Abstract

This research was motivated by the lack of maximum mudharabah financing due to the high risk experienced by Islamic banking. In addition, Islamic banks are extra careful in channeling mudharabah financing. This study aims to find out what the results of the reconstruction of mudharabah financing look like. Relating to rebuilding the mudharabah contract, the aims and practices align with what is determined in accordance with the basic principles of Islamic banking. Researchers use qualitative phenomenological approaches that are descriptive, analytical and inductive. This research seeks to explore data to find the basics of phenomena, reality and experience. This research uses documentary studies and studies of theories to explain and conclude the problems raised. This research is descriptive, which means it describes or describes a situation, symptoms, and events. In this case, to find out problems related to the status of Islamic banking as shahibul mal in the mudharabah contract that occurred at Bank Syariah Indonesia (BSI) Regional South Sulawesi. From various related information, from references that discuss mudharabah transactions and their application in Islamic banking that occur at Bank Syariah Indonesia (BSI) South Sulawesi Regional. This study concluded that the reconstruction carried out at BSI still did not go as expected. There are still many obstacles faced, including in determining profits. Meanwhile, the mudharabah contract applied at BSI is free from maysir, gharar, and usury elements—Mudharabah financing practices. The profit-sharing ratio given to mudharabah financing benefits both banks and customers. Profit sharing system where operational costs must reduce the profit earned by the fund manager and must also return the funds provided by shahibul maal therefore the profit obtained by the mudharib is by what is agreed. Various customers have felt this financing because customers who previously did not have the capital to do business with this financing customers can have capital provided by the BSI Regional South Sulawesi Bank. In practice, the distribution of profits between the two parties is based on a pre-agreed ratio. The ratio is the share of business profits for each party whose amount is determined based on the agreement. The partnership relationship in mudharabah financing is a collaboration between shahibul maal to provide funds. In contrast, the other party, mudharib, provides his mind, energy, and time to manage the cooperation business. The most important element in mudharabah financing cooperation is trust. This belief is mainly from shahibul maal to mudharib. Shahibulmaal should act as a supervisor to the mudharib to avoid business risks. The author advises BSI always to supervise customers when managing funds provided by banks in order to create transparency between the bank and customers. The bank should analyze the character and ability of prospective customers first before providing financing to customers to run a business and manage the funds provided by the bank, in order to minimize losses obtained by shahibul mall and can establish transparent cooperation and in accordance with Islamic economic principles

Abstract

Penelitian ini dilatarbelakangi atas munculnya fenomena perekonomian di pondok pesantren Pondok pesantren memiliki potensi pengembangkan ekonomi. Namun, disayangkan ekonomi yang begitu melimpah belum dikelola secara syariah menurut maqashid syariah. Begitupula, mata pelajaran ilmu ekonomi yang diajarkan belum mengacu pada konsep syariah dalam perspektif maqashid syariah. Penelitian ini bertujuan untuk mendalami potensi penerapan pengembangan dan pemberdayaan ekonomi syariah di Pondok pesantren di Ponpes An Nur Tompobulu, Kabupaten Maros. Berbagai sumber daya yang ada di pesantren bisa diberdayakan sebagai fasilitas dalam penerapan dan pengembangan pemahaman dan praktik ekonomi syariah dalam kegiatan ekonomi. Metode penelitian ini menggunakan pendekatan kualitatif fenomologi yang bersifat deskriptif analitis dan induktif. Objek penelitian ini menggunakan beberapa pondok pesantren. Namun, lokasi utama penelitian berada di Pondok Pesanrtren An Nur Tompobulu Maros. Hasil penelitian menunjukkan pengembangan dan pemberdayaan ekonomi syariah bisa dalam bentuk penerapan di pondok pesantren yang bisa dirincikan menjadi beberapa hal, di antaranya pendidikan prinsip ekonomi syariah, akad dan kerjasama ekonomi syariah, akuntansi pesantren serta penginapan syariah, kuliner dan wisata halal. Sementara dalam bentuk pengembangan ekonomi syariah, pesantren sebagai lembaga yang dikenal dengan kemandiriannya bisa menjadikan Pondok pesantren sebagai laboratorium pengkajian ekonomi syariah, baik pada kitab fiqh klasik maupun pada kitab fiqh modern, membentuk forum bisnis syariah, menjadi islamic inspirator pengembangan ekonomi berbasis syariah. Penelitian ini menggunakan pendekatan kualitatif fenomenologi yang bersifat deskriptif analitis dan induktif dengan menggali data untuk menemukan hal-hal mendasar dari fenomena, realitas maupun pengalaman. Hasil penelitian ini diharapkan memberi kontribusi terhadap pengembangan ekonomi syariah dalam lingkup pesantren. Seluruh pemangku kepentingan diharapkan bisa mengaplikasikan serta menyebarkan pentingnya ekonomi syariah berbasis maqashid syariah.

Abstract

Research is motivated by the emergence of economic actors when conducting transactions without paying attention to the principle of justice as religious believers. Thus arose the division of the religious ummah. In fact, in the Islamic economy, one of the attitudes that need to be developed in transactions is mutual respect or not discriminating between Muslims and non-Muslims. The author tries to conceptualize the importance of the sharia economy in religious moderation. Islamic economic principles, such as justice, Amanah, and mutual respect will be developed in peace. The problem raised in this study is how the basic concept of Islamic economics in building the lives of Muslims and non-Muslims. As well as the importance of the Islamic economy in religious moderation. Whether the Islamic economy is at odds with the application of religious moderation. The research method used in this scientific work is descriptive qualitative. The author tries to explain the importance of the Islamic economy in religious moderation. The approach used is phenomenology. Where the author himself experiences and feels how important the Islamic economy is in the concept of religious moderation. A number of results obtained by the author include how important the Islamic economy is in religious moderation. To create peace and tranquility respecting each other's fellow religious believers must be the basic foundation in everyday life. In carrying out economic activities, sharia concepts will not be complete without being accompanied by religious moderation. Both Muslims and non-Muslims must be aligned in carrying out economic activities. This is in line with the basic principles of Islamic religious teachings and the sunnah of the Prophet Muhammad SAW. The time of the great prophet Muhammad SAW also practiced mutual respect in trading. Prophet Muhammad SAW never forbade carrying out economic activities with non-Muslims. It signifies that Islam justifies religious moderation in the economy

Abstract

Umar bin Khattab is a Caliph who replaced the leadership of Abu Bakar after his death. Umar bin Khattab led the people starting in the year 13 AH/ 634 AD. Poverty is decreasing and the welfare of employees is guaranteed. This research uses a descriptive qualitative method by collecting the data from books such as history books of Islamic economic thought, the historical milestone of the economic thought of Umar Bin Al Khattab, and books such as ijtihad of Umar bin Khattab. The results of this study revealed that Umar was a leader who became a role model not only in government but managing the finances of the state was also an excellent exemplar of him. Because many leaders today who carry out the fiscal policy do not consider the benefit of the people, instead enrich themselves and their colleagues in a great deal. The fiscal policy of Umar is based solely on maslahah that is in accordance with the Qur'an and Sunnah. The policy regarding the salaries of the heads of state and soldiers is a new thing. Because in the ages of the Rasulullah and Abu Bakr had never made a payroll to the Head of State and the Army. This is a sign which shows that Islamic fiscal policy in the period of Umar was more advanced.
