Abstract

Criminal acts do not yet have provisions that are expressly contained in Islamic law. Al-Quran and hadith do not explicitly regulate this issue. That is, regarding legal matters of understanding sexuality it is not mentioned in the realm of ḥudud's finger, the same is the case with adultery. The handling of juridical cases that limit sexual orientation experiences problems, especially regarding the formulation of criminal acts or delicts. The type of research used is through comparative sociological normative methods. Normative research is carried out by examining library materials which are secondary data, while sociological/empirical legal research methods are carried out by examining primary data obtained directly in the community. This study also uses a comparative approach (Comparative Approach) is research that is comparative in nature, which is compared both in the form of similarities and differences. The results showed that: 1) Sexual harassment is an act that includes dirty or indecent verbal expressions (comments, jokes and so on), indecent behavior, showing pornographic/obscene images, assault and indecent coercion such as forcing to kiss and hugging, threatening to buy a woman if she refuses to provide sexual services, to deception. Factors that influence the occurrence of sexual division among students are internal and external factors.

Abstract

This study discusses the application of the principle of consensualism in contract law, particularly in the case of a sale and purchase agreement containing elements of fraud as reflected in the Bandung High Court Decision Number 575/PDT/2019/PT.Bdg. The main focus of the study is to examine the validity of the sale and purchase agreement if there is a defect in will arising from fraud (bedrog) and its legal implications for the parties. The research method used is normative juridical with a library approach, which emphasizes the analysis of articles of the Civil Code, legal literature, and related court decisions. The results of the study indicate that the principle of consensualism as a requirement for the validity of an agreement (Article 1320 of the Civil Code) is not sufficient to be interpreted only with formal agreement, but must be based on free will, honesty, and without fraud. In this case, the binding agreement for the sale and purchase of a house (SP3R) was declared legally invalid because the object of the agreement did not match what was promised, so that the agreement of the parties was not born purely. The panel of judges emphasized that agreements arising from fraud can be annulled and even declared null and void (Article 1321 of the Civil Code), and all legal consequences must be restored, including the return of payment to the buyer. Thus, this study confirms that the principle of consensualism in Indonesian contract law cannot be separated from the principles of honesty, propriety, and good faith. This decision also strengthens the doctrine that agreements containing elements of fraud lose their legal legitimacy and do not produce legal consequences binding on the parties

Abstract

Perjudian merupakan praktik yang bertentangan dengan nilai-nilai agama, moral, dan sosial, serta membahayakan kesejahteraan masyarakat. Upaya Pemerintah Kab. Karo Untuk Menanggulangi Kejahatan Perjudian Dadu, serta Implementasi PP No. 9 Tahun 1981 Untuk Menanggulangi Perjudian dan Pandangan Fiqih Jinayah Terhadap Perjudian di desa naman teran dan desa sukandebi kec. Naman teran kab.karo. Metode penelitian yang digunakan adalah yuridis empiris yaitu penelitian hukum berdasarkan hukum yang berkembang di Masyarakat. Hasil penelitian tinjauan hukum pidana Islam, perjudian terdiri dari tiga unsur: permainan atau perlombaan, keberuntungan, dan taruhan. Perjudian dianggap sebagai tindak pidana karena merugikan masyarakat, harta benda, dan moralitas. Hukuman bagi pelanggar perjudian mencakup sanksi fisik berupa cambukan, sesuai dengan ajaran Islam. Dalam konteks Kabupaten Karo, tindakan pencegahan terhadap perjudian dilakukan oleh aparat desa melalui sosialisasi, keterlibatan masyarakat, penegakan hukum, pengawasan terhadap sarana, dan kerjasama dengan lembaga terkait. Tujuan utama larangan perjudian adalah untuk menjaga kekayaan, mencegah tindakan merugikan masyarakat, dan memaksimalkan keterlibatan aktif masyarakat dalam mencegah perjudian.

Abstract

Indonesia has again received an unfavorable nickname from the international community. The number of adolescent smokers in Indonesia increases every year. They are generally produced by smokers’ parents/environment. This time, it is nicknamed the country of baby smokers because the highest number of smokers in Indonesia are teenagers and children. The National Commission for Child Protection (Komnas PA) Aris Merdeka Sirait when speaking in Advocacy for the Implementation of KTR Regional Regulations for journalists at the Santi Denpasar Hotel, Bali. According to Aris, up to now 69% of teenagers in Indonesia are active smokers. They live in a smoking environment and family. Besides that, There are 89 million children exposed to cigarette smoke and their health is at risk. Of these, there are 230 thousand children under the age of 10 who are already active smokers. Law Number 39 of 2007 concerning Amendments to Law Number 11 of 1995 concerning Excise, defines Excise as a state levy imposed on certain goods which have the properties or characteristics specified in this law. Qualitative research methods make more effort in investigating the problem. These existing problems will be the basis used by researchers in retrieving data. Then the researcher determines the variables and measures them with numbers for analysis according to the procedures of the applicable statistics. Based on the results of this study, with the enactment of this Ministerial Regulation, the Head of Office re-stipulates excise rates with the following conditions: the re-set excise rates cannot be lower than the applicable excise rates, and/or n. The Retail Selling Price may not be lower than the applicable Retail Selling Price Limit per Stick or Gram, as stated in the Appendix which is an integral part of this Ministerial Regulation
