Abstract

Sexual Violence is a form of criminal act that in the modern era is very common in Indonesian society. Based on data from the KOMNAS Perempuan RI, in 2021 there have been approximately 1,721 Reports cases of violence against women. This Sexual Violence does not only occur physically, but has evolved into Electronic-based Sexual Violence. This Electronic-Based Sexual Violence has been regulated based on Article 14 paragraph (1) TPKS Law. The resolution of Sexual Violence Criminal Acts cases has so far been carried out on a criminal basis, which does not pay attention to the interests of victims. Therefore, the Writing Team tries to use Restorative Justice (RJ) as one way or alternative to solve cases of Sexual Violence Crimes, especially for electronic-based sexual violence in order to pay more attention to the rights of victims. This paper is written with the Dogmatic Normative Juridical research method which is realized through a conceptual approach and statute approach. The final result of this study is that RJ can still be applied both at the level of investigation and prosecution of electronic-based sexual violence crimes with notes: The article imposed on the perpetrator is Article 14 paragraph (1) of the TPKS Law where the threat of imprisonment is 4 years; there is no rejection from the Society ; there is peace between the perpetrator and the victim ; and the rights of victims are restored again by redress or other exercise of responsibility of the perpetrator. If one condition is not met, then RJ cannot be carried out and the criminal justice process continues in accordance with the Indonesian criminal procedure law.

Abstract

Laws are a fundamental component of a state, providing protection and ensuring that every person has the opportunity to receive medical treatment from qualified medical professionals. In the medical field, every action carries the potential for conflict, particularly between medical professionals and patients. When patients experience pain, disability, death, or other adverse outcomes, medical professionals may be accused of malpractice. It is important to recognize that there is always some level of risk involved in any medical procedure, but many patients do not fully understand the difference between malpractice and medical risk, leading to frequent misunderstandings. Malpractice occurs when medical professionals act either intentionally or negligently, which can result in the application of penal laws. In contrast, losses caused by inherent medical risks are not subject to such laws. The actions of doctors and medical professionals are regulated by the Indonesian Criminal Code, Indonesian Civil Code, and the Doctor's Code of Ethics. In conclusion, malpractice involves either intentional wrongdoing or negligence by medical professionals in the provision of medical services, and it is crucial to take steps to prevent such occurrences

Abstract

Penelitian ini mengevaluasi tantangan yang dihadapi oleh Badan Pengawas Obat dan Makanan (BPOM) dalam memastikan keamanan produk sebelum dan sesudah beredar di pasar. BPOM bertanggung jawab untuk melakukan evaluasi yang menyeluruh dan berulang terhadap produk guna memastikan keamanannya bagi konsumsi masyarakat. Tanggung jawab ini tidak hanya terbatas pada tahap persetujuan awal, tetapi juga mencakup pengawasan pascapasar untuk mendeteksi dan menangani risiko yang ditimbulkan oleh produk yang tidak aman atau ilegal. Dalam menjalankan mandatnya, BPOM bekerja sama dengan instansi pemerintah serta melibatkan masyarakat guna mempercepat proses deteksi dan penarikan produk bermasalah. Apabila ditemukan produk yang berisiko tinggi terhadap kesehatan, BPOM wajib mengambil tindakan tegas, seperti mencabut izin edar, menarik produk dari peredaran, meninjau ulang keamanannya, memusnahkan produk, dan menerapkan sanksi hukum yang berlaku. Perlindungan konsumen yang efektif menuntut BPOM untuk senantiasa waspada dalam mengawasi produk yang sudah maupun belum beredar. Selain itu, BPOM juga memiliki kewajiban untuk secara berkala memberikan informasi terkini kepada publik mengenai status keamanan produk demi meningkatkan transparansi dan kepercayaan konsumen. Penelitian ini menyimpulkan bahwa BPOM harus secara konsisten melaksanakan pengawasan pra-pasar dan pascapasar untuk memastikan bahwa bahan yang digunakan sesuai dengan yang terdaftar, guna menjaga kepercayaan konsumen dan mencegah kelalaian pengawasan.

Abstract

This study aims to analyze the application of the element of intent under Article 2 of Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Person, specifically as it relates to recruiters and their criminal liability. The focus is on determining whether a recruiter can be held liable when they claim to act solely as an intermediary without explicit knowledge of exploitation. This study employs a normative juridical method, employing both statutory and conceptual approaches. Legal norms and principles relevant to the concept of intent in criminal law are examined, along with an analysis of applicable laws and doctrinal interpretations in the context of human trafficking cases. The findings of this study reveal that intent under Article 2 of the Law on Trafficking in Persons encompasses both direct and indirect forms. Direct intent refers to situations where the perpetrator explicitly knows and aims to carry out exploitation. In conclusion, Article 2 of the Law on Trafficking in Persons is not limited to demonstrable knowledge of exploitation. It can also encompass situations where the recruiter should have had reasonable suspicion of potential exploitation but ignored warning signs. Therefore, recruiters can be held criminally liable as principal perpetrators when it is proven that their actions contributed to the trafficking chain, and they knew or should have known of the risks of exploitation involved.

Abstract

A minor is under the legal responsibility of their parents or guardians, as regulated in the Civil Code, the Marriage Law, and the Child Protection Law. This responsibility includes the obligation to care for, educate, and supervise the child until they reach adulthood or enter into marriage. In the context of unlawful acts (tort) committed by a child, this research is a normative juridical study using a statutory approach. It highlights the importance of parental supervision and the possibility of exemption from liability if it can be proven that the parents have exercised proper supervision. Through the case involving the child "R", this article emphasizes that parental negligence in supervision may result in legal consequences in the form of compensation obligations to third parties.

Abstract

Penelitian ini mengkaji perlindungan hukum terhadap pekerja freelance dan remote-working dalam sistem hukum ketenagakerjaan Indonesia. Meski belum diatur secara spesifik, kedua jenis pekerja ini dapat dikaitkan dengan hubungan kerja selama memenuhi unsur perintah, pekerjaan, dan upah, hubungan kerja dapat diakui secara hukum. Namun, banyak pekerja freelance dan remote-working bekerja tanpa perjanjian tertulis, sehingga menimbulkan ketidakpastian hukum dan minimnya perlindungan. Prinsip perlindungan tenaga kerja sebagaimana tercantum dalam UUD 1945 dan UU Ketenagakerjaan tetap berlaku, termasuk hak atas upah layak, jaminan sosial, serta perlakuan yang adil. Penelitian ini menggunakan metode yuridis normatif, yaitu penelitian hukum yang dilakukan dengan menelaah bahan-bahan pustaka atau data sekunder. Pendekatan yang digunakan adalah pendekatan peraturan perundang-undangan dengan bahan hukum yang meliputi bahan hukum primer, sekunder, dan tersier. kata kunci: hukum ketenagakerjaan, pekerja jarak jauh, pekerja lepas, perlindungan hukum.
