil maupun non materil.Berdasarkan realitas tersebut menunjukan perlindungan keselamatan penumpang harus mendapat jaminan keselamatan dan keamanan berdasarkan Undang-Undang Nomor 17 Tahun 2008 Tentang Pelayaran yang dengan jelas menyebutkan bahwa penumpang berhak mendapat perlindungan untuk keselamatannya

This study aims to find out and analyze the position and function of the National Counter Terrorism Agency (Badan Nasional Penanggulangan Terorisme/BNPT). This type of research is normative legal research. The approach used is the legislative approach, conceptual approach and case approach.The results of the study indicate that the BNPT is a non-ministerial state institution under the President and is responsible to the President. In carrying out its duties and functions, BNPT is coordinated with the Coordinating Minister for Politics, Law and Security. The task and function carried out by BNPT is to counter terrorism in Indonesia by using the soft power main approach (prevention). Through a soft power approach BNPT implements two programs, namely deradicalization and counter radicalization. Both of these programs are based on BNPT's view that reducing radicalism does not always have to use a repressive approach as done by the police in general. Law enforcement must be balanced with preventive measures (prevention) by using a pattern of humanitarian approaches so as not to create a sense of revenge and give birth to a new form of violence.

AbstractThis study uses a comparative study that seeks to find similarities and differences or compare the similarity of views of interfaith marriages according to national marriage law with fiqh. The basic marriage law in Indonesia is regulated in the Law of the Republic of Indonesia number 1 of 1974. While fiqh in question is the fiqh of four Mazhab in Islam.Interfaith marriage in Law number 1 of 1974 has not been clearly regulated. However, Clause 2 paragraph 1 states that marriage is legal if it is carried out according to the laws of each religious law and its beliefs. It is explicitly understood that if interfaith marriages are not in accordance with religious law, then the marriage cannot be held. This is in line with the marriage of interfaith in fiqh which is basically prohibited.Keywords: Marriage Different Religion; National Law; Jurisprudence.

penelitian ini menganalisis urgensi hukum internasional untuk kemaslahatan umat manusia dan difokuskan pada upaya penyelesaian sengketa dalam hukum internasional dan hukum islam. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan perundangan-undangan dan pendekatan konseptual. Data diperoleh melalui penelesuran pustaka dan dianalisa menggunakan tehnik analisa deskrpiti kualitatif. Hasil penelitian menunjukkan bahwa Seruan kepada perdamaian dan keinginan pada penyelesaian persengketaan internasional dengan jalan damai pada umumnya merupakan upaya pertama dan utama baik yang diatur hukum Barat terutama sejak terbentuknya Liga Bangsa-Bangsa yang kemudian digantikan oleh Perserikatan Bangsa Bangsa dalam Mukadidma Piagamnya menyerukan perlunya mewujudkan perdamaian dan kemanaan dunia internasional dan penegasan penghapusan imperialism dan kolonialisme. Hal ini kemudian berseuaian dengan kosnep hukum islam yang sudah dari dulu mengajarkan pentingnya perdamaian dan seruan perdamaian untuk uat manusia. Sehingga kedua sistem tersebut perlu dikorelasikan sehingga menjadi dasar dan pedoman untuk dalam mewujudkan tujuan PBB dalam Pasal 10 Piagam PBB terutama dalam menyelesaikan sengketa bangsa yang saat ini belum berkesudahan diantaranya konflik Israil dan Palestina, Yunani dan Turki, Jepang dan Cina. Demikian pula persengketaan soal rasisme di Afrika, di Myanmar dan bangsa-bangsa lain-lainnya.

Although government policies play an important role in improving education and IPM, maximizing overcoming the APS phenomenon, there is evidence of government efforts to transform even though these policies still need to be evaluated. Therefore, this study aims to reveal and evaluate the GEMAS LIMAS program policy in Bone Regency in terms of education design in overcoming APS. The research method used, sociolegal research with a conceptual approach, and data collection with direct interviews with policy makers related to this APS education program. The findings of the research are: first, the GEMAS LIMAS program is one of the strategies to overcome the education sector and human index development. Second, the financial sector and budget allocation are limited in maximizing the GEMAS LIMAS program. Third, there are gaps and inconsistencies in APS data from relevant agencies in Bone district.

Abstract:This study is a conceptual review of governance management in the perspective of Islamic law. It focuses on the management of a state by reviewing the literature relevant to the system of state governance in Islam. The researcher applied a normative and historical approach using analysis of the concept proposed by Islamic scholars in relation to the system of governance in Islam. The result of the study indicates that the system of government practiced by the Prophet Muhammad and Khulafaurrasidin became a role model in the management of a state. Islamic law has given the concept of state administration professionally and equitably. The Islamic government must be able to provide a concept of religion and at the same time provide the best security and services for its people. Keywords: Governance-Management-Islamic Law.

The purpose of this study is to review the implementation of government responsibility for fulfilling the rights of women prisoners at the Class IIA Watampone Correctional Institution. The type of research used is qualitative, using an empirical juridical approach, namely analyzing the articles in the applicable laws and regulations related to legal facts in the field. The results showed that the government's responsibility for the fulfillment of the rights of women prisoners at the Class IIA Watampone Penitentiary has not been fully effective due to several indicators of weak performance achievement, namely facilities and infrastructure that are not yet feasible due to budgets that are not yet human rights-based so that room facilities are still overcapacity. Health clinics and medical personnel are only permanently recruited at the Class IIA Watampone Penitentiary. As a result, the fulfillment of the rights of women prisoners still needs to be improved and optimal as mandated by Law Number 39 of 1999 concerning Human Rights and Law Number 12 of 1995 concerning Correctional Institutions (LAPAS).
